99-23216 RESO RESOLUTION NO. 99-23216 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE PROPOSED FINAL PLAT OF "MARK LANDS SUBDIVISION", A REPLAT OF LOTS 28 AND 29 OF "INDIAN RIVER SUBDIVISION", AS RECORDED IN PLAT BOOK 31 PAGE 75, OF THE MIAMI-DADE COUNTY PUBLIC RECORDS. WHEREAS, the City's Board of Adjustment approved a variance in December 5, 1980, allowing a waiver of 15 ft. of the minimum 60 ft. lot width, in the resubdivision of Lots 28 and 29 of "Indian Creek Subdivision", as recorded in Plat Book 31, Page 75 of the Public Records of Miami-Dade County, Florida; and WHEREAS, as required by Chapter 28 of the Miami-Dade County Code, a replat of these two lots was submitted to the City as a Tentative Plat in August 1998, and was reviewed and approved by the City's Planning, Building, and Public Works Departments respectively; and WHEREAS, the Final Plat of "Mark Lands Subdivision", as prepared by Campanile and Associates, Inc. is submitted for approval herein and executed by the Owners and Mortgage Holders as shown on the attached Opinion of Title. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, accepting the proposed final plat of "Mark Lands Subdivision", a Replat of Lots 28 and 29 of "Indian River Subdivision", as recorded in Plat Book 31 Page 75, of the Miami-Dade County Public records. ADMINISTRATION RECOMMENDATION Adopt the Resolution. BACKGROUND On December 5, 1980, the City's Board of Adjustment approved a variance allowing a waiver of 15 feet, of the required minimum 60 feet lot width, in the resubdivision of Lots 28 and 29 of Indian Creek Subdivision, as recorded in Plat Book 31, Page 75 of the Public Records of Miami-Dade County, Florida. At that time, a single family home and swimming pool existed on Lot 29 and on a portion of Lot 28 located at 6620 Allison Road, formerly called Water View Prado. A new lot line was then established which included all of the existing improvements within the subdivided Lot 29 as shown in the attached Exhibit "A". As required under Chapter 28 of the County Code, a request for the replat of these two (2) lots was submitted to the City in August 1998, and approved by the City's Planning, Building and Public Works Departments. The proposed plat was also submitted to the Miami-Dade County Plat Committee and approved. A final plat, which is a replat of Lots 28 and 29 of "Indian River Subdivision" entitled "MARK LANDS SUBDIVISION," has been submitted for the City's approval as shown in the attached Exhibit "B". AGENDA ITEM C1F ~"~3-'l~ 61 DATE ANALYSIS The two new Lots 1 and 2 of the proposed "Mark Lands Subdivision", which are a replat of Lots 28 and 29 of the existing "Indian River Subdivision", are in an RS-2, Single Family Residential zoning district, with a minimum lot size requirement of 18,000 square feet. Lot 2, the smaller of the two lots, is 20,052 square feet and therefore meets the City's minimum lot size requirement. The proposed plat has also been approved by the Miami Dade County Plat Committee, subject to the availability of water, sewage disposal, and the undergrounding of electric and communication lines. The two lots have single family residences connected to the City's sewer system and water main on Allison Road. Recently, as part of the Allison Island Utilities Undergrounding project, all residences, including the above lots, had their electric and communication services undergrounded. The area platted is encumbered by a mortgage and the mortgage holder has executed the plat and joined in its dedications.
