MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY

HIBISCUS ISLAND, ACCORDING TO THE PLAT THEREOF, RECORDED IN
PLAT BOOK 8, PAGE 75, OF THE PUBLIC RECORDS OF MIAMI-DADE
COUNTY, FLORIDA, CONTAINING APPROXIMATELY 875 SQUARE FEET; SAID
RELEASE BENEFITING IBRAHIM AL-RASHID AND RYANN AL-RASHID, THE
OWNERS OF THE PROPERTY ENCUMBERED BY THE EASEMENT, LOCATED
AT 218 SOUTH HIBISCUS DRIVE.
WHEREAS, Ibrahim AI -Rashid and Ryann al -Rashid, are the owners of the Property located
at 218 South Hibiscus Drive, Miami Beach, bearing Miami -Dade County Folio No. 02-3232-006-
0880 (the "Property"); and

WHEREAS, the Property is located on Hibiscus Island at the southeast corner of the
intersection of Fountain Street and South Hibiscus Drive; and
WHEREAS, the Property fronts Biscayne Bay at the rear and is surrounded at the sides and
across the streets by similar single-family homes; and
WHEREAS, the Property is platted and encompasses Lots 29 and 30, of Block 3 of the
HIBISCUS ISLAND plat, as recorded in Plat Book 8, at Page 75 of the Public Records of Miami -
Dade County; and
WHEREAS, the Property is approximately 31,500 square feet in size and is located within
the RS-3, Single Family Residential Zoning District; and
WHEREAS, the Property is encumbered by a 5-foot easement running along the easterly
five (5)'feet of the Property (the ``Easement"); and
WHEREAS, the Easement was created on January 18, 1949, in favor of the City and
recorded in Deed Book 3106, at Page 355, of the Public Records of Miami -Dade County, Florida,
with the stated purpose of laying and maintaining underground storm sewers, and more particularly
described as follows:
lying in the easterly five (5) feet of Lot 29, Block 3, HIBISCUS ISLAND, according to
the Plat thereof, recorded in Plat Book 8, Page 75, of the Public Records of Miami -
Dade County, Florida, containing approximately 875 square feet; and
WHEREAS, a review of existing conditions and public records reveals, that due to recent
work by the City on the stormwater system for the nearby area, there is no current existing use of
the Easement by the City for storm sewer purposes; and
WHEREAS, since the City is not currently using the Easement, the owners have requested
that the City abandon the Easement; and
WHEREAS, the City's Public Works Department does not anticipate the need to use the
Easement in the future; and
WHEREAS, since the Easement is not currently being used by the City and the City does
not anticipate needing the Easement in the future, the Easement may be abandoned; and
WHEREAS, based upon the foregoing, the City Manager recommends terminating and
releasing the Easement.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYORAND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby
approve and authorize the City Manager and City Clerk to execute a Termination and Release of a
City stormwater utility easement ("Easement") in the form attached to this Resolution as Exhibit 1 ";
said Easement recorded in Deed Book 3106, at Page 355, of the Public Records of Miami -Dade
County, lying in the easterly five (5) feet of Lot 29, Block 3, HIBISCUS ISLAND, according to the
Plat thereof, recorded in Plat Book 8, Page 75, of the Public Records of Miami -Dade County,
Florida, containing approximately 875 square feet; said release benefiting Ibrahim AI -Rashid and
Ryann AI -Rashid, the owners of the Property encumbered by the Easement, located at 218 South
Hibiscus Drive.

RECOMMENDATION
The Administration recommends approving the Resolution.
Ibrahim AI -Rashid and Ryann al -Rashid, are the owners of the Property located at 218 South
Hibiscus Drive, Miami Beach, bearing Miami -Dade County Folio No. 02-3232-006-0880 (the
"Property").
The Property is located on Hibiscus Island at the southeast comer of the intersection of

SUPPORTING SURVEY DATA
Results from the 2022 Resident Survey related to the City's perception and satisfaction show
an overall approval of 67.4%, and rated the City as a good place to live.
No fiscal impact.
CONCLUSION
The Administration recommends approving the Resolution.

This law firm represents Ibrahim Al Rashid and Ryann
al Rashid (collectively, the "Petitioner"), the owners of the
Property located at 218 S. Hibiscus Drive (the "Property") in
the City of Miami Beach (the "City"). Please allow this letter
to serve as the required letter of intent in connection with
the Petitioner's request for the abandonment of a
stormwater utility easement located within the Property that
is held by the City but is no longer in use or projected future
use.
Property Information. The Property is located on
Hibiscus Island at the southeast corner of the intersection of
Fountain Street and S. Hibiscus Drive. The Property fronts
Biscayne Bay at the rear and is surrounded at the sides and
across the streets by similar single-family homes. The
Miami -Dade County Property Appraiser's Office identifies
the Property with Folio No. 02-3232-006-0880. See Exhibit
A, Property Appraiser Summary Report.
The Property is platted and encompasses Lots 29 and
30 of Block 3 of the Hibiscus Island plat as recorded in Plat
Book 8 at Page 15 of the Public Records of Miami -Dade
County. See Exhibit B, Plat. The Property is approximately
31,500 square feet in size and is located within the RS-3,
Single Family Residential Zoning District.

Purpose and History of the Easement. At present, there exists a 5-foot easement
on the eastern 5 feet of the Property (the "Easement"). The easement was created on
January 18, 1948, in favor of the City with the stated purpose of laying and maintaining

records, reveals that due to recent work by the City on the stormwater system for the
nearby area there is no current existing use of the Easement by the City for storm sewers

early August 2023, through meetings and communications with Alex Alvarez, Principal
Engineer and Acting Right -of -Way Manager for the City, and Cristina Ortega Castineiras,
City Engineer, it has been determined that the Easement is not needed and may be
abandoned.

TERMINATION AND RELEASE OF EASEMENT
THIS TERMINATION AND RELEASE OF EASEMENT ("Agreement") s made and
entered into as of the day of , 2023, by and between IBRAHIM
AL-RASHID and RYANN AL-RASHID, husband and wife (collectively, the "Owner'), owner of
the property located 218 South Hibiscus Drive, Miami Beach, Florida 33139 (the "Property") as
described in Exhibit "A", attached hereto, and the CITY OF MIAMI BEACH, FLORIDA, a
municipal corporation of the State of Florida (the "City*).
WHEREAS, the Property is encumbered by a 5-foot perpetual, recorded easement in favor
of the City and its grantees to lay and maintain underground storm sewers (the "Easement); and
WHEREAS, the Easement runs along the easterly 5 feet of the Property, recorded in Deed
Book 3106, at Page 365, of the Public Records of Miami -Dade County, Florida, and more
particularly described as follows:
lying in the easterly five (5) feet of Lot 29, Block 3, HIBISCUS ISLAND,
according to the Plat thereof, recorded in Plat Book 8, Page 75, of the
Public Records of Miami -Dade County, Florida, containing approximately
875 square feet.
WHEREAS, since the Easement is not currently being used by the City and the City
does not anticipate needing the Easement in the future, the Owner has requested that the City
abandon the Easement and the City has agreed; and
WHEREAS, on October 18, 2023, the Mayor and City Commission adopted Resolution No.
, approving and authorizing the City Manager and City Clerk to execute this
Agreement, terminating and releasing the Easement.
NOW, THEREFORE, in consideration of the foregoing, and other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, Owner and the
City agree as follows:
1. The foregoing recitals are true and correct and are incorporated herein by
reference.
2. The Easement is hereby fully canceled, terminated, extinguished and released
and shall have no further force or effect and shall no longer bind the Property set forth therein.
3. Owner and the City hereby direct the Clerk of the Court, Miami -Dade County,
Florida to cancel the same of record.
