A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE
CITY MANAGER, PURSUANT TO INVITATION TO BID (ITB) NO. 2022-059-
WG, TO ESTABLISH A POOL OF COMMERCIAL REAL ESTATE
BROKERAGE FIRMS TO PROVIDE REAL ESTATE BROKERAGE SERVICES
AND TO APPROVE THE INITIAL RESPONSIVE BROKERAGE FIRM IN THE
POOL: COLLIERS INTERNATIONAL FLORIDA, LLC; FURTHER
• AUTHORIZING THE CITY MANAGER TO KEEP THE ITB OPEN FOR THE
PURPOSE OF PREQUALIFYING ADDITIONAL COMMERCIAL REAL ESTATE
BROKERAGE FIRMS; AND DELEGATING TO THE CITY MANAGER THE
AUTHORITY TO ADD FIRMS TO THE POOL, PROVIDED THAT ANY SUCH
FIRM MEETS THE REQUIREMENTS OF THE ITB, AND TO REMOVE FIRMS
FOR POOR PERFORMANCE; AND FURTHER PROVIDING THAT ANY TASK
ORDER ANTICIPATED TO BE IN EXCESS OF $100,000 SHALL BE SUBJECT
TO THE PRIOR APPROVAL OF THE CITY COMMISSION.
WHEREAS, on August 25, 2022, the Administration issued 'ITB 2022-059-WG
Prequalification Pool for Commercial Real Estate Brokerage Services; and
WHEREAS, on September 25, 2022, the City received proposals from the following
three (3)firms: Colliers International Florida, LLC, Lewis Team Corp., and Silverline, Inc.; and
WHEREAS, the ITB stated that following the review of applications, the responsive and
responsible bidder(s) meeting all terms and conditions of the ITB would be recommended for
the commercial real estate broker and the residential real estate services category; and
WHEREAS, the City required bidders to specify the categories they sought
prequalification for; and
WHEREAS, bidders were not required to participate in all categories to be considered
part of the prequalified pool; and
WHEREAS, a bidder may only participate in the category it has been prequalified; and
WHEREAS, the applications submitted by Lewis Team Corp., and Silverline, Inc., were
deemed non-responsive to the requirements of the solicitation for failure to meet the minimum
requirements and, as a result, could not be considered at this time; and
WHEREAS, the remaining firm, Colliers International Florida, LLC, has been deemed a
responsive, responsible bidder meeting all terms and conditions of the ITB and is
recommended to be added to the pool of prequalified firms in the Commercial Real Estate
Broker category; and
WHEREAS, the City Manager concurs with staff that it is in the best interest of the City
to have a pool of prequalified brokerage firms from which the City may select a firm to assist
with commercial or residential real estate transactions as needed; and
WHEREAS, new applicants that meet the ITB requirements will be added to the pool,
and brokerage firms that do not perform well will be removed from the pool; and
WHEREAS, the remaining firm, Colliers International Florida, LLC, has been deemed a
responsive, responsible bidder meeting all terms and conditions of the ITB and is
recommended to be added to the pool of prequalified firms in the Commercial Real Estate
Broker category; and
WHEREAS, the City Manager concurs with staff that it is in the best interest of the City
to have a pool of prequalified brokerage firms from which the City may select a firm to assist
with commercial or residential real estate transactions as needed; and
WHEREAS, new applicants that meet the ITB requirements will be added to the pool,
and brokerage firms that do not perform well will be removed from the pool; and
WHEREAS, the Administration will not request quotes pursuant to this prequalification
until there are a minimum of two (2) prequalified firms in the pool; and

WHEREAS, any task order anticipated to be in excess of$100,000 shall be subject to
the prior approval of the City Commission; and
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby accept the recommendation of the City Manager, pursuant to Invitation to
Bid (ITB) 2022-059-WG, to establish a pool of commercial real estate brokerage firms, and to
approve Colliers International Florida, LLC to be added to the pool for the Commercial Real
Estate Broker category; further, authorize the City Manager to keep the ITB open for the
purpose of prequalifying additional firms; and delegate to the City Manager the authority to add
firms to the pool, provided that any such firm meets the requirements of the ITB, and to remove
firms for poor performance; and further provide that any task order anticipated to be in excess of
$100,000 shall be subject to the prior approval of the City Commission.

RECOMMENDATION
It is recommended that the Mayor and City Commission approve the Resolution authorizing the
Administration to establish a pool of qualified commercial real estate brokerage firms from
which the City may select to assist with commercial or residential real estate transactions and
approve the initial responsive brokerage firm Colliers International Florida, LLC, the only firm
responding to the ITQ to date.
The Resolution also authorizes the City Manager to keep the ITB open to prequalify additional
firms and delegates authority to the City Manager to add firms to the pool, provided such firms
meet the requirements of the ITB or remove firms.Any task order anticipated to be in excess of
$100,000 shall be subject to the prior approval of the City Commission.
This solicitation is currently under the cone of silence.
BACKGROUND/HISTORY
The City of Miami Beach has contracted with qualified commercial real estate brokers to provide
customary real estate services to the City for City-owned facilities. These services are

predominantly for the Leasing of City-owned properties (i.e., Tenancy at Anchor Shops and
Garage, etc.) and the search to Lease properties from an independent developer (i.e.,
warehouse space, office space, etc.). The current contract for these services was awarded to
CBRE on October 24, 2017,and is set to expire on October 23, 2022. The brokerage services
also include the ability for such firms to purchase or sell real property. However, the process for
any purchase or sale of real property would require a more thorough process for review and
approval by the City Commission, including but not limited to a 6/7th Vote, Planning Analysis,
two (2) Public Hearings, etc. To seek replacement contracts, the Administration issued an
Invitation to Bid (ITB).
Through the ITB, the City of Miami Beach requested applications from licensed commercial
real estate brokers who wish to be included in a pool of prequalified firms from which the City
may select a firm to assist with commercial or residential real estate transactions as may be
needed in the future. Interested firms may submit an application indicating their intent to become
prequalified in accordance with Appendix A. The City intends to prequalify firms in the
categories below.
1. Commercial Real Estate Broker.A commercial real estate broker representing the City will
act as a middleman between sellers and buyers of commercial real estate, assisting with selling,
leasing, or purchasing real estate. The Broker shall be able to list real estate on Co-Star or
LoopNet.
2. Residential Real Estate Services. A commercial real estate agent is qualified to deal with
residential and commercial properties. Accordingly, the City may, from time to time, require
assistance with the sale, lease, or purchase of the residential real estate. Commercial Real
Estate Brokers wishing to participate in this category must be able to list real estate on the
Multiple Listing Service (MLS).
ANALYSIS
On August 25, 2022, the Administration issued ITB 2022-059-WG Prequalification Pool for
Commercial Real Estate Brokerage Services. Responses were due and received on
September 25, 2022. Bidders wishing to be prequalified as part of the Application Process
were required to specify which categories they requested to be prequalified for. Bidders were
not required to participate in all categories to be considered part of the prequalified pool.
However, a bidder may only participate in the category for which it has been prequalified. The
categories were as follows:
Commercial Real Estate Broken
Commercial Real Estate Broker. A commercial real estate broker representing the City will act

of the residential real estate. Commercial Real Estate Brokers wishing to participate in this

The City received applications from three (3) firms: Colliers International Florida, LLC, Lewis
Team Corp., and Silverline, Inc.
However, the applications submitted by Lewis Team Corp., and Silverline, Inc., were deemed
non-responsive to the requirements of the solicitation for failure to meet the minimum
requirements and, as a result, could not be considered at this time. The remaining firm
submitting an application, Colliers International Florida, LLC, has been deemed a responsive,
responsible bidder meeting all terms and conditions of the ITB by the Procurement and
Facilities and Fleet Management Departments and, therefore, is recommended to be added to
the pool of prequalified firms.
As there is only one eligible responsive bidder at this time, the Administration will not request
quotes pursuant to this pre-qualification until there are a minimum of two (2)pre-qualified firms in
the pool.

Not applicable.
FINANCIAL INFORMATION
There is no fiscal impact at this time. Funding for brokerage fees generally are included as part
of a sale and/or purchase price within the real estate transaction. Leasing brokerage fees are
budgeted for or identified as a fiscal impact at the time of a Lease transaction per project and
approved through the City's budgeting process. The pool of prequalified Commercial Real
Estate Brokers will ensure that projects are awarded in a competitive manner while opening up
options for brokerage firms that are the best fit for each particular transaction. The Asset
Management Division will solicit quotes from the prequalified brokers when multiple bids are
required.

CONCLUSION
I concur with staff that it is in the best interest of the City to have a pool of prequalified
commercial real estate brokerage firms who wish to participate in subsequent spot market
purchases as required by the City to provide real estate brokerage services on an as-needed
basis. New applicants that meet the ITB requirements will be added to the pool. Brokerage
firms that do not perform well will be removed from the pool.
Therefore, I recommend that the Mayor and City Commission of the City of Miami Beach,
Florida, approve the Resolution, accepting the recommendation of the City Manager, pursuant
to Invitation to Bid (ITB) No. 2022-059-WG, to establish a pool of qualified commercial real
estate brokerage firms from which the City may select to assist with commercial or residential
real estate transactions as may be needed, and approving the initial brokerage firm in the pool:
Colliers International Florida, LLC, by category established in the solicitation (e.g., Commercial
Real Estate Broker or Residential Real Estate Services).
The Resolution also authorizes the Administration to keep the ITB open to prequalify additional
