A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA REFERRING TO THE PLANNING BOARD
THE ATTACHED ZONING AMENDMENT PROPOSED BY
THE CITY COMMISSION REQUIRING THAT VACANT
LOTS IN COMMERCIAL DISTRICTS BE SECURED
AGAINST VEHICLE ENTRY.
WHEREAS, there currently exist in the City' s commercial
districts vacant lots which have not been improved or licensed
for parking in accordance with City requirements but are often
used for parking by persons patronizing businesses in the area;
and
WHEREAS, these lots may lack adequate lighting and may
have other conditions which make them unsafe or unsuitable for
use as parking lots; and
WHEREAS, the City' s current zoning regulations do not
require that such lots in commercial districts be secured to
prevent improper or unauthorized parking; and
WHEREAS, pursuant to Section 14 of the City' s Zoning
Ordinance, proposed amendments to the Ordinance are first
reviewed by the Planning Board for recommendation to the City
Commission regarding their adoption; and
WHEREAS, pursuant to Subsection 14-1 of the Zoning
Ordinance the City Commission may submit an applicationfor a
proposed zoning amendment which will then be reviewed by the
Planning Board prior to Commission consideration; and .
WHEREAS, the Mayor and City Commission wish to submit an
application for the zoning amendment attached hereto as Exhibit
"1" which would require that vacant lots in commercial
districts be secured against vehicle entry.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor
and City Commission hereby propose the ordinance attached
. hereto as Exhibit "1" as an amendment to the City' s Zoning
Ordinance and refer the proposed amendment to the City' s
Planning Board for consideration and recommendation in
accordance with Section 14 of Zoning Ordinance No. 89-2665 .

SUBJECT: RESOLUTION PROPOSING AND REFERRING TO THE PLANNING BOARD
AN ORDINANCE REQUIRING THE SECURING OF VACANT LOTS IN
COMMERCIAL DISTRICTS
Commissioner Nancy Liebman requested that our office draft the
attached Resolution referring to the Planning Board an ordinance
requested by Commissioner Liebman which would require that vacant
lots in the City's commercial districts be secured against vehicle
entry. Currently there is no requirement that vacant lots which
are not licensed or approved by the City for use as parking lots be
secured against unauthorized use as such.

The attached ordinance is an amendment to the supplementary
yard regulations in the Zoning Ordinance. Pursuant to Section 14
of the City's Zoning Ordinance, a zoning amendment must be reviewed
by the Planning Board prior to City Commission consideration.
Subsection 14-1 of the Zoning Ordinance authorizes the City
Commission to be the applicant for a zoning amendment. The
attached Resolution provides for the City Commission to be the
applicant for the proposed zoning amendment which will be referred
to the Planning Board. -
