Resolution 2022-32269 RESOLUTION NO. 2022-32269 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ESTABLISHING THE "AD HOC IGUANA REMEDIATION ADVISORY COMMITTEE," FOR A PERIOD OF SIX MONTHS (SUBJECT TO EARLIER OR LATER SUNSET BY THE CITY COMMISSION), TO STUDY WHAT ACTIONS OTHER JURISDICTIONS HAVE TAKEN TO ADDRESS IGUANA INVASIONS AND MAKING RECOMMENDATIONS TO THE MAYOR AND CITY COMMISSION REGARDING IGUANA MITIGATION AND REMOVAL OPTIONS; PRESCRIBING THE PURPOSE, COMPOSITION, POWERS AND DUTIES OF THE COMMITTEE; FURTHER, APPROVING RFQ NO. 2022- 251-WG FOR IGUANA REMEDIATION SERVICES; AND FURTHER, DIRECTING THE CITY ADMINISTRATION TO EXPLORE OPTIONS TO COORDINATE WITH OTHER JURISDICTIONS DEALING WITH IGUANA REMEDIATION ISSUES, SUCH AS THE FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION AND MIAMI-DADE ANIMAL CONTROL; AND FURTHER EXPLORE COLLABORATING ON IGUANA REMEDIATION THROUGH A MEMORANDUM OF UNDERSTANDING WITH NEIGHBORING MUNICIPALITIES SUCH AS THE TOWN OF SURFSIDE, NORTH BAY VILLAGE, AND THE CITY OF MIAMI. WHEREAS, black spiny-tailed iguana, the Mexican spiny-tailed iguana, ad, green iguanas are not native to Florida and are considered an invasive species due to their impacts to native wildlife; and WHEREAS, iguanas indiscriminately eat any plant material they can get their claws on, including landscaping, widespread and endangered plants in the state, and tropical fruit and vegetable crops; and WHEREAS, iguanas also cause significant damage to buildings and other man- made and natural structures with their large, elaborate burrows, and disturb various native wildlife populations by hijacking other animals' burrows, such as the native burrowing owl and gopher tortoise; and WHEREAS, like all nonnative reptile species, iguanas are not protected in Florida except by anti-cruelty laws and can be humanely removed as long as it is done under the Florida Fish and Wildlife Conservation Commission's guidelines; and 1 WHEREAS, in 2019, the City launched a successful iguana removal pilot program where over 200 iguanas were removed from facilities such as Brittany Bay Park, Muss Park, Pinetree Park, and Flamingo Park by Redline Iguana Removal; and WHEREAS, after the successful pilot program, the City contracted Redline Iguana Removal for a yearly service to the City, and established an iguana mitigation and removal program, with the strategy to remove large iguanas and control future breeding and nests; and WHEREAS, the City's Property Management staff also negotiated a resident rate for removal of iguanas on private property at a rate of $70.00 per service call (regularly $100.00); and WHEREAS, on November 3, 2021, the City awarded ITQ 2022-062-NA to Iguana Control for iguana remediation, with the service collecting and humanely euthanizing over 1,000 iguanas citywide since January 2022; and However, despite these efforts, the population continues to grow, and additional resources are being further researched and implemented to remove these prolific pests. WHEREAS, however, despite these efforts, the population continues to grow, and additional resources are being further researched and implemented to remove these prolific pests; and WHEREAS, as follows, the Mayor and City Commission desire to establish an Ad Hoc Iguana Remediation Advisory Committee, for a term of six (6) months, to study actions other jurisdictions have taken to address similar iguana invasions, in addition to contracting with an iguana mitigation and removal program; and WHEREAS, the purpose, composition, and powers and duties of the Committee members, and administrative liaison to the Committee are set forth in Exhibit "A" attached to this Resolution; and WHEREAS, in addition, the Mayor and City Commission direct the City Administration to explore options to coordinate with other jurisdictions dealing with iguana remediation issues, such as the Florida Fish and Wildlife Conservation Commission, Miami-Dade Animal Control, and further explore collaborating on iguana remediation through a Memorandum of Understanding with neighboring municipalities such as the Town of Surfside, North Bay Village, and the City of Miami. The purpose of the Ad Hoc Iguana Remediation Advisory Committee (the "Committee") would be to study what actions other jurisdictions have taken to address iguana invasions and make recommendations to the Mayor and City Commission regarding iguana remediation options. 2. The Committee will meet on a monthly basis, or as frequently as the Committee deems necessary to make final recommendations. The Committee will sunset at the end of six (6) months unless determined by the Mayor and City Commission that it should be extended. B. Membership Composition 1. The Committee shall be composed of seven (7) direct appointments made by individual City Commissioners and the Mayor, with the currently vacant Group II appointment to be made after the November 8, 2022 election. 2. Membership criteria for the Committee: individuals must be .residents of the City for a minimum of two (2) years, or demonstrate ownership/interest in, or employment relationship with a business established in the City for a minimum of two (2) years. Exceptions to the foregoing may be approved by a majority vote of the City Commission for individuals with specific knowledge or expertise relative to iguana remediation or other invasive nonnative species remediation. C. Powers and duties The Committee will serve to study actions taken by other jurisdictions to prevent, eradicate, and control the spread of invasive iguanas and advise the City Manager and the City Commission on potential actions available to the City in addition to contracting with an iguana mitigation and removal services, including, without limitation, recommendations regarding the Administration's competitive solicitation for iguana mitigation providers. D. Conflict of interest. In accordance with Florida law, under circumstances presenting a conflict of interest, an advisory board member should abstain from voting with respect to any measure in which the advisory board member has a personal, private, or professional interest and which inures to his special private gain or the special gain of a principal by whom he is retained. The City Attorney's Office liaison shall assist advisory board members in addressing any potential voting conflicts, as necessary. E. Iguanas can cause damage to the residential and commercial landscape and vegetation and threaten our native and endangered species such as Florida Tree Snails, Miami Blue Butterflies,and the Burrowing Owl.They can also transmit the infectious bacterium Salmonella to humans through contact with water or surfaces contaminated by their feces.The City has attempted various methods for controlling iguana population in the past. ANALYSIS Through the RFQ, the City seeks proposals from qualified and experienced iguana remediation contractors. The City intends to negotiate an agreement for services with the contractor(s) deemed most qualified pursuant to this RFQ. All methods used for trapping,euthanasia,and disposal must follow all federal,state,and local laws,ordinances,and guidelines. Guidelines of the Florida Fish and Wildlife Conservation Commission shall be closely followed regarding all population control methods used. The scope of work and requirements of the RFQ are more fully defined in the RFQ attached as Attachment A. Following the receipt of proposals,an Evaluation Committee will review proposals in accordance with the criteria established in the RFQ. They must also provide dedicated resources for the City of Miami Beach operation. In an emergency where services are required immediately outside the City's business hours, the City will contact the Contractor, and the Contractor shall respond to the work site within two (2) hours. The Contractor shall provide a telephone number MIAMI BEACH and email during emergency response.The Contractor will only have access to the locations after regular working hours with prior approval of City staff. 4.5 Contractor shall be responsible for creating a safe environment for their employees,City employees, residents, and visitors while performing services. Proper safety signs or cones shall be used as necessary. The Contractor shall provide for a clean and safe environment during all work. Whenever the Contractor leaves a location, that location shall be clean, safe, and free of any tools and other materials related to the work. At its own cost, the Contractor shall properly dispose of debris and other objectionable material created through the work process. 4.6 Resident Workshops The Contractor may also be required to collaborate with City staff to conduct semi-annual safety workshops for City of Miami Beach residents to help combat any iguana problems they might face on their private property. 4.7 Resident Remediation Program A Miami Beach resident remediation program and discounted rate may be negotiated for its residents, including hotels and condominiums who wish to contract iguana remediation services for their private property privately. 4.8 Reporting Monthly/Quarterly Reports. The City Manager's recommendation need not be consistent with the information provided by the evaluation committee process and takes into consideration Miami Beach City Code Section 2-369, including the following considerations: (1)The ability, capacity and skill of the Proposer to perform the Contract. (2)Whether the Proposer can perform the Contract within the time specified,without delay or interference. (3)The character, integrity, reputation,judgment, experience and efficiency of the Proposer. (4)The quality of performance of previous contracts. (5) The previous and existing compliance by the Proposer with laws and ordinances relating to the Contract. The City Manager may recommend to the City Commission the Proposer(s) s/he deems to be in the best interest of the City or may recommend rejection of all proposals. The City Commission shall consider the City Manager's recommendation and may approve such recommendation. The City Commission may also, at its option, reject the City Manager's recommendation and select another Proposal or Proposals which it deems to be in the best interest of the City, or it may also reject all Proposals. 13.NEGOTIATIONS. Following selection,the City reserves the right to enter into further negotiations with the selected Proposer. Notwithstanding the preceding, the City is in no way obligated to enter into a contract with the selected Proposer in the event the parties are unable to negotiate a contract. It is also understood and acknowledged by Proposers that no property, Contract or legal rights of any kind shall be created at any time until and unless an Agreement has been agreed to; approved by the City; and executed by the parties. 14. E-VERIFY. As a contractor you are obligated to comply with the provisions of Section 448.095, Fla. Stat., "Employment Eligibility." Evaluation Committee.An Evaluation Committee, appointed by the City Manager, may meet to evaluate each Proposal in accordance with the qualitative criteria set forth below. In doing so, the Evaluation Committee may review and score all proposals received, with or without conducting interview sessions. City staff will assign points for the quantitative criteria. It is important to note that the Evaluation Committee is advisory only and does not make an award recommendation to the City Manager or the City Commission.The results of Step 1 &Step 2 Evaluations will be forwarded to the City Manager who will utilize the results to make a recommendation to the City Commission. a. Upon approval of selection by the City Commission, negotiations between the City and the selected Consultant will take place to arrive at a mutually acceptable Agreement, including final scope of services, deliverables and cost of services. 2. Term of Contract. The term of the Agreement resulting from this RFQ shall be for an initial term of three (3)years. 3. Option To Renew. The City, through its City Manager, will have the option to extend for two (2) additional one-year periods at the City's sole discretion. The successful Contractor shall maintain, for the entirety of any renewal period, the same revenue share, terms, and conditions included within the originally awarded Contract. Continuation of the Contract beyond the initial period, and any option subsequently exercised, is a City prerogative, and not a right of the successful Contractor. 4. Additional Services. These reptiles are known to indiscriminately eat local vegetation, including landscaping and endangered plants. Iguanas also cause significant damage to buildings and disturb various native wildlife populations. Like all nonnative reptile species, iguanas are not protected in Florida except by anti-cruelty law and can be humanely removed. Item C2K on tomorrow's agenda: As part of the upcoming fiscal year budget,there is a proposed increase in funding to the City's iguana remediation program. Item C2K on the September 14, 2022, meeting of the Miami Beach City Commission proposes the approval of the issuance of a RFQ for iguana remediation services.The intent is to select a firm(s) for a proactive approach to suppressing iguana populations in which humane and environmentally safe techniques are utilized and implemented. Proposal: Recognizing that much more must be done to address this growing nuisance affecting the quality of life our residential neighborhoods,I intend to pull item C2K from the consent agenda to propose—with the approval of the item — the creation of an Ad Hoc Iguana Remediation Advisory Committee to be composed by affected residents. The purpose of the Committee would be to study what actions other jurisdictions have taken and receive feedback from residents on acceptable solutions for the City to consider. Acknowledgments: I advance this motion having received extensive feedback from community members throughout our City who have requested the creation of this committee. In particular, I want to thank Robin Jacobs who has advocated for the additional action, residents' input, and suggestions through the creation of this Committee.
