AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AMENDING ORDINANCE NO. 1605, THE
UNCLASSIFIED SALARY ORDINANCE; CORRECTING THE MAXIMUM OF
EACH SALARY RANGE TO REFLECT A TWO PERCENT INCREASE (2%)
(INSTEAD OF 5% DUE TO A CLERICAL ERROR IN ORDINANCE NO. 2022-
4516) TO ACCOUNT FOR COST-OF-LIVING ADJUSTMENTS NOT AWARDED
TO UNCLASSIFIED EMPLOYEES IN 2019 AND 2020; AND PROVIDING FOR
REPEALER, SEVERABILITY, AND AN EFFECTIVE DATE.
WHEREAS, the Unclassified Service is categorized as Group VII, comprised of over 700
at-will employees (commonly referred to as "Unclassified Employees"); and
WHEREAS, the City Commission amended and adopted the Unclassified Salary
Ordinance (Ordinance No. 2022-4516) at second (2nd) reading on September 28, 2022; and
WHEREAS, there is a need to amend the Unclassified Salary Ordinance to correct the
maximum of each salary range to reflect a two percent increase (2%) (instead of 5% due to a
clerical error In Ordinance No. 2022-4516) to account for Cost-of-Living-Adjustments ("COLAs")
not awarded to Unclassified employees in 2019 and 2020; and
WHEREAS, the amendment to the Unclassified salary ranges does not have a fiscal'
impact to the budget.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, AS FOLLOWS:
SECTION 1. CLASS AND PAY GRADES, SALARIES AND CLASSIFICATIONS
The Unclassified Salary Ordinance No. 1605 shall be amended as follows:
A. Salary Grades and Ranges
1. The following chart reflects a five two percent (5-2%) increase to the maximum of salary
ranges and shall be effective upon ratification of this Ordinance.

All ordinances or parts of ordinances in conflict herewith be and the same are hereby

remainder shall not be affected by such invalidity.

RECOMMENDATION
Administration recommends approval of the Ordinance.
BACKGROUND/HISTORY
The City of Miami Beach has five classified service employee groups represented by
bargaining units, one employee group comprised of classifications in the classified service not
covered by a bargaining unit and one group comprised of at-will employees, commonly referred
to as Unclassified employees. The City of Miami Beach has over 700 at-will employees in the
Unclassified salary group.
The City Commission amended and adopted the Unclassified Salary Ordinance at second
(2nd) reading on September 28, 2022. The Ordinance provided a five percent(5%)increase to
the maximum of each salary range upon ratification of the Ordinance due to an understanding
that Unclassified employees did not receive Cost of Living Adjustments (COLA) in 2017, 2019
and 2020. During a routine audit of pay grade changes, it was discovered before
implementation of this ordinance that unclassified employees in fact received a three percent
(3%)COLA in 2017 but did not receive a COLA in 2019 and 2020.
ANALYSIS
In May of 2017, the City went live with its new Human Resources Management (HRM) system
from. Tyler Munis. Tyler's implementation team spent several months on site training and
assisting HR staff with the new HRM software. During that period, the COLA was approved for

Unclassified employees, and processed in the Munis system by Tyler staff. Unfortunately, the
method that Tyler used to process the 2017 COLA created an anomaly in the brand-new
software where it cannot be seen by HR staff in an Action Entry History Report. Following
implementation, the HR staff collaborated with other users and put in place best practices for
application of mass salary changes. The procedure has been in place since 2017 (after the
COLA).The method used by HR staff creates an audit trail of any salary change made to an
employee's record.
Therefore, since the Unclassified employees did receive a COLA in 2017 but did not receive
COLAs in 2019 and 2020, this Ordinance shall adjust to two percent (2%) the increase in the
maximum of each salary range, effective upon ratification of this Ordinance, in order to provide
parity and prevent loss of wage growth and salary compression.
The ordinance changes reflect edits, additions, and deletions to the classifications and grades
chart.

The reduction from five percent (5%) to two percent (2%) to the maximum of the salary range
does not have a fiscal impact to the budget.
CONCLUSION
The Administration recommends amending Ordinance No. 1605, the Unclassified Employees
Salary Ordinance of the City of Miami Beach, by correcting the maximum of each salary range
by two percent(2%)in the salary charts of the previously approved Ordinance.
Based on the foregoing,the Administration recommends that the City Commission approve the
proposed ordinance on first reading and set the ordinance for second reading December 7,
2022.
