Resolution 2022-32413 RESOLUTION NO. 2022-32413 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, AMENDING RESOLUTION NO. 2022-32385, WHICH APPROVED THE GRANT AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND THE PARENT-TEACHER ASSOCIATION (THE "PTA") FOR NORTH BEACH ELEMENTARY SCHOOL (THE "SCHOOL"), FOR THE SOLE PURPOSE OF REDUCING THE ORIGINAL GRANT AMOUNT AWARDED FROM $100,000 TO $75,000, IN ORDER TO REIMBURSE THE PTA FOR ENGAGING AN INDEPENDENT STRUCTURAL ENGINEERING AND ENVIRONMENTAL CONSULTANT TO ASSIST IN RESOLUTION OF ON- GOING BUILDING CONDITIONS IN NORTH BEACH ELEMENTARY, IN FURTHERANCE OF THE SHARED GOAL OF PROTECTING THE STUDENTS OF THE SCHOOL; AND FURTHER, PROVIDING FOR THE GRANT MONIES TO BE REIMBURSED TO THE PTA WITHIN THIRTY (30) DAYS OF THE RECEIPT OF SUPPORTING DOCUMENTATION. WHEREAS, North Beach Elementary School (the "School") is currently in a state of disrepair, with various building issues including cracking in the walls throughout the building, peeling paint, damaged floors representing tripping hazards, roofing issues, and potential mold issues; and WHEREAS, there has been an alleged water intrusion into the School since 2017, causing concern about the presence of mold; and WHEREAS, mold presents a significant health and environmental hazard and necessitates a complete environmental assessment, particularly if mold circulates through ventilation systems; and ' WHEREAS, the areas at the School that are deemed structurally unsound or unsafe are currently closed off to students; and WHEREAS, the School and the Parent-Teacher Association have been meeting with the Miami-Dade County Public Schools (the "District") to address and remedy the on-going issues; and WHEREAS, on September 21, 2022, the condition of North Beach Elementary was discussed at the Public Safety and Neighborhood Quality of Life Committee (the "Committee"), and as the result of the Committee's participation, and urging the District to take action to address structural and environmental concerns, the District is currently working on conducting various ongoing inspections and remediation work; and WHEREAS, at the Committee meeting, Vice-Mayor Fernandez expressed concern that parents of the North Beach Elementary students should not be responsible for incurring fees for requesting additional inspections and environmental studies; and WHEREAS, notwithstanding the District's efforts; parents at the School, many of whom are Miami Beach residents, remain concerned about the condition of the leaking roof and the potential presence of mold; and WHEREAS, prior to starting on the repairs to the School, parents have reasonably requested that a full assessment of the structural soundness of the School buildings be conducted, as well as an environmental study with full mold assessment, identification, and remediation; and WHEREAS, on October 26, 2022, Commissioner David Richardson sponsored, and the Mayor and City Commission adopted, Resolution No. 2022-32385 to award a grant in the not-to- exceed amount of $100,000, to reimburse the PTA for engaging an independent structural engineer and environmental consultant, to assist in resolution of on-going building conditions in North Beach Elementary, finding that a public purpose would be served thereby in furtherance of our shared mission with the District to provide for the health, safety, and welfare of children attending a school in Miami Beach; and WHEREAS, on Friday, October 28, 2022 the voting members of the PTA met and agreed to hire Thorton Tomasetti to conduct an, independent inspection of North Beach Elementary, including destructive testing, as well as a comprehensive environmental study/inspection, subject to approval by the District of the scope of the inspection; and WHEREAS, the cost of the independent destructive testing and inspection is estimated to be no more than $40,000; and WHEREAS, the Mayor and City Commission wish to amendment the grant amount from $100,000 to $75,000, which will not require prior review by the City's Finance and Economic Resiliency Committee before being awarded to the PTA; and WHEREAS, an amendment to Resolution No. 2022-32385 is necessary to reflect the new grant amount. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby amend Resolution No. 2022-32385, which approved the grant agreement between the City of Miami Beach and the Parent-Teacher Association(the"PTA")for North Beach Elementary School (the "School"), for the sole purpose of reducing the original grant amount awarded from $100,000 to $75,000, in order to reimburse the PTA for engaging an independent structural engineering and environmental consultant to assist in resolution of on-going building conditions in North Beach Elementary, in furtherance of the shared goal of protecting the students of the School; and further, providing for the grant monies to be reimbursed to the PTA within thirty (30) days of the receipt of supporting documentation.
