Resolution 91-21032 RESOLUTION NO. 94-21032 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, FOR THE CITY COMMISSION TO SET JANUARY 28, 1994 AT 3:00 P.M. FOR A SPECIAL MEETING OF THE CITY COMMISSION TO HEAR THE POSITION OF THE PARTIES WITH RESPECT TO THE SPECIAL MASTER RECOMMENDATIONS FOR SETTLING THE IMPASSE BETWEEN MIAMI BEACH EMPLOYEES BENEVOLENT ASSOCIATION (M.B.E.B.A. ) AND THE CITY OF MIAMI BEACH. WHEREAS, the Administration has been negotiating with the Miami Beach Employees Benevolent Association for a successor labor agreement as this agreement expired September 30, 1991; and WHEREAS, the parties were unable to reach an agreement and utilized the impasse procedures provided in Florida Statute 447.403 (Resolution of Impasses) ; and WHEREAS, the Special Master report is required to be sent to the City Commission along with the recommendation for settlement by the respective parties where there is a rejection by one of the parties to the Special Master report; and WHEREAS, Florida Statute 447.403, Resolution of Impasses, further requires a hearing before the City Commission at which the parties shall be required to explain their position with respect to the rejected recommendation of the Special Master; and WHEREAS, Florida Statute 447.403, requires when there is a rejected portion of the Special Master report, the City Commission will hold a hearing and after hearing the parties, shall take such action as it deems to be in the public interest, including the interest of the public employees involved, to resolve all disputed issues. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Commission of the City of Miami Beach set a Special City Commission Meeting at ,3: 00 p.m. on January 28, 1994 to hear the Administration's and the Miami Beach Employees Benevolent Association's position with respect to the Special Master Report. A report will be filed with the City Commission prior to the Hearing of January 28, 1994 which will contain the following: A. The Special Master Report and Recommendations; B. The Miami Beach Employees Benevolent Association Report rejecting the Special Masters Findings and their recommendation for settlement; and, C. The City Manager's recommendation for settlement.
