AN ORDINANCE OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA,
AMENDING CHAPTER 2 OF THE CODE OF THE CITY OF
MIAMI BEACH, ENTITLED "ADMINISTRATION," BY
AMENDING ARTICLE II, ENTITLED "CITY COMMISSION,"
BY AMENDING SECTION 2-14, ENTITLED "MEETING
PROCEDURES AND AGENDAS," TO IMPOSE A LIMIT ON
THE MAXIMUM NUMBER OF PROCLAMATIONS,
AWARDS, CERTIFICATES, OR OTHER RECOGNITIONS
THAT MAY BE PLACED ON A MEETING AGENDA BY THE
MAYOR OR BY EACH MEMBER OF THE CITY
COMMISSION; AND PROVIDING FOR REPEALER,
CODIFICATION, SEVERABILITY, AND AN EFFECTIVE
DATE.
WHEREAS, Article II of Chapter 2 of the City Code, entitled "City Commission,"
establishes rules of procedure and agenda requirements for meetings of the City
Commission; and
WHEREAS, proclamations, awards, certificates, and other recognitions made by
the Mayor and City Commission are presented at Presentations and Awards Meetings,
which are separate, regularly scheduled meetings specifically dedicated for these
purposes; and
WHEREAS, in order to promote efficiency at City Commission meetings, and in
view of the significant time and resources required to staff and prepare for meetings, the
Mayor and City Commission now desire to impose a limit on the number of proclamations,
awards, certificates, or other recognitions that may be placed on each meeting agenda
by the Mayor or each member of the City Commission.
NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA,AS FOLLOWS:
SECTION 1. That Article II of Chapter 2 of the Miami Beach City Code is hereby amended
to state as follows:

take place every other month to the extent possible. or on such other dates as
the Ci Commission ma determine at its discretion. •rovided that at least six(6

SECTION 2. REPEALER.
All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. SEVERABILITY.
If any section, sentence, clause or phrase of this ordinance is held to be invalid or
unconstitutional by any court of competent jurisdiction, then said holding shall in no way
affect the validity of the remaining portions of this ordinance.
SECTION 4. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach,
and it is hereby ordained that the provisions of this ordinance shall become and be made
a part of the Code of the City of Miami Beach, Florida. The sections of this ordinance

may be renumbered or re-lettered to accomplish such intention, and the word "ordinance"
may be changed to "section," "article," or other appropriate word.
SECTION 5. EFFECTIVE DATE.
This Ordinance shall take effect on 1/196rck ' , aoa?

The attached Ordinance has been drafted at the request of Vice-Mayor Steven Meiner and placed
on the February 22, 2023 City Commission meeting agenda for Second Reading.
Article II of Chapter 2 of the City Code, entitled "City Commission," establishes rules of procedure
and agenda requirements for meetings of the City Commission. On July 8, 2015, the City
Commission adopted Ordinance No. 2015-3924 which, among other things, amended the Code
to provide for the setting of Presentations and Awards meetings. The purpose of the Ordinance
was to provide for "separate regularly scheduled meetings" that are "specifically dedicated" for
purposes of presenting proclamations, awards, certificates, and all other recognitions
(collectively, "Proclamations") made by the Mayor and City Commission.
The City's current practice is to schedule up to three (3) standalone Presentations & Awards
meetings per year. In months with a standalone Presentations &Awards meeting, Proclamations
may only be presented at the Presentations & Awards meeting. If Proclamations are scheduled
to be presented on the same date as a regular City Commission meeting, the City's practice is to
notice the meeting as a "City Commission/Presentations &Awards Meeting."
On February 1, 2023, the Mayor and City Commission unanimously approved a proposed
amendment to the Ordinance, to eliminate the practice of presenting Proclamations at regular
meetings of the City Commission, and provide for Proclamations to only be presented at stand-
alone Presentations and Awards meetings. The City Commission also expressed the desire for
such Presentations and Awards meetings to be scheduled to take place every other month (six
times per year). Accordingly, the proposed Ordinance has been amended to reflect the changes
unanimously endorsed by the City Commission at First Reading.
