A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, DIRECTING THE
ADMINISTRATION TO IDENTIFY APPROPRIATE FUNDING IN THE FY
2024 BUDGET FOR THE CITY MANAGER TO EITHER HIRE A
SENIOR-LEVEL EMPLOYEE OR ENGAGE AN OUTSIDE
CONSULTANT TO ASSIST WITH AND LEAD NEGOTIATIONS FOR
DEVELOPMENT AGREEMENTS AND PUBLIC-PRIVATE
PARTNERSHIPS, IN ORDER TO ALLOW THE SENIOR MEMBERS OF
THE CITY MANAGER'S OFFICE TO DEDICATE MORE OF THEIR TIME
TO ADDRESSING THE MANY OTHER PRESSING ISSUES AND
PRIORITIES OF THE MAYOR AND CITY COMMISSION.
WHEREAS, the City Manager's Office and City Attorney's Office routinely
handle the negotiation and drafting of development agreements, ground leases and'•
related documents in connection with major complex public-private partnerships and
development agreements, and many other transactions, including transactions that do
not ultimately materialize or do not obtain the requisite voter referendum approval; and
WHEREAS, currently, the Deputy City Manager and one (1) Assistant City
Manager are responsible for the negotiation of all major development agreements,
leases and proposed public-private partnerships, with support from the City Attorney's
Office on legal issues and the drafting of the agreements and related City Commission
agenda items; and
WHEREAS, these two (2) senior public administrators in the City Manager's
Office invest an enormous amount of hours on negotiating specific deal terms in the
best interest of the City, while also overseeing numerous departments and diligently
working to address the many other priorities of the Mayor and City Commission; and
WHEREAS, notwithstanding the efforts of the City Manager's Office and City
Attorney's Office to successfully complete every transaction the City Commission
desires to consider, the City would be better served by identifying funding as part of
the FY 2024 budget to allow the City Manager to either hire a senior-level employee or
engage an outside consultant to assist with and lead negotiations for public-private
partnerships projects and development agreements; and
WHEREAS, identifying a "Lead Negotiator" position to reside in the City
Manager's Office, either as a senior-level administrator or outside consultant, would
result in better utilization of scarce resources, and would allow the senior members of
the City Manager's office to dedicate more of their time to addressing the many other
pressing issues and priorities of the Mayor and City Commission.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby direct the Administration to identify appropriate funding in the FY
2024 budget for the City Manager to either hire a senior-level employee or engage an
outside consultant to assist with and lead negotiations for development agreements
and public-private partnerships, in order to allow the senior members of the City
Manager's office to dedicate more of their time to addressing the many other pressing
issues and priorities of the Mayor and City Commission.
