A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE AMENDMENT NO. 12 TO THE
PROFESSIONAL ARCHITECTURAL AND ENGINEERING (A/E) SERVICES
AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND
WOLFBERG/ALVAREZ AND PARTNERS, INC., FOR ADDITIONAL
ARCHITECTURAL AND ENGINEERING PROFESSIONAL SERVICES
INCLUDING (1) THE DESIGN OF AN ALTERNATIVE RESILIENT STORM
WATER RETENTION SYSTEM TO ASSIST WITH THE FUTURE FLAMINGO
PARK NEIGHBORHOOD DRAINAGE IMPROVEMENT PROJECT, (2)
REVISIONS TO THE DRAINAGE PLANS FOR THE BASEBALL AND
SOFTBALL FIELDS, (3) CORRECTION OF EXISTING UNFORESEEN
CONDITIONS IN THE BASEBALL STADIUM, AND (4) AN ALLOWANCE FOR
UNFORESEEN ADDITIONAL DESIGN SERVICES FOR THE FLAMINGO PARK
MASTER PLAN GOB PROJECT, IN THE NOT-TO-EXCEED AMOUNT OF
$194,361, WITH PREVIOUSLY APPROPRIATED FUNDING.
WHEREAS, on September 5, 2007, pursuant to Request for Qualifications (RFQ) No. 15-
06/07, the Mayor and City Commission adopted Resolution No. 2007-26609 approving and
authorizing the Mayor and City Clerk to execute an NE Agreement with Wolfberg/Alvarez and
Partners, Inc. (Wolfberg/Alvarez), for the Flamingo Park Project, in the amount of$443,000; and
WHEREAS, the scope included architectural, engineering, master planning, landscape
architecture and surveying services,for the development of the Master Plan, as well as the design,
bidding, award services, and construction administration of the Tennis Center; and
WHEREAS, on September 9, 2009, the City Commission approved option "L" of the
Flamingo Park Master Plan through the adoption of Resolution No. 2009-27190; and ,
WHEREAS, the Basis of Design Report (BODR) was subsequently issued based upon
this approval and on November 9, 2010, the Flamingo Park Master Plan was approved by the
Historic Preservation Board (HPB); and
WHEREAS, on July 14, 2010, the Commission adopted Resolution No. 2010-27427
approving and authorizing the Mayor and City Clerk to execute Amendment No. 1 for a total
amount of$77,720, for additional architectural and engineering services associated with revisions
to the Master Plan and Tennis Center; and
WHEREAS, Amendments Nos 2-4 were administratively approved by the City Manager,
for a total amount of$6,446, for additional architectural and engineering services associated with
changes to the scope and the design of the Tennis Center; and
WHEREAS, on January 15, 2014, the City Commission adopted Resolution No. 2014-
28449, approving and authorizing the Mayor and City Clerk to execute Amendment No. 5 for a
total amount of$403,261; and
WHEREAS, this Amendment provided for the planning, design, bidding, and construction
phase services of the following park improvements, which consist of a community garden,
baseball field renovation, historic lodge renovation, new park entrance, enhanced pedestrian/bike
paths, new interactive water feature, teenage activity, lighting enhancement, signage, drainage,
landscaping and irrigation; and
WHEREAS, on April 23, 2015, Amendment No. 6 was approved administratively by the
City Manager for a total amount of$14,732 and this amendment provided for scope modifications
to the Master Plan concept that included an outdoor fitness cluster, the replacement of the
community garden with a butterfly garden,the relocation of the new restroom facility and upgrades
to the baseball, softball and soccer fields, inclusive of sod, drainage and irrigation;.and
WHEREAS, on July 14, 2015, Amendment No. 7 was approved by the City Manager for
a total amount of $15,090 for additional design services associated with the renovation of the
existing soccer field, including replacing existing sod with synthetic turf and site drainage in and
around the field; and
WHEREAS, on December 14, 2016, the City Commission adopted Resolution No. 2016-
29672, approving Amendment No. 8 in the amount of $231,269, for the provision of additional
architectural and engineering services that include updated phases for construction completion,
revised construction cost estimates; the design, bidding and construction administration of the
renovation of the Robert C. Hass and Joe Rubin Handball Court Buildings, the eight(8) existing
outdoor courts and additional scope identified for the softball field with new lighting, new benches,
dug out, and a synthetic turf playing field with associated site drainage; and
WHEREAS, on September 12, 2018, the City Commission adopted Resolution No. 2018-
30478, approving Amendment No. 9 in the amount of $71,200, for the provision of additional
architectural and engineering services that included revisions necessary for the relocation of the
existing IT Room (currently located inside the historic lodge), plan revisions to park-wide
landscaping and concrete pathways(due to Hurricane Irma tree damages), relocation of baseball
field guy wires (due to the unforeseen conflict with the renovation of ADA ramps), preparation of
construction documents for the softball field as a "stand-alone" project and preparation of a new
specific purpose and topographic survey for Flamingo Park; and
WHEREAS, on November 6, 2018, the electorate of the City of Miami Beach approved
the issuance of a $439,000,000 General Obligation Bond (GOB), including $169,000,000 for
parks, recreational facilities, and cultural facilities and funding for the Flamingo Park Master Plan
was included; and
WHEREAS, on March 13, 2019, the City Commission adopted Resolution No. 2019-
30754, approving the GOB implementation plan, which included the necessary funding to
complete the improvements of the Flamingo Park Master Plan in the third tranche bond issuance;
and
WHEREAS, on July 17, 2019, the City Commission adopted Resolution No. 2019-30874
approving Amendment No. 10 in the amount of $35,216, for the provision of additional
architectural and engineering services as a result of a community request and direction from the
City Commission to revisit the Flamingo Park Master Plan regarding tree retention and mitigation,
and for the extension of construction administration services for the renovation of the Joe Rubin
and Robert Haas handball courts for added scope of work associated to the restoration of stucco
and project phasing; and
WHEREAS, on April 21, 2021 Commission adopted Resolution No. 2021-31693
advancing the GOB funding for the Flamingo Park Master Plan from tranche 3 to the current
tranche 1; and
WHEREAS, on September 17, 2021, the City Commission adopted Resolution No. 2021-
31837, approving Amendment No. 11, in the amount of$365,800, for the provision of additional
architectural and engineering professional services for the Flamingo Park Master Plan that
included the implementation of resiliency strategies within the baseball field and softball field
renovation projects, including an underground storm water retention system to assist in the
collection, treatment, and disposal of storm water run-off from the Flamingo Park Neighborhood,
and solar panels for the pedestrian lighting within the park; and
WHEREAS, Wolfberg/Alvarez commenced the design of the resilient elements including
the storm water retention system and as part of the design development process, the design team
met with the Parks and Recreation and Public Works Departments to review the plans and
coordinate the future use of the system by the Flamingo Park Neighborhood Improvement Project;
and
WHEREAS, early on, it was noted that the selected storm water retention system did not
provide the anticipated capacities or benefits to the neighborhood project, and further still, posed
significant maintenance challenges for the City; and
WHEREAS, the design consultants and City staff determined that the City and the
Flamingo Park Neighborhood would be better served by exploring and investigating alternative
resiliency strategies, which would better accomplish the intended goals and as a result, the team
abandoned the design of the storm water retention system in favor of an approach based on the
installation of stormwater injection wells; and
WHEREAS, this approach will better assist the future Flamingo Park Neighborhood
drainage improvement project, allowing for expandability, and would help address water quality
concerns related to the overall collection and drainage system; and
WHEREAS, the underground retention system is being replaced to incorporate a modular
approach based on injection wells and the design consultants will have to redesign the baseball
and softball field collection and drainage systems; and
WHEREAS, in the years since Amendment No. 5 was executed in 2014, the baseball field
facility has continued to experience wear and tear; and
WHEREAS, as part of the due diligence for the development of the construction
documents, Wolfberg/Alvarez conducted additional site visits to the baseball stadium which have
resulted in recommendations for the repair of newly identified unforeseen conditions, related to
the extended wear and tear, that include: (1) re-roof ticket booth; (2) renovation of ticket booth
interior and exterior finishes and air conditioning; (3) re-roof restroom building; (4) repair/remodel
existing metal stairs to press box and walkway from stair to press box entrance; (5) repair existing
metal roof and wall panels of the press box; and (6) repair and/or replace, as needed, structural
metal deck under press box; and
WHEREAS, the City requested a proposal from Wolfberg/Alvarez for the provision of
additional professional services associated with the design of an alternative storm water retention
system, the redesign of the drainage systems for the baseball and softball fields, and for the
design of corrective scope of work for unforeseen conditions at the baseball stadium; and
WHEREAS, the City also requested that Wolfberg/Alvarez include an allowance for
potential future unforeseen design requirements; and
WHEREAS, Wolfberg/Alvarez presented the City with a fee proposal for additional
professional services, which has been reviewed and negotiated by staff in the not-to-exceed
amount of$194,361; and
WHEREAS, the negotiated fee is commensurate with the level of work contemplated for
the additional scope of work required for this project; and
WHEREAS, this Amendment No. 12 (Exhibit A) will revise the total contract amount to
$1,858,095. Exhibit A includes the Wolfberg/Alvarez fee proposal; and
WHEREAS, The Administration recommends that the Mayor and City Commission
approve Amendment No. 12.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission
hereby Approving and Authorizing the Mayor and City Clerk to execute Amendment No. 12 to the
Professional Architectural and Engineering (NE)services agreement between the City of Miami
Beach, Florida and Wolfberg/Alvarez and Partners, Inc., for additional Architectural and
Engineering Professional Services including (1)the design of an alternative resilient storm water
retention system to assist with the future Flamingo Park Neighborhood Drainage Improvement
Project, (2) revisions to the drainage plans for the baseball and softball fields, (3) correction of
existing unforeseen conditions in the baseball stadium, and (4) an allowance for unforeseen
additional design services for the Flamingo Park Master Plan GOB Project, in the not-to-exceed
amount of$194,361, with previously appropriated funding.

As a result of the change in direction related to the storm water retention system, the design
consultants will redesign the baseball and softball field drainage system. The baseball and
softball fields were originally designed to take advantage of the intended underground retention
system as part of their drainage system. Since the underground retention system is being
replaced to incorporate a modular approach based on injection wells, this change must also be
incorporated into the baseball and softball field drainage design.
In the years since Amendment No. 5, 2014, the baseball field facility has continued to

softball field with new lighting, new benches, dug out, and a synthetic turf playing field with
associated site drainage; and
WHEREAS, on September 12, 2018, the City Commission adopted Resolution No.
2018-30478, approving Amendment No. 9, in the amount of $71,200, for the provision of
additional architectural and engineering services that included: 1) revisions associated with
the relocation of the existing IT Room (currently located inside the historic lodge); 2) plan
revisions to park-wide landscaping and concrete pathways (due to Hurricane Irma tree
damages); 3) relocation of baseball field guy wires (due to the unforeseen conflict with the
renovation of ADA ramps); 4) preparation of construction documents for the softball field as a
"stand-alone" project and 5) preparation of a new specific purpose and topographic survey for
Flamingo Park; and
•
WHEREAS, on July 17, 2019, the City Commission adopted Resolution No. 2019-
30874 approving Amendment No. 10 in the amount of$35,216, for the provision of additional
architectural and engineering services as a result of a community request and direction from
the City Commission to revisit the Flamingo Park Master Plan regarding tree retention and
mitigation, and for the extension of construction administration services for the renovation of
the Joe Rubin and Robert Haas handball courts for added scope of work associated to the
restoration of stucco and project phasing; and
WHEREAS, On September 17, 2021, the City Commission adopted Resolution No.
2021-31837, approving Amendment No. 11 in the amount of $365,800, for the provision of
additional architectural and engineering professional services for the Flamingo Park Master
Plan that include the implementation of resiliency strategies within the baseball field and
softball field renovation projects, including an underground storm water retention system to
assist in the collection, treatment, and disposal of storm water run-off from the Flamingo Park
Neighborhood, and solar panels for the pedestrian lighting within the park; and
WHEREAS, the Consultant commenced the design of the resilient elements including
the storm water retention system and as part of the design development process, the design

team met with the Parks and Recreation and Public Works Departments to review the plans
and coordinate the future use of the system in the Flamingo Park Neighborhood
Improvement Project; and
WHEREAS, it was noted that the selected storm water retention system did not
provide the anticipated capacities or benefits to the neighborhood project, and further still,
posed significant maintenance challenges for the City; and
WHEREAS, at the recommendation of the design consultants and City staff, the team
determined that the City and the Flamingo Park Neighborhood would be better served by
exploring and investigating alternative resiliency strategies, which would better accomplish
the intended goals and as a result, the team abandoned the design of the storm water
retention system in favor of a different approach that would allow for expandability and would
help address water quality concerns related to the overall collection and drainage system;
and
WHEREAS, as a result of the change in direction related to the storm water retention
system, since the baseball and softball fields were originally designed to take advantage of
the intended underground retention system as part of their drainage system, the design
consultants will have to redesign the baseball and softball field collection and drainage; and
WHEREAS, the original scope of work for the baseball stadium was limited to the
renovation of restrooms, the replacement of windows and flooring in the press box, and the
addition of new ADA seating areas and ramps in the grandstand; and
WHEREAS, as part of their due diligence, the Consultant has conducted site visits to
the baseball stadium this year which resulted in additional recommendations for the repair of
newly identified unforeseen conditions that include:
(1) re-roof ticket booth
(2) renovation of ticket booth interior and exterior finishes and air conditioning
(3) re-roof restroom building
(4) repair/remodel existing metal stairs to press box and walkway from stair to press
box entrance
(5) repair existing metal roof and wall panels of the press box
(6) repair and/or replace, as needed, structural metal deck under press box
WHEREAS, the City requested a proposal from Wolfberg/Alvarez for the provision of
additional professional services associated with the design of an alternative storm water
retention system, the redesign of the drainage systems for the baseball and softball fields, the
design of corrective scope of work for newly identified unforeseen conditions at the baseball
stadium, and to include an allowance for future unforeseen design requirements; and
WHEREAS, the Consultant presented the City a fee proposal for additional
professional services and staff negotiated and reached an agreement for the additional
professional services in the not-to-exceed amount of$194,361; and
WHEREAS, the negotiated fee is commensurate with the level of work
contemplated in the scope of services for this project and the total revised contract amount
is$1,858,095; and

NOW, THEREFORE, the parties hereto, and in consideration of the mutual
promises, covenants, agreements,terms, and conditions herein contained, and other good

The above recitals are true and correct and are incorporated as a part of this
Amendment No. 12.
2. MODIFICATIONS
The Agreement is amended as defined in Schedule "A-12", attached herein.
3. OTHER PROVISIONS,
All other provisions of the Agreement, as amended, are unchanged.
4. RATIFICATION,
The City and Consultant ratify the terms of the Agreement, as amended by

AMENDMENT NUMBER 01 TO THE AGREEMENT BETWEEN CLIENT AND KIMLEY-HORN
AND ASSOCIATES, INC.
This is Amendment number 01 dated October 11th, 2022 to the agreement between
Wolfberg Alvarez& Partners("Client")and Kimley-Horn and Associates, Inc. ("Consultant")dated
July 16th, 2021 ("the Agreement")concerning Flamingo Park Improvements(the"Project").
The Consultant has entered into the Agreement with Client for the furnishing of professional
services,and the parties now desire to amend the Agreement.
The Agreement is amended to include services to be performed by Consultant for
compensation as set forth below in accordance with the terms of the Agreement, which are
incorporated by reference.
Project Understanding
The City of Miami Beach requires the installment of deep injection wells within Flamingo Park to be
connected to the potential Flamingo Park neighborhood drainage improvements. The purpose of
the wells will be to provide additional drainage capabilities to Flamingo Park and the Flamingo Park
Neighborhood.
Consultant will perform the following services:
Task 1 —Flamingo Park Drainage Well Plans and Permitting Assistance
Kimley-Horn will submit a conceptual layout plan and coordinate with the City or the City's
consultant to verify that the proposed well placement works for the City's maintenance and future
connections.Kimley Horn will place the wells based on proximity requirements,existing utilities and
park infrastructure conflicts thus maximizing the number of wells in compliance with these
requirements. Upon the City's approval of the well location, Kimley-Horn will provide engineering
plans, details and calculations for the proposed wells within the limits of the park. The proposed
well design will include flood routing, pipe materials and sizing, grate and invert elevations, and
construction details. The proposed system will be designed to stormwater improvements of
Flamingo Park for a 10 year 24 hour storm with a higher factor of safety to assist the future drainage
improvements previously mentioned and to be completed by others. Kimley-Horn will also process
the proposed drainage wells with the Department of Environmental Resources Management Water
Control Section with a Class V drainage well permit application.The local drainage well contractor
will be responsible for leading the drainage well permitting process through Florida Department of
Environmental Protection Agency (FDEP). Kimley-Horn will address up to four (4) rounds of
comments.
Task 2 -Baseball Field Drainage Plans and Permitting Assistance

conference calls with the project team,City of Miami Beach staff,and/or other regulatory agencies.
Kimley-Horn will provide these services at the level requested by the Client's or Client's Design
Team Representatives.

Project Assumptions
• Retaining walls are not required. If so, retaining walls will be designed by the structural
engineer.
• The Client will'provide a current boundary, topographic and detailed tree survey in State
Plane coordinates to an appropriate vertical datum, including all abutting right of ways,
easements, existing utilities such as, but not limited to, dry utilities, sanitary sewer and
drainage rims, inverts, and pipe sizes and materials. The survey will be provided in
AutoCAD (dwg) electronic file format, and in hardcopy form, signed & sealed by a
professional land surveyor registered in the State of Florida.
• Client will hire a local well driller to obtain site specific well capacity rates.
• Client will hire a geotechnical engineer to obtain site specific percolation rates.
• Client will hire a subsurface utility company to provide information on existing utilities within
the project area.
• Drainage analysis or plans in the public right of.way is not included in this scope.
• Drainage lift station design, updates nor analysis is not included in this scope.
• Environmental assessments or coordination with the Pollution Remediation Section is to
be done by others.
• Pavement section recommendations are not a part of this scope.
• Any previous open permits are to be handled by the City of Miami Beach.
• If the design includes discharge to a public system,then a Class II Permit will be required.
• Drainage wells are to be permitted through a Class V Drainage Well Permit. (The local
drainage well contractor will be responsible for leading the drainage well permitting process
through Florida Department of Environmental Protection Agency(FDEP).
For the services set forth above, Client shall pay Consultant the following compensation:
