Resolution 94-21028 ± s RESOLUTION NO. 94-21028 A RESOLUTION OF THE MAYOR AND CITY COMMISSION ,' OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE FIRST ONE (1) YEAR EXTENSION OF THE MANAGEMENT SERVICES AGREEMENT BY AND BETWEEN THE CITY OF MIAMI BEACH AND • BEACH PARKING SYSTEMS, INC. FOR OPERATION AND MANAGEMENT OF MUNICIPAL PARKING GARAGE 17-A LOCATED AT 13TH STREET AND COLLINS AVENUE, SAID EXTENSION COMMENCING ON APRIL 1, 1994, AND ENDING ON MARCH 31, 1995. WHEREAS, the City owns the Municipal Parking Garage 17-A at 13th Street and Collins Avenue (hereinafter referred to as the Facility) ; and WHEREAS, on March 20, 1991, the Mayor and City Commission approved Resolution No. 91-20268, authorizing the Mayor and the City Clerk to execute a three (3) year Management Services Agreement by and between the City and Beach Parking Systems, Inc. , for operation and management of the Facility, said Agreement commencing on April 1, 1991 and ending on March 31, 1994; and WHEREAS, the Agreement provides for two (2) successive one (1) year extension options, to be exercised by the City upon notice to Beach Parking Systems, Inc. ; and WHEREAS, the Administration herein recommends that the Mayor and City Commission. authorize ' and approve a first (one) year extension to the Agreement, said extension commencing on April 1, 9 1994 and ending on March 31, 1995. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein approve and authorize the first one (1) year extension of the Management Services Agreement by and between the City of Miami Beach and Beach Parking Systems, Inc. for operation and management of Municipal Parking Garage 17-A, located at 13th Street and Collins Avenue, said extension commencing on April 1, 1994 and ending on March 31, 1995. Carifd City Manager EXTENSION OF MANAGEMENT SERVICES AGREEMENT WITH BEACH SUBJECT: PARKING SYSTEMS, INC. FOR THE MANAGEMENT AND OPERATION OF CITY OF MIAMI BEACH MUNICIPAL PARKING GARAGE 17-A, LOCATED AT 13TH STREET AND COLLINS AVENUE ADMINISTRATION RECOMMENDATION: The City Administration recommends that the City Commission approve a one (1) year extension of the'Management Services Agreement with Beach Parking Systems, Inc. for the management and operation of the City of Miami Beach municipal parking garage 17-A, located at 13th Street and Ocean Drive. BACKGROUND: City Commission Resolution No. 91-20268 authorized the Mayor and the City Clerk to execute a three (3) year management services agreement by and between the City of Miami Beach and Beach Parking Systems, Inc. for operation and management of municipal parking garage 17-A located at 13th Street and Ocean Drive. The current agreement commenced April 1, 1991 and expires March 31, 1994 . The extension option in the Agreement states that "the City shall have the right to extend this Agreement for two (2) successive additional one (1) year terms. . . " . The one year extension period would then expire on March 31, 1995 . ANALYSIS: The City of Miami Beach pays Beach Parking Systems, Inc. , for the term of the current agreement, a base management fee not to exceed $178, 000 per year, payable in an amount not to exceed $14, 833 per month. As an incentive fee, Beach Parking Systems, Inc. is paid 10 per cent of the amount of gross revenues generated in access of $190, 000 for any contract year. All terms would remain the same during the one (1) year extension. period. An amendment was incorporated into the Agreement on July 10, 1991, which provides police services for additional security in the garage on weekends and evenings. CONCLUSION: When the City was operating the municipal parking garage, the City was losing money. The current management services agreement has proven profitable for both the City of Miami Beach and Beach Parking Systems, Inc.
