A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE
RECOMMENDATIONS OF THE TOURISM AND CULTURE
DEPARTMENT, AND APPROVING THE SPECIAL EVENT
SPONSORSHIP FUNDING FOR THE FISCAL YEAR 2022/2023 FOR
THE FOLLOWING THREE (3) SPECIAL EVENT ORGANIZERS: (1)
AMERICAN BLACK FILM FESTIVAL; (2) FIU SURF & TURF BEACH
VOLLEYBALL TOURNAMENT, AND (3) SOUTH BEACH JAZZ
FESTIVAL, IN THE TOTAL AMOUNT OF $207,000 TO PROVIDE
FINANCIAL ASSISTANCE TO MIAMI BEACH-BASED SPECIAL
EVENTS; AND FURTHER AUTHORIZING THE CITY MANAGER AND
CITY CLERK TO EXECUTE THE SPONSORSHIP AGREEMENTS
RELATED TO THE APPROVED FUNDS.
WHEREAS, on June 23, 2021, the Mayor and City Commission accepted and
approved the recommendations of the Finance and Economic Resiliency Committee,
at its February 28, 2020 and June 11, 2021 meetings, and the recommendation of
the Neighborhood and Quality of Life Committee, at its September 23, 2020 meeting,
in part; and
WHEREAS, both Committees recommended approval of the revised Special
Events Requirements and Guidelines relating to City sponsorships, with an annual
budget not to exceed 1,500,000, with the said revisions creating an evaluation
process to analyze and process sponsorship requests based upon weighted criteria;
and
WHEREAS, the Miami Beach Special Event Sponsorship Program (the "
Program") was created in June 2021 to assist the City in the review of event
sponsorship and fee waiver request; and
WHEREAS, the Program process is formalized and allows the Administration
to properly.analyze and budget special event sponsorship requests; and
WHEREAS, the City' s current sponsorship process is codified within Section
12-7 of the City Code; and
WHEREAS, Section 12- 7 of City Code provides that "in considering approval
of a Sponsorship for an event, the City Commission may consider:
i. whether the event organizer has exercised good -faith, diligent efforts to
apply for grant funding that may be available from the City's Visitor and
Convention Authority ("VCA") or Cultural Arts Council (" CAC");
ii. the Event organizer's history and performance in delivering quality Events;
iii. any benefits being directly provided to the general public with respect to the
Event, such
iv. as free or discounted tickets to persons residing in the City of Miami Beach,
. . seniors,
v. veterans, or member of disadvantaged groups;
vi. whether the event is accessible to the general public (either as a ticketed
event or
vii. otherwise);
viii. . the demonstrable economic impacts associated with the Event;
ix. the demonstrable media commitments secured by the Event organizer for
the Event; or
x. the efforts undertaken by the Event organizer to mitigate any quality of life
impacts
xi. associated with the Event, including noise, littering, traffic or parking
impacts associated
"xii. with an Event"; and
WHEREAS, sponsorship requests are generally to be reviewed well in
advance of the date of each event, either as part of the City Commission' s annual
budget process, or through applications to the BCA or CAC; and
WHEREAS, any sponsorships request that falls outside of the standard
review process is subject to the Finance and Economic Resiliency Committee
(FERC) advisory review, as well as a heightened 5/ 7ths approval requirement by
the City Commission; and
WHEREAS, the Program addresses these elements and provides a platform
for event organizers to apply for city sponsorship in advance and allows the
Administration time to do a proper due diligence and budget planning for the fiscal
year; and
WHEREAS, the Program launched on January 1, 2022, and concluded on
February 28, 2022, with nine (9) event organizers starting the application, and four
(4) event organizers completing the application; and
WHEREAS, applicants who met all application requirements, including
deadlines were reviewed, and incomplete applications were disqualified; and
WHEREAS, four (4) applications were reviewed, and the Administration
made the following recommendation for three (3) events:
• American Black Film Festival, in the amount of$171,000;
• FIU Surf & Turf Beach Volleyball Tournament, in the amount of $
$6,500;
• South Beach Jazz Festival, in the amount of$29,500; and

WHEREAS, the Administration recommends the approval of the Miami Beach
Special Event Sponsorship recommendation for Fiscal Year 2022/2023 in an amount
not to exceed $207,000 for the three (3) aforementioned events.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND
CITYCOMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor
and City .Commission hereby accept the recommendations of the Tourism and
Culture Department, and approve the special event sponsorship funding for the Fiscal
Year 2022/2023 for the following three (3) special event organizers: (1) American
Black Film Festival; (2) FIU Surf & Turf Beach Volleyball Tournament, and (3) South
Beach Jazz Festival, in the total amount of $ 207,000.00, to provide financial
assistance to Miami beach-based special events; and further authorize the City
Manager and City Clerk to execute the sponsorship agreements- related to the
approved funds.

RECOMMENDATION
The Administration recommends the approval of the Miami Beach Special Event Sponsorship
recommendations for fiscal year 2022/2023.
BACKGROUND/HISTORY
The Miami Beach Special Event Sponsorship Program (the "Program") was created in June
2021 to assist the City in the review of event sponsorship and fee waiver requests.
The Program process is formalized and allows the Administration to properly analyze and
budget special event sponsorship requests. The City's current sponsorship process is within
the City Code:
Section 12-6 of the City Code defines a sponsorship as any contract, grant or other
commitment by the City to fund an event, either through:
-A cash or in-kind contribution, in any amount; or
-A reimbursement for City special event-related costs(police,fire, sanitation); or
-A waiver of special event permit fees(including user fees, adn'in fees, and square footage fees), in
excess of$25,000.
Section 12-7(c)of the City Code provides that"in considering approval of a Sponsorship for an
event,the City Commission may consider:
(i) whether the event organizer has exercised good faith, diligent efforts to apply for grant
funding that may be available from the City's Visitor and Convention Authority ("VCA") or
Cultural Arts Council ("CAC");

(vi)the demonstrable media commitments secured by the Event organizer for the Event; or
(vii)the efforts undertaken by the Event organizer to mitigate any quality of life impacts
associated with the Event, including noise, littering, traffic or parking impacts associated
with an Event.
In Section 12-7 of the City Code, sponsorship requests are generally to be reviewed well in
advance of the date of each event, either as part of the City Commission's annual budget
process, or through applications to the VCA or CAC. Any sponsorship request that falls outside

("FERC") advisory review, as well as a heightened 5/7ths approval requirement by the City
Commission.
The Special Event Sponsorship Process addresses these elements and provides a platform
for event organizers to apply for city sponsorship in advance and allows the Administration time
to do a proper due diligence and budget planning for the fiscal year, while also allowing for a
opportunities to curate a fiscal year of engaging, unique, entertaining, educational and fun
community events that express the spirit of Miami Beach residents, businesses, visitors, history
and ethos.
Accordingly, in it's second year, the program applications opened on January 1, 2022 and
closed February 28, 2022.The program is hosted at: MBEventSponsorship.gosmart.org.
Nine (9)event organizers opened the application and Four (4) event organizers completed the
application. During the months of April and May each application was reviewed and accessed.
ANALYSIS
The Program is for events held in Miami Beach. The purpose is to provide financial assistance
and in-kind support to local festivals, special events, community events, or programming that
attracts quality events and promotes community engagement and elevates Miami Beach as a
world-class tourist destination.
The City of Miami Beach considered special events that:
• provide unique and engaging experiences that increase resident quality of life;
• increase tourism by hotel rooms block contract(s)and targeted tourist attendance;
• promote Miami Beach as a national and international tourist destination;
• accessible to the general public;and
• strengthen Miami Beach by enhancing the City's Cultural Events.
Application review included an extensive review process that reviewed non-profit status, length

of event, history of event, hotel room block, whether attendees are regional, national and/or
international, resident/community benefit, marketing, and public relations exposure, utilization of
local venues and more.Applicants were required to have a mandatory dollar for dollar ($1 to $1)
match and demonstrate this match through• cash, other matching sponsorships, and/or in-kind
contributions.
Four (4) applicants who met all application requirements, including deadlines, were reviewed.
Incomplete applications were disqualified and applicants were invited to apply during the next
session,which launches on January 1, 2023 and will close on February 28, 2023.
According to the Special Events Sponsorship Guidelines approved by the City Commission, an
application must score at least 65% on the Sponsorship Score Card for the administration to
recommend that the sponsorship be awarded. Only three (3) met the threshold. Furthermore,
guidelines state that based on the score received from the Sponsorship Score Card, applicants
would receive that percentage of their Sponsorship request. Based on these guidelines, the
administration is making the following funding recommendations:

Event Descriptions:
American Black Film Festival (the Event): The American Black Film Festival is an annual event
dedicated to recognizing Black talent and show-casing quality film and television content by and
about people of African descent. The annual event will take place June 12-19, 2023 at the New
World Center, Regal South Beach Cinema, Ritz Carlton Hotel, and Royal Palm Hotel. This
event traditionally attracts 7,000 to 10,000 visitors each year with four(4)to five (5)host hotels.
FIU Surf and Turf Beach Volleyball Tournament (the Event): Proposed by Florida International
University, the 9th Annual FIU Surf and Turf event will take place at Lummus Park on March 17-
18, 2023. Every year, FIU produces this annual NCAA Women's invitation Beach Volleyball
Tournament which is free to the public and widely considered as a premiere collegiate beach
volleyball tournament on the East Coast, and one of the top two in the nation.
South Beach Jazz Festival (the Event): Proposed by Power Access, Inc., the 7th Annual South
Beach Jazz Festival will take place at locations throughout the City of Miami Beach on January
5-8, 2023. The festival promotes access, opportunity and inclusion for people with disabilities in
the arts through jazz. Performances will take place at the 1111 Lincoln Road Stage and Plaza,
the Euclid Oval on Lincoln Road, The North Beach Bandshell, Faena Hotel, with an additional
evening event on the weekend.
SUPPORTING SURVEY DATA
In the 2022 City of Miami Beach Resident Survey, 86% of residents agreed that free or City
sponsored art and cultural activities contribute to their quality of life in Miami Beach and 86% of

residents agreed that Miami Beach Cultural Activities (such as art shows, film festivals,
musicals,and live performances)contribute to the quality of life in Miami Beach.
FINANCIAL INFORMATION
The amount awarded for special event sponsorship for FY 2022/2023 is$207,000.
CONCLUSION
Accordingly, the Administration recommends the approval of the Miami Beach Special Event
Sponsorship recommendations for fiscal year 2022/2023.
The Program recommended funds will provide financial assistance and in-kind support to three
wonderful events. Together with annual contractual events (such as SOBE Wine & Food, Miami
Beach Pride, and Air& Sea Show),these events will begin the journey to create an environment
where, in partnership with the CAC and VGA, the sponsorship will support quality and well-
financed events and play a role in supporting the special event community. In addition, the
events will assist in the promotion of tourism, economic and cultural development efforts that
should have a positive impact on the entire city.
Program applications for FY 23/24 including events held between October 1, 2023 —
September 30, 2024 will be open and available from January 1, 2023 to February 28, 2023.
Sponsorships will be presented to Commission on or before June 2023 Commission meeting.

Florida International University athletics will be proposing an operating budget of$36,050 for the 2023 FY that
we are presently working on for the University athletic department budget. This budget covers the expenses
associated with equipment rentals,cleaning services,court set up and manicuring services,and game officials
hotels and their respective match fees.
This grant would help us cover the$16,000 of City services and fees that are anticipated. ($5000 deposit fee
would be refunded). We would be hard pressed to hold this event on Miami Beach without the awarding of
this grant.

Power Access inc., a non-profit 501(c)3 Humanitarian Organization based in Miami
Beach will produce the 7th annual South Beach Jazz Festival at locations throughout the
City of Miami Beach on January 5-8, 2023.
We have submitted an application for City Sponsorship for the 7th annual South Beach
Jazz Festival. We request a City Sponsorship in the amount of$40,000 to assist in our
high quality, non-profit,4-day music event. We will provide matching funds and already
have commitments in excess of our match requirement.
The South Beach Jazz Festival has grown each year,and with our well managed growth,
we have always maintained a level of excellence that represents the City of Miami
Beach as a world class cultural destination for guests and residents.The festival spreads
our mission by promoting access, opportunity and inclusion for people with disabilities
in the arts through jazz.

Our 6th annual South Beach Jazz Festival held in January of 2022 was a great success,
with 14 performances including a sold out show with multi Grammy artists Aymee
Nuviola and Gonzalo Rubalcaba at Faena Theater, a full house for legends The Blind
Boys of Alabama and jazz master, Donald Harrison at the North Beach Bandshell and 2
full days of free programing showcasing acclaimed local and regional artists and student
musicians at our Lincoln Road stages on Saturday and Sunday with over 4000 Eventbrite
attendees as well as thousands more who found us on Lincoln. We have even more
excellent programming planned for January 2023 and are honored to announce The
Rhythm Foundation is returning as our music production partner.
Our marketing plan and budget increased significantly in 2022, including a match digital
marketing sponsorship from GMCVB and advertising on WDNA, and WLRN, and a Clear
Channel billboard sponsorship. We are thrilled to announce have since doubled our
marketing budget for 20231
We will continue to provide streamed and recorded programming added in 2021 and
will be promoting Miami Beach arts and culture and our message of access, opportunity,
and inclusion in the arts throughout•the festival.

10. Applicants applying through a"fiscal agent"are not eligible.
**A Special Events staff member will be available to assist in determining eligibility and discussing guidelines
with applicants.**

GENERAL CONDITIONS
1. All sponsorship recipients must comply with Sec. 12-5 of Chapter 12(Arts, Culture and Entertainment)
of the City Code,wherein standards and procedures for the issuance of special event permits are set
forth.
2. Sponsorship recipients may only use the sponsorship funds for the purposes that are specifically
described in eligible uses of funding,unless otherwise approved.
3. All sponsored activity(ies) funded must take place within the funding period.
4. The sponsorship recipient shall keep accurate and complete books and records of all receipts and
expenditures of the sponsorship funds, in accordance with reasonable accounting standards,and shall
retain such books and records at the completion of the event.These books and records,as well as all
document pertaining to payments received and made in conjunction with the sponsorship, including, but
not limited to,vouchers,bills, invoices, receipts, and cancelled checks, must be directly related to
sponsored activities.
5. The sponsorship recipient must provide the City with a final report of all sponsorship fund expenditures.
6. The sponsorship will be awarded with the understanding that the event will enhance activate and attract
community engagement to Miami Beach.
7. Approved City/public space may be used for sponsored uses only during the time(s) and location
specified in the sponsorship application.
8. The City may monitor and conduct an evaluation of the event funded by this Sponsorship.

9. The Recipient must be ready,willing and able to enter a contractual agreement for sponsorship with the
City and provide a certificate of liability insurance or proof of self-insurance, if applicable.
10. The Recipient shall indemnify and hold harmless the City and its officers, employees, agents,and
contractors,from and against any and all actions(whether at law or inequity), claims, liabilities, losses,
expenses, or damages, including, but not limited to, attorneys'fees and cost of defense,for personal,
economic,or bodily injury,wrongful death,or loss of or damage to property,which the City or its officers,
employees, agents, and contractors may incur as a result of claims,demands,suits,causes of action or
proceedings of any kind or nature arising out of, relating to, or resulting from the activation by the
Sponsorship Applicant or its officers,employees, agents, servants, partners, principals or contractors.
Sponsorship Applicant shall pay all claims and losses in connection therewith and shall investigate and
defend all claims, suits, or actions of any kind or nature in the name of the City,where applicable
including appellate proceedings,'and shall pay all costs,judgments, and attorneys'fees which may issue
thereon. Sponsorship Applicant expressly understands and agrees that any insurance protection
required by this Agreement, or otherwise provided,shall in no way limit its obligation, as set forth herein,
to indemnify, hold harmless, and defend the City or its officers, employees, agents, and contractors as
herein provided.
11. The Recipient of this Sponsorship funds may not discriminate on the grounds of race, religious creed,
color, national origin,ancestry, age, physical disability, mental disability, medical condition including the
medical condition of Acquired Immune Deficiency Syndrome (AIDS)or any condition related thereto,
marital status, sex, or sexual orientation. Further,the organization must agree to conform to the
requirements of the Americans with Disabilities Act.
12. The Recipient shall not be permitted to assign this Sponsorship to any other party.Any purported
assignment will be void and shall be treated as a default of the Sponsorship Agreement.
13. The Recipient agrees to abide by and be governed by all applicable Federal, State, County,and City
laws.
14. Any uncommitted Sponsorship Funds which remain in the possible or under the control of Recipient
must be returned to the City within thirty(30)days of the submitted Final Report.
15. Sponsorship funds expires and the Sponsorship must be closed out by the end of each funding period.
COMPLIANCE WITH LAWS/GOOD STANDING WITH THE CITY
The Sponsorship agrees to abide by and be governed by all applicable Federal,State, County, and City laws,
including but not limited to Miami-Dade County's Conflict of Interest and Code of Ethics Ordinance, as
amended,which is incorporated herein by reference as if fully set forth herein,and Chapter 2,Article VII of the
Miami Beach City Code, as amended,which is incorporated herein by reference as if fully set forth herein.
Sponsorship Applicant shall maintain its good standing in accordance with the laws of the State of Florida and
the City of Miami Beach Code of Ordinances("City Code"),and shall comply with any City Code requirement
applicable to Sponsorship Applicant or to the Sponsorship Applicant's operation, its business or other activities
in the City of Miami Beach,including,without limitation,obtaining any Certificate of Use or Business Tax

Receipt(s)that may be required for any business activity,timely making payment of all taxes,fees or charges
that may be due to the City of Miami Beach. Sponsorship Applicant shall promptly take corrective action to
correct any City Code violation or notice of violation issued by any governmental agency with jurisdiction over
Sponsorship Applicant. Further, Sponsorship Applicant agrees to comply with the terms and conditions of any
lease,contract, or other sponsorship agreement that Sponsorship Applicant may have separately entered into
with the City of Miami Beach ("Other City Contracts").Any failure by Sponsorship Applicant to comply with any
provision of the City Code applicable to Sponsorship Applicant, or any breach or default by the Sponsorship
Applicant of any covenant or other term or condition contained in any Other City Contracts (after the passage
of any applicable notice and cure provision set forth therein),shall,at the option of the City, be considered a
Default(as such term is defined more fully below in Article II,Section 14 of this Agreement), in which event the
City shall be entitled (but in no event required)to apply all rights and remedies available to the City under the
terms of this Agreement by reason of an Sponsorship Applicant's breach or failure to comply with said
obligations. Recipient shall comply with Florida Public Records law under Chapter 119, Florida Statutes, as
may be amended from time to time.
