Amendment No.4 to Agreement with School Board of Miami Dade County DocuSIgn Envelope ID:58321005-3246-4822-9E2C-93B039098C01 Doou8ign Envelope ID:4A8DBC21-8EF9.4696-9007-88C70A082F22 Reso 2019.30958 AMENDMENT NO.4 TO AGREEMENT BETWEEN THE SCHOOL BOARD OF MiAMI-DADE COUNTY, MIAMI,FLORIDA AND • THE CITY OF MiAMI BEACH,FLORIDA • This Amendment No. 4 (the"Amendment") to the Agreement, dated November 8,2019, as amended by Amendment No. 1,dated August 19,2020, by Amendment No. 2, dated May 8, 2021, and by Amendment No. 3 dated June 18, 2021, (collectively, the "Agreement"), by and between the City of Miami Beach, Florida, a municipal corporation organized and existing under the laws of the State of Florida.having its principal place of business at 1700 Convention Center Drive,Miami Beach, Florida 33139("CMB")and The School Board of Miami-Dade County,Miami, Florida,a body corporate and political subdivision of the State of Florida,having its principal place of business at 1450 NE 2nd Avenue Miami, Florida CM-DCPS"), (CMB and M-DCPS may be individually referred to as a Party or collectively as Parties), is entered into this 5 day of August , 2022: RECITALS WHEREAS, CMB entered into the Agreement with M-DCPS in order to deploy its resources with M-DCPS and Miami Dade College ("MDC") in order to increase the competitiveness of the students of Miami Beach Senior High School by nurturing and supporting the dual enrollment programs taught at Miami Beach Senior High School(the"High School"),and Miami Beach Nautilus Middle School f/k/a Nautilus Middle School(the"Middle School");and WHEREAS, on August 19, 2020, the Parties executed Amendment No. 1 to the Agreement to continue the expansion of the program,as MDC resources permitted,by providing dual enrollment classes at the High School and the Middle School, in order to provide 80 graders, who attend the Middle School and Miami Beach Fienberg Fisher K-8 f/k/a Fienberg Fisher k-8 Center,with the opportunity to take dual enrollment courses at the Middle School;and WHEREAS, on February 10, 2021, the Mayor and City Commission adopted Resolution No. 2021-31572, authorizing the addition of Florida International University ("FIU") as an additional provider of dual enrollment courses under the Agreement; and WHEREAS,on May 8,2021,the Parties executed Amendment No.2 to the Agreement to allow CMB to maximize the number of dual enrollment course offerings for the 2020-2021 school year, based upon the approved budget for the program, by adding FIU as an additional educational partner;and WHEREAS,on June 18,2021, the Parties executed Amendment No.3 to the Agreement to allow CMB to maximize the number of dual enrollment course offerings for the 2021-2022 school year, based upon the approved budget for the program;and WHEREAS, on April 6, 2022, the Mayor and City Commission adopted Resolution No. 2022-32099,authorizing the City Manager to execute an agreement with the University of Florida (`UF"),to provide dual enrollment courses at Miami Beach Senior High School for the 2022-2023 school year, in an amount not to exceed $13,432,and every subsequent school year,subject to annual budget approval by the City Commission of the City's contribution for each subsequent school year;and • DocuSIgn Envelope ID:58321005-3246-4B22-9E2C-93B039098C01 • DocuSlgn Envelope ID:4ABDBC21-CEF9.4698-9D07-66C70A062F22 •• I . WHEREAS,to promote educational opportunities through the dual enrollment program in • Miami-Dade County,Miami Dade College(MDC)and M-DCPS entered into the 2022-2023 Dual Enrollment Articulation Agreement in July 2022, which is incorporated herein by reference and attached hereto as Composite Exhibit A;and .• WHEREAS, to promote educational opportunities through the dual enrollment program in Miami-Dade County, Florida International University(FIU) and M-DCPS entered into the 2022- 2023 Dual Enrollment Articulation Agreement in July 2022,which is attached as Exhibit A,and is incorporated herein by reference and attached hereto as Composite Exhibit A; and WHEREAS, to promote educational opportunities through the dual enrollment program in Miami-Dade County, University of Florida (UF)and M-DCPS entered into the 2022-2023 Dual • Enrollment Articulation Agreement in July 2022, which Is attached as Exhibit A, and Is Incorporated herein by reference and attached hereto as Composite Exhibit A;and WHEREAS, the Articulation Agreements with MDC, FIU and UF shall be collectively referred to herein as the"Articulation Agreement";and WHEREAS,through this Agreement, in partnership with M-DCPS,CMB seeks to combine its resources with M-DCPS, MDC, FIU, and OF in order to increase the competitiveness of the students attending Miami Beach Senior High School,by supporting the dual enrollment programs at the High School and the Middle School. NOW THEREFORE, in consideration of the mutual promises and conditions contained herein, and other good and valuable consideration, the sufficiency of which is hereby acknowledged, CMB and M-DCPS hereby agree to amend the Agreement as follows: 1. ABOVE RFcITAL,S. The above recitals are true and correct and are incorporated as part of this Amendment. I. r. 2. MODIFICATIONS. The Agreement is hereby amended(deleted items struck through and inserted items underlined)as follows: (a) Subsections 1.06 and 1.07 of Article I(Recitals and Definitions) is hereby deleted In their entirety and a new subsection 1.06 Is hereby added to the Agreement, as follows: 1.06 Adjunct instructor. Any reference to"adjunct instructor"shall refer to a full-time or part-time member of the teaching faculty of MDC. FIU or UF, who may be teaching dual enrollment courses at the Middle School or High School, as applicable. (b) Section 2.01 of the Agreement is hereby deleted in its entirety and replaced with the following: 2.01 Term of Agreement. FIU. or UF, as applicable. are terminated. In the event that a Dual Enrollment Articulation Agreement with one of the participating college institutions is terminated, the Agreement will remain in effect as to the remaining participating college institutions. This Agreement may be renewed for additional periods of time upon the mutual written consent of the Parties and subiect to such terms and conditions as the Parties shall determine In writing. (c) Section 2,03(8)(6)of the Agreement Is hereby deleted in Its entirety and replaced with the following: (6) It is anticipated that the cost(or the student instructional material costs will be $18.000 for Fall 2022 and Spring 2023 based upon the enrollment of 150 students in six(6)dual enrollment classes. Actual costs will be based on the actual cost for the classes and instructional materials, (d) The first full paragraph of section 2.06 of the Agreement is hereby deleted in its entirety and replaced with the following: 2.06 Course Selection and Scheduling. The High School or Middle School principal shall select the dual enrollment courses to be taught at the High School or Middle School, as applicable, provided that the courses are selected from the dual enrollment courses identified In the Articulation Agreement with MDC or FIU, as applicable, and the selected courses do not require a prerequisite course,The High School principal may also select courses,that do not require a prerequisite course, from the Dual Enrollment Articulation Agreement with UF. The High School Is responsible for ensuring that the student placement variables are provided to MDC, Flu and UF prior to scheduling the dual enrollment course.These variables include identifying qualified students and providing the adjunct instructor with the class schedule. The dual enrollment courses shall be accessible to all university/coliepe eligible students and may not be restricted to students enrolled in a specific high school academy or program at the High School. The adjunct instructor shall strictly adhere to the 2022-2023 Miami-Dade County Public Schools calendar and schedule, a copy of which is attached hereto as Exhibit B. The adjunct Instructor shall provide instruction every available school day for the Fall semester, from August 17. 2022 through January 20. 2023. and for the Spring semester, from January 24, 2023 through June 7,2023.
