A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, REJECTING ALL BIDS RELATING TO REQUEST
FOR PROPOSALS NO. 2020-180-ND, FOR DESIGN/BUILD SERVICES FOR
72ND STREET COMMUNITY COMPLEX.
WHEREAS, on June 24, 2020, the Mayor and City Commission authorized the issuance
of RFP 2020-180-ND for design/build services for the 72nd Street Community Complex(the RFP);
the RFP was issued on June 26, 200, with an opening date of August 10, 2020; and
WHEREAS, on September 16, 2020, City Commission adopted Resolution No. 2020-
31387, accepting the recommendation of the City Manager pertaining to the ranking of the
proposals with respect to Phase I of the RFP selection process and authorized for (1) Kaufman
Lynn Construction, Inc., (2) PCL Construction Services, Inc., (2) The Haskell Company, to be
further considered in Phase II of the RFP evaluation process; and
WHEREAS, on September 17, 2020, the Procurement Department issued Phase II of the
RFP to the short-listed proposers; and
WHEREAS, on December 14, 2020, the City received the technical and price proposals
in response to Phase II of the RFP; and
WHEREAS, after reviewing all of the submissions and the Evaluation Committee's
rankings and commentary, the City Manager, recommended that the Mayor and City Commission
authorize the Administration to enter into negotiations with The Haskell Company ("Haskell"), as
the top ranked proposer; PCL Construction Services, Inc. ("PCL"), as the second ranked
proposer; and Kaufman Lynn Construction, Inc. ("Kaufman"), as the third ranked proposer;. and
further authorized the Mayor and City Clerk to execute a design build agreement upon conclusion
of successful.,negotiations by the Administration; and
WHEREAS, on March 17, 2021, the City Commission approved the City
Manager's recommendation and authorized the City to negotiate with Haskell, PCL, and
Kaufman in order of ranking and further authorized the Mayor and City Clerk to execute
a design build agreement upon conclusion of successful negotiations by the
Administration; and
WHEREAS, after sixteen months of unsuccessful negotiations, the Administration
declared an impasse in the City's negotiations with Haskell on October 14, 2022; and
WHEREAS, after declaring an impasse with Haskell, the Administration met with
PCL and found that PCL's proposal exceeded the City's estimates and capabilities; and
WHEREAS, during the October 26, 2022 City Commission meeting, the City
Commission voted to accept the,Administration's recommendation to reject all bids under
(RFP) NO. 2020-180-ND and prepare a new procurement process to be presented at the
December 14, 2022 City Commission meeting.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE-MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby reject all bids for Request for Proposals No. 2020-180-nd, -for
design/build services for 72nd street community complex.
