RESOLUTION NO. 73-14111
WHEREAS, City Council of the City of Miami Beach,
Florida, heretofore authorized institution of condemnation
proceedings for the acquisition of the fee simple title to
the following parcels of land, to wit:
PARCELS NO. 3, 4, and 5 of proceedinqs entitled
City of Miami Beach v. Joe Kasdin, et ale
Lots 1, 2, and 3, Block 12, ALTOS DEL MAR
SUB NO. 2, according to the Plat thereof
recorded in Plat Book 4 at page 162 of the
Public Records of Dade County, Florida~
PARCELS NO. 34 and 35 of proceedings entitled
City of Miami Beach v. Joe Kasdin, et al.
Lots 3 and 4, Block 18, ALTOS DEL MAR
NO. 1, according to the Corrected Plat
thereof recorded in Plat Book 31 at
page 40 of the Public Records of Dade
County, Florida~
PARCEL NO. 44 of proceedings entitled
City of Miami Beach v. Filosof-lnvestment
Properties , Inc. , et al.
Block 20, ALTOS DEL MAR NO. 1, according
to the Plat thereof recorded in Plat
Book 31 at page 40 of the Public Records
of Dade County, Florida
for use for public park and recreational purposes, and
WHEREAS, pursuant to said resolution, appropriate
condemnation proceedings were instituted in the Dade County
Circuit Court for said purpose, and
WHEREAS, prior to impanelling of a jury, the proposed
offers of settlement were made by the owners of said parcels,
by and through their attorneys, as follows:
1. For Parcels No. 3, 4, and 5, owned by Kenneth
Oka and Gertrude Oka, as tenants in common, the sum of
Two Hundred and Five Thousand Dollars ($205,000.), plus
the sum of Five Thousand Dollars ($5,000. ) for attorneys
fees, total sum being Two Hundred and Ten Thousand Dollars
($210,000.) ;
~. For Parcels No. 34 and 35, owned by Rae M. Watson,
the sum of One Hundred and Thirty-Three Thousand, One Hundred
and Seventy-Five Dollars ($133,175.) , plus Thirteen Thousand
Three Hundred and Seventeen Dollars and Fifty Cents ($13,317.50)
for attorneys fees, total sum being One Hundred and Forty-Six
Thousand, Four Hundred Ninety-Two Dollars and Fifty Cents

3. For Parcel No. 44, owned by Filosof Investment
Properties, Inc. , a dissolved Florida corporation, the sum
of Two Hundred and Seven Thousand, Five Hundred Dollars
($207,500.) , plus Two Thousand Five Hundred Dollars ($ 2,500. )
for attorneys fees, total sum being Two Hundred and Ten
Thousand Dollars ($2l0,OOO.)~
and
WHEREAS, the City Attorney, City Manager and Mr. S. Z.
Bennett, the City's Real Estate Consultant, have each recommended

to the City Council that the acceptance of said offemof
settlement are financially advantageous to the City and in
its best interests, and
WHEREAS, the City Council of the City of Miami
Beach, Florida, had duly considered said offers of settlement
and said recommendations, and now being fully advised in the
premises, it is, therefore,
RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI
BEACH, FLORIDA, that the said offers of settlement, as herein-
above recommended, be and the same are hereby accepted and
the City Attorney be and he is hereby authorized and directed
to take all legal steps necessary to effectuate and execute
said offers of settlement and the proper financial officers
of the City be and they are hereby authorized and directed
to make all payments required by law hereby and hereunder.
