Resolution 2022-32268 RESOLUTION NO. 2022-32268 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER, PURSUANT TO REQUEST FOR PROPOSALS (RFP) NO. 2022-334-WG FOR PROFESSIONAL TENNIS MANAGEMENT AND OPERATION OF THE CITY'S MIAMI BEACH TENNIS CENTER; AUTHORIZING THE ADMINISTRATION TO NEGOTIATE WITH VAN DAALEN TENNIS, LLC, THE TOP-RANKED PROPOSER; AND, IF UNSUCCESSFUL, AUTHORIZING THE ADMINISTRATION TO NEGOTIATE WITH THE TENNIS KING, INC., THE SECOND-RANKED PROPOSER; AND, IF UNSUCCESSFUL, AUTHORIZING THE ADMINISTRATION TO NEGOTIATE WITH CASELY TENNIS FOUNDATION, INC., THE THIRD-RANKED PROPOSER; AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE AN AGREEMENT UPON CONCLUSION OF SUCCESSFUL NEGOTIATIONS BY THE ADMINISTRATION; AND FURTHER AUTHORIZING THE MONTH-TO- MONTH EXTENSION OF THE EXISTING AGREEMENT WITH VAN DAALEN TENNIS, LLC, UNTIL A REPLACEMENT AGREEMENT IS EXECUTED. WHEREAS, on May 4, 2022, the Mayor and City Commission approved the issuance of RFP 2022-334-WG for Professional Tennis Management and Operation of the City's Miami Beach Tennis Center; and WHEREAS, on June 15, 2022, the City received proposals from seven (7) firms: Canas Tennis Academy LLC, Casely Tennis Foundation, Inc., FM Tennis LLC, Gorin Tennis Academy, Inc., Neighborhood Tennis LLC, The Tennis King, Inc., and Van Daalen Tennis, LLC; and WHEREAS, on July 28, 2022, the Evaluation Committee appointed by the City Manager comprised of Cindy Casanova, Assistant Director, Parks and Recreation Department; Jose Del Risco, Assistant Director, Parks and Recreation Department; Carolina Jones, resident and member, Parks and Recreational Facilities Advisory Board member; Betsy Perez, resident; and Sean Smith, chair, Parks and Recreational Facilities Advisory Board, convened to consider the proposals received; and WHEREAS, the Committee was provided an overview of the project, information relative to the City's Cone of Silence Ordinance, the Government Sunshine Law, and general information on the scope of services and a copy of each proposal; and WHEREAS, the Committee was instructed to score and rank each proposal pursuant to the evaluation criteria established in the RFP; and WHEREAS, the evaluation process resulted in the proposers being ranked by the Evaluation Committee in the following order: 1st Van Daalen Tennis, LLC 2nd The Tennis King, Inc. 3rd Casely Tennis Foundation, Inc. 4th Canas Tennis Academy LLC 4th FM Tennis LLC 6th Neighborhood Tennis LLC 7th Gorin Tennis Academy, Inc. WHEREAS, after reviewing all of the submissions and the Evaluation Committee process, the City Manager concurs with the Evaluation Committee and finds Van Daalen Tennis, LLC, the top-ranked firm, to•be the best-qualified firm to provide professional tennis management and operation of the City's Miami Beach Tennis Center; and WHEREAS, Van Daalen Tennis, LLC has provided excellent service to the City as the incumbent firm for five years and is proposing to continue delivering quality tennis programming and center operations; and WHEREAS, the second-ranked and third-ranked firms, The Tennis King, Inc. and Casely Tennis Foundation, Inc., respectively, are well-qualified and should be considered, in order of rank, if negotiations with Van Daalen Tennis, LLC are not successful; and NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR. AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the City Manager, pursuant to Request for Proposals (RFP) No. 2022-334-WG for Professional Tennis Management and Operation of the City's Miami Beach Tennis Center; authorize the Administration to negotiate with Van Daalen Tennis, LLC, the top-ranked proposer; and, if unsuccessful, authorize the administration to negotiate with the Tennis King, Inc., the second-ranked proposer; and, if unsuccessful, authorize the Administration to negotiate with Casely Tennis. Foundation, Inc., the third-ranked proposer; further, authorize the City Manager and City Clerk to execute an agreement upon conclusion of successful negotiations by the Administration; and further authorize the month-to- month extension of the existing agreement with Van Daalen Tennis, LLC, until a.replacement agreement is executed. RECOMMENDATION It is recommended that the Mayor and City Commission approve the Resolution authorizing the Administration to negotiate with Van DaalenTennis, LLC, the top-ranked proposer. If the Administration is unsuccessful in negotiating with Van DaalenTennis, LLC, the Resolution authorizes the Administration to negotiate with The Tennis King, Inc., the second-ranked proposer, and Casely Tennis Foundaton, Inc., the third-ranked proposer, in order of rank. The Resolution also authorizes the City Manager and City Clerk to execute an Agreement upon the conclusion of successful negotiations and the month-to-month extension of the existing Agreement with Van Daalen Tennis, LLC until a replacement agreement is executed. This solicitation is currently under the cone of silence. BACKGROUND/HISTORY On August 30, 2017, the City and Van Daalen Tennis, LLC executed the one (1) year pilot agreement to provide Tennis Programming at the City's Miami Beach Tennis Center. On June 6, 2018, the Mayor and City Commission adopted Resolution No. 2018-30330, approving Page 83 of 1700 Amendment No. 1,extending the Agreement. On October 16, 2019, the Mayor and City Commission adopted Resolution No. 2049-31029, accepting the City Manager's recommendation and waived, by 5/7th vote, the competitive bidding requirement extending the expiration date of the Agreement to September 30, 2020, and included two (2)successive one (1)year renewal terms at the City's option. The.Agreement is presently scheduled to expire on September 30, 2022. ANALYSIS O n May 4, 2022, the Mayor and City Commission approved t h e issuance of .RFP 2022-334-WG for Professional Tennis Management and Operation of the City's Miami Beach Tennis Center. On May 4, 2022, the RFP was issued. A voluntary pre-proposal conference to provide information to proposers submitting a response was held on May 18, 2022. One (1) addendum was issued.The Procurement Department issued bid notices to 9291 companies utilizing the City's e-procurement system, with 41 prospective bidders accessing the solicitation. RFP responses were due and received on June 15, 2022. The City received proposals from seven(7)firms: Canas Tennis Academy LLC, Casely Tennis Foundation, Inc., FM Tennis LLC, Gorin Tennis Academy, Inc., Neighborhood Tennis LLC, The Tennis King, Inc., and Van Daalen Tennis, LLC. The evaluation process resulted in the proposers being ranked by the Evaluation Committee as noted in Attachment A,with the three top-ranked proposers as follows: 1st rank-Van Daalen Tennis, LLC 2nd rank-The Tennis King, Inc. 3rd rank-Casely Tennis Foundation, Inc. Following is a summary of the three top-ranked firms. Van Daalen Tennis. LLC Van Daalen Tennis, LLC has managed the programming of the Miami Beach Tennis Center since August 2017 and took over all aspects of operations in January 2020. For the past five years, they have provided the City of Miami Beach with the highest standards of professional tennis services. They pride themselves on giving back to the local community and their sustainability initiatives.And most importantly,customer satisfaction is our top priority. President and CEO Martin van Daalen has coached tennis for over 40 years, including players such as Pete Sampras, Jim Courier, Jennifer Capriati, Mary Pierce, and Jared Palmer. He worked as a national coach for the USIA for over 11 years and worked as Director of Player Development for the Finnish Tennis Federation in 2013 and 2014. Page 84 of 1700 The Tennis King. Inc. The Tennis King incorporated is owned by Mark Johns, with Alex Johns and Russell Johns as principals. With over 40 years in the tennis industry, The Tennis King has been involved in all aspects of running a tennis facility from ownerships, club management, being a vendor, membership growth, 80 years of combined teaching experience, and all areas that preclude operating a tennis facility. Samples of relevant experience providing similar services include Kings Point Indoor Tennis Club, located in Great Neck,.NY,and Roslyn Estates Tennis, in Roslyn Estates, NY. Casely Tennis Foundation. Inc. (CTF) Casely Tennis Foundation, Inc. is a United States Tennis Association member organization founded in 1984. The firm was incorporated in the State of Florida on April 24, 1998, and its president, Carlos Casely, has been an award winning member of the United States Tennis Association and the United States Professional Tennis Association for over.25 years. Carlos Casely has served as tennis director at several local parks and settings in Miami Dade County, such as Ron Ehmann Tennis Center, Tropical Park Tennis Center, Florida International University Tennis Center, and in Broward County at Brian Piccolo Tennis Center, Paul J. Maxwell Park Tennis Center, Vernon E. Hargray Youth Enrichment Center. This experience has provided CTF with extensive experience in tennis facility management, tennis program development and management, customer service, and all facets of pro shop operations, including food, beverage, and merchandise sales. SUPPORTING SURVEY DATA Not Applicable FINANCIAL INFORMATION The annual minimum guarantee paid to the City under the current agreement is $54,000.00. Van Daalen Tennis, LLC has proposed an increased annual minimum guarantee of $78,000.00, a $24,000 increase over the current Agreement. Additionally, the City expects to receive 5% on revenue exceeding $700,000. However,final financial terms are subject to negotiations. CONCLUSION After reviewing all of the submissions and the Evaluation Committee process, I concur with the Evaluation Committee and find Van Daalen Tennis, LLC, the top-ranked firm, to be the. best-qualified firm to provide professional tennis management and operation at the City's Miami Beach Tennis Center.Van Daalen Tennis, LLC has provided excellent service to the City as the incumbent firm for five years and is proposing to continue delivering quality tennis programming and center operations,with an increase in revenue. The second-ranked and third-ranked firms, The Tennis King, Inc., and Casely Tennis Foundation, Inc., respectively, are well-qualified and should be considered, in order of rank, if negotiations with Van Daalen Tennis, LLC are not successful. For the reasons stated herein, I recommend that the Mayor and City Commission approve the Resolution authorizing the Administration to enter into negotiations with Van Daalen Tennis, Page 85 of 1700 LLC, as the top-ranked proposer, and, if unsuccessful, authorizing the Administration to enter into negotiations with The Tennis King, Inc., as the second-ranked proposer, and, if unsuccessful, authorizing the Administration to enter into negotiations with Casely Tennis Foundation, Inc., as the third-ranked proposer.
