Resolution 2023-32729RESOLUTION NO. 2023-32729 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AMENDMENT NO. 1 TO THE PROGRAM AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND MIAMI RESCUE MISSION, INC, D/B/A THE CARING PLACE, TO PROVIDE EMERGENCY SHELTER SERVICES TO REFLECT THE INCREASE IN DAILY BED RATES FOR A TOTAL AMOUNT NOT TO EXCEED $120,780 FOR ONE (1) YEAR; FURTHER APPROVING THE FIRST RENEWAL TERM OF THE PROGRAM AGREEMENT FOR AN ADDITIONAL ONE-YEAR TERM; AND AUTHORIZING THE CITY CLERK AND CITY MANAGER TO EXECUTE AMENDMENT NO. 1. WHEREAS, the City is committed to reducing homelessness in the community, and in order to do so, the City provides a variety of services to the homeless, including outreach services, provision of employment, identification documentation services, relocation services, and emergency shelter services; and WHEREAS, the City has contracted with Miami Rescue Mission, Inc. (now doing business as The Caring Place) since 2003 for the provision of 15 emergency shelter beds serving homeless males; and WHEREAS, the current agreement was executed on October 5, 2018, and will expire on October 4, 2023, with two (2), one (1)-year renewal options to be exercised at the discretion of the City Manager; and WHEREAS, the professional services provided by The Caring Place qualify as professional services exempt from formal bidding requirements under Section 287.057(1)(e) of the Florida Statutes; and WHEREAS, during agreement renewal negotiation, The Caring Place has conveyed that due to the organization's rising operational costs, the renewal agreement would require an increase of $1.70 to the daily emergency shelter bed rate, thus increasing the rate from $20.30 to $22.00 (an 8.37% increase), totaling $120,780 for 366 days; and WHEREAS, the willingness of The Caring Place to accept homeless clients who may otherwise be rejected by other shelter providers because of identification, criminal history or physical impairments, ensures that the City can place its most vulnerable and hard -to -serve homeless in shelter as the first step in ending their personal homelessness; and WHEREAS, the City Manager recommends approving the Resolution to authorize the execution of Amendment No.1 to the Program Agreement between the City of Miami Beach and The Caring Place for emergency shelter services and approving the increase in daily bed rate in a total amount not to exceed $120,780 for approximately one (1) year. RECOMMENDATION The Administration recommends approving the Resolution to authorize the execution of Amendment No.1 to the Program Agreement between the City of Miami Beach and The Caring Place (formerly known as the Miami Rescue Mission) ("Contractor") for emergency shelter services and approving the increase in daily bed rate in a total amount not to exceed $120,780 for approximately one (1) year. BACKGROUND/HISTORY The Caring Place provides emergency shelter, residential programs, job training, education & computer literacy classes, healthcare, transitional housing, permanent housing, and employment opportunities for homeless men. The City has contracted with The Caring Place since 2003 to provide fifteen (15) emergency shelter beds. This longstanding partnership has allowed the City to offer shelter placement to homeless males in a safe, supportive environment with effective tools that support individuals in achieving short- and long-term goals. The Caring Place has historically been notably essential to the City's outreach efforts by accepting homeless males that may be unable to access shelter at alternative locations due to mobility limitations, medical conditions, and substance abuse and/or criminal history. On September 12, 2018, the Mayor and City Commission adopted Resolution No. 2018-30460, waiving, by a 5r7ths vote, the competitive bidding requirement and approving the City to enter into an agreement with the Miami Rescue Mission for a period of five (5) years for fifteen (15) emergency shelter beds. The agreement was executed on October 5, 2018, and will expire on October 4, 2023, with two (2), one (1) year renewal options to be exercised at the discretion of the City Manager. Page 611 of 2938 In July 2023, the Administration met with the Contractor to negotiate the terns of the renewal agreement, at which point the Contractor conveyed that due to the organization's rising operational costs, the renewal agreement would require an increase of $1.70 to the daily emergency shelter bed rate, thus increasing the rate from $20.30 to $22.00 (an 8.37 percent increase), totaling $120,780 for 366 days. In March 2023, the City renewed the agreements for emergency shelter beds with Camillus House and the Salvation Army at a 3 percent increase in daily bed rates, increasing the costs to $30.54 and $36.08 per bed per day, respectively. The City also contracts with the Sundari Foundation for six (6) beds at a daily rate of $42.50 per bed. The Caring Place offers emergency shelter beds at a lower rate than any other emergency shelter provider contracted by the City. The Office of Housing and Community Services has inquired about purchasing additional beds from The Caring Place, however, no additional beds are available at this time. To increase the City's benefit of services, the Contractor has agreed to support the City's newly formed extended outreach team by accepting clients for shelter placement on Saturdays and S undays. The current agreement with The Caring Place expires on October 4, 2023 and must be renewed beforehand to avoid service interruption. The Administration has drafted the proposed amendment to increase the daily rate for emergency shelter beds to $22.00 per bed for fifteen (15) beds. The Administration is seeking the approval of Amendment No.1 to the agreement with The Caring Place for emergency shelter services with an increase in daily bed rate in a total amount not to exceed $120,780 for approximately one (1) year. •; ► According to the 2022 Miami Beach Community Survey, 24.6 percent of surrey responders cited efforts to address homelessness one of the major categories of City services most important for the City to provide. AddRionalty, the Mayor and City Commission identified the need to address homelessness by continuously evolving and innovating services to help those wishing to end their personal homelessness as a key management objective in the City's 2019 Strategic Plan Through the Lens of Resilience. The fiscal impact would be $120,780. These funds have been proposed in the FY 2024 General Fund Operating Budget (FUND 0560). RECITALS WHEREAS, The Caring Place provides emergency shelter, residential programs, job training, education 8 computer literacy classes, healthcare, transitional housing, permanent housing, employment opportunities for homeless men; and WHEREAS, the City has contracted with The Caring Ptace since 2003 for the provision of fifteen (15) emergency shelter beds for homeless mates; and WHEREAS, On September 12, 2018, the Mayor and City Commission adopted Resolution 2018-30460, waiving, by 517ths vote, the competitive bidding requirement and approving the City to enter into an agreement with the Miami Rescue Mission for a period of five (5) years for fifteen (15) emergency shelter beds in the annual not -to -exceed amount of $98,769, with the not -to - exceed amount increased by three percent (3%) annually; and WHEREAS, on October 5, 2018, the City and Contractor executed the agreement; and WHEREAS, the agreement included an initial term of five (5) years with two (2), one (1) year renewal options to be exercised at the discretion of the City Manager; and WHEREAS, Section 3.1 of the agreement established the following Year 1- $18.04 per bed, per day for a minimum of fifteen (15) beds, totaling $98,769.00; Year 2- $18.58 per bed, per day for a minimum of fifteen (15) beds, totaling $102,004.20; Year 3- $19.14 per bed, per day for a minimum of fifteen (15) beds, totaling $104,791.50; Year 4- $19.71 per bed, per day for a minimum of fifteen (15) beds, totaling $107,912.25; Year 5- $20.30 per bed, per day for a minimum of fifteen (15) beds, totaling $111,142.50 WHEREAS, the current agreement will expire on October 4, 2023; and WHEREAS, the current agreement does not stipulate the fixed fee or terms of a renewal agreement; Page 614 of 2938 WHEREAS, the Administration met with the Contractor to negotiate the terms of the renewal agreement, at which point the Contractor conveyed that due to the organization's rising operational costs, the renewal agreement will require an increase in the daily emergency shelter bed rate of $1.70, thus increasing the rate from $20.30 to $22.00, totaling $120,780.00 for one (1) year (366 days); and WHEREAS, as an additional benefit to the City, the Contractor agrees to support the City's newly formed extended outreach team by accepting clients for shelter placement on Saturday's and Sunday's. WHEREAS, because the cost of the Services during the renewal term are estimated to exceed the City Manager's purchasing authority under the City Code, in the amount not to exceed $100,000.00, the approval of the renewal term will require approval by the City Commission; and NOW, THEREFORE, in consideration of the mutual promises and conditions contained herein, and other good and valuable consideration, the suftlency of which is hereby acknowledged, the City and Consultant hereby agree as follows: 1. ABOVE RECITALS. The above recitals are true and correct and are incorporated as part of this Amendment. 2. MODIFICATIONS. The Agreement is modified (deleted items sipuGk lhm"14 and inserted items underlined as follows: (a) The fixed fee per bed, per day, I's hereby adjusted to $22.00, in an amount not to exceed $120,780 for one (1) year (366 days). (b) The Contractor will accept homeless clients for shelter intake seven (7) days a week. (c) Section 3.1 of the Agreement is hereby deleted in its entirety and replaced with the following: All expenditures are contingent upon -manual budget appropriation. 3. RATIFIC&ION. Except as amended herein, all other terms and conditions of the Agreement shall remain unchanged and in full force and effect.
