On behalf of the Belle Isle Residents Association (BIRA) and Sunset Harbour Neighborhood
Association Boards of Directors, attached please find resolutions relating to Item R5 M on the
June 28, 2023 Commission meeting.
R5 M INDOOR RESTAURANT AMBIENT ENTERTAINMENT PILOT PROGRAM
AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, AMENDING CHAPTER 12 OF THE CODE OF THE CITY OF MIAMI
BEACH, ENTITLED "ARTS, CULTURE AND ENTERTAINMENT," BY AMENDING
ARTICLE 11, ENTITLED "SPECIAL EVENTS," BY AMENDING SEC TION 12-6, ENTITLED
"AMBIENT ENTERTAINMENT PERMIT PROGRAM," TO CREATE AN INDOOR

R5-M Sponsored by Commissioner Arriola
The Belle Isle Residents Association urges the Miami Beach City Commission to reject the request to create an indoor
restaurant ambient entertainment pilot program.
Residents will not benefit from this pilot program. It will be administered by the Director of Tourism and Culture, whose
job is to generate more revenue from tourism. This pilot, led by tourism, will subject city residents to unwanted noise
while they are trying to eat and have conversations with their fellow diners. Moreover, the city's Code Compliance team
will be charged with enforcement of the hours and sound level of this pilot. Code Compliance fails to enforce current
ambient noise complaints from restaurants. Adding a pilot program to their workload means no enforcement, and
residents will suffer.
Finally, this proposed pilot does not allow residents - via their neighborhood associations- to opt out of this program.
The only acceptable option for this pilot program is to offer each neighborhood association the opportunity to opt-out at
their sole discretion.

The neighborhood voted via ballots on 9-10-2019, we have
provided in person input in 2021, 2022 now 2023, many residents
emails, residents attendance via zoom and we continue to
communicate that W E DO NOT W ANT LIVE ENTERTAINM ENT IN
SUNSET HARBOUR.
THE NEIGHBORHOODS DOES NOT W ANT LIVE ENTERTAINM ENT
NOR A PILOT- W E ARE HOPING YOU W ILL GET THIS M ESSAGE &
PLEASE KILL ITEM RSN FOR ONCE AND FOR ALL ON JUNE 28 2023.
All 4 of the neighborhood associations have com municated
resolutions that they also do not want live entertainment and do
not want to participate in the pilot. The residents' have been
communicated to the commission and the city still wants to
implement this item via a pilot.
As we continue to state W E DO NOT W ANT LIVE ENTERTAINMENT
the city has pressing issues to address please kill this item once and
for all.
Enjoy the LIVE ENTERTAINMENT AREAS we have today and fix them
that we can all enjoy them safely because today we currently do
not.
W e urge you, please do not waste any more of our tim e on this
item. The residents do not want it, the neighborhood do not want
and end this 4-year ordeal. If it passes it will change the character
of our great neighborhood that we all love and enjoy today and into
the future.

Honorable Mayor and Commissioners:
The following Resolution was passed by our neighborhood in 2019. That is how
long this issue has been going on.
March 30, 2019
Mayor Dan Gelber and Commissioners;
On March 30 th 2019 the Sunset Harbour Neighborhood Association
board has passed the following resolution:
The Sunset Harbour Neighborhood Association respectfully request
that the City Commission leave intact our current zoning prohibiting
entertainment and desist from any effort to redefine "entertainment",
and not to dilute any of the quality of life protections applicable to each
neighborhood that are in the current code.
Today, June 24, 2023, it is more important than ever that this proposal be killed once
and for all. We do not want it, it will change the character or our neighborhood and it
will alter the lives of over 500 families. This should not be the legacy that the departing
members of our City Commission leave in their names.
