Resolution 2022-32284 RESOLUTION NO. 2022-32284 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DELEGATING TO THE CITY MANAGER THE AUTHORITY TO EXECUTE SPONSORSHIP AGREEMENTS IN THE AMOUNT OF $25,000 OR LESS, CASH OR IN KIND, FOR MARKETING OR RELATED ACTIVATIONS AT CITY EVENTS, TO THE EXTENT PERMITTED BY LAW; FURTHER, REQUIRING THAT THE CITY MANAGER RELEASE A MONTHLY REPORT VIA LETTER TO COMMISSION DOCUMENTING THE NAME OF EACH SPONSOR, THE AMOUNT OF THE SPONSORSHIP FEE, THE NATURE OF THE SPONSORSHIP AND THE DURATION THEREOF. WHEREAS, the City of Miami Beach enters into sponsorship agreements with various entities and individuals desiring to promote their products or services at City events; and WHEREAS, such revenue-generating sponsorship agreements help the City defray the costs of producing City events and providing event-related services; and WHEREAS, currently, all sponsorship agreements, regardless of the amount, must be formally approved by the Mayor and City Commission via a Resolution during regularly scheduled City Commission meetings; and WHEREAS,the City Administration recommends delegating to the City Manager authority to execute revenue-generating sponsorship agreements with a contract value of$25,0000 or less, in cash or in kind, to promote efficiency, and to conserve time and effort spent by the City Administration and the City Attorney's Office on drafting and reviewing memoranda and resolutions regarding routine sponsorship agreements of limited value and/or duration. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby delegate to the City Manager the authority to execute sponsorship agreements on behalf of the City in an amount of$25,000 or less, in cash or in kind,for marketing or related activations,at City events, to the extent permitted by law; and further, require that the City Manager release a monthly report via Letter to Commission documenting the name of each sponsor, the amount of the sponsorship fee, the nature of the sponsorship and the duration thereof. RECOMMENDATION The Administration recommends that the City Commission approve this item and grant the City Manager the authority to execute sponsorship agreements in the amount of $25,000 or less in cash or in-kind. BACKGROUND/HISTORY The City of Miami Beach frequently enters into sponsorship and marketing agreements with various entities for a variety of public purposes, including but not limited to sponsorship of events and marketing and advertising campaigns. Currently all sponsorships, regardless of amount, must be formally accepted by the Mayor and Commission via a Resolution during regularly scheduled City Commission meetings. The delegation of this authority to the City Manager would allow the Administration to expedite sponsorship agreements to the contracting stage, and reduce the risk of losing the sponsors interest. Historically, prospective sponsors have been hesitant to go through a lengthy approval period of anywhere between 30-60 days, regardless of sponsorship amount. The existing approval process has caused some sponsors to walk away from City sponsorship opportunities, resulting in loss of revenues to the City. Granting the City Manager the authority to accept sponsorships for$25,000 or less would allow the Administration to continue securing sponsorship revenues, despite tight timelines. The Administration would have more opportunities to engage with a wider breadth of sponsors and for a wider range of opportunities. As the process is currently set up, there would not be adequate administrative time to secure a sponsorship within 30 -45 days of the event date, as Page 424 of 1700 the item could not go through the required committee and commission procedural approvals during that time. The delegation of this authority would remove that procedural limitation for all sponsorships of$25,000 or less of cash or in-kind. SUPPORTING SURVEY DATA N/A FINANCIAL INFORMATION Delegating this authority to the City Manager, allows the Administration to be more agile in prospecting and contracting sponsors within shorter timelines, which will result in an increase in sponsorship revenues to offset the costs of existing budgeted line items for City initiatives.
