WHEREAS, the City of Miami Beach is committed to ensuring public safety and upholding the law within its jurisdiction; and WHEREAS, the safety and well-being of the residents and visitors of Miami Beach is of paramount importance; and WHEREAS, bench warrants may be issued by the court when an individual fails to appear for a scheduled court date or violates the terms of their release; and WHEREAS, the timely execution of bench warrants and apprehension of criminal defendants is crucial for maintaining public safety and the integrity of the criminal justice system by ensuring that individuals facing criminal charges are brought to justice; and WHEREAS, the Miami Beach Police Department plays a vital role in maintaining law and order within the City, and having immediate access to accurate and up-to-date information about bench warrants is essential for effective law enforcement efforts; and WHEREAS, Miami-Dade County, under whose jurisdiction the City falls, maintains the records of bench warrants issued for defendants arrested in the City of Miami Beach for all felony and misdemeanor cases; and WHEREAS, cooperation and information sharing between municipalities and local law enforcement agencies is essential to many law enforcement endeavors and protecting the community; and WHEREAS, access to accurate and up-to-date bench warrant information for Miami Beach criminal defendants with outstanding bench warrants would significantly enhance the City's ability to apprehend such individuals and fulfill its duty to uphold public safety; and WHEREAS, the City recognizes the critical role of Miami-Dade County as a key partner in addressing criminal activities within its boundaries; and WHEREAS, the City hereby expresses its willingness to collaborate with Miami-Dade County in instituting any necessary measures or protocol in order to implement this Resolution and facilitate the smooth and secure sharing of information; and WHEREAS, this item was heard and received a unanimous favorable recommendation at the June 21, 2023 Public Safety and Neighborhood Quality of Life Committee meeting. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby urge Miami-Dade County to provide the Miami Beach Police Department with, or access to, a comprehensive list of bench warrants issued for Miami Beach criminal defendants on a daily basis, to include relevant details such as the defendants' names, addresses, charges, and any additional pertinent information, in order to enhance the City's ability to apprehend such individuals and fulfill its duty to uphold public safety and hold criminal violators accountable; and further, directing the City Clerk to transmit a copy of this Resolution to the Miami-Dade County Board of County Commissioners, the Miami-Dade County Mayor, the Miami-Dade County Police Department, the Miami-Dade County Clerk of the Courts, the Miami-Dade County Information Technology Department and any other appropriate stakeholders, urging their full support and collaboration in implementing this important initiative.PASSED and ADOPTED this ON day of J T 1v►d- , 2023.
