A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, RELATING TO CITY
COMMISSION AGENDA ITEMS SPONSORED BY THE MAYOR OR
MEMBERS OF THE CITY COMMISSION OR THE
ADMINISTRATION, AND REQUIRING THE COMMISSION
MEMORANDA ACCOMPANYING SUCH AGENDA ITEMS TO
SPECIFICALLY DISCLOSE: (1) WHETHER ANY LOBBYIST,
INCLUDING THE PRINCIPAL FOR ANY LOBBYIST, HAS
REQUESTED FOR THE ADMINISTRATION OR THE CITY
COMMISSION SPONSOR TO INITIATE THE AGENDA ITEM, AND
(2) IF ANY LOBBYING HAS OCCURRED, TO SPECIFY THE
NAME(S) OF THE FOLLOWING ENTITIES ASSOCIATED WITH THE
ITEM: LOBBYIST(S), PRINCIPALS, AND INDIVIDUALS WITH A
DIRECT OR INDIRECT OWNERSHIP INTEREST OF 5% OR MORE
IN THE PRINCIPAL, CONSISTENT WITH THE LOBBYIST
REGISTRATION REQUIREMENTS OF SECTION 2-482 OF THE
CITY CODE.
WHEREAS, the City Commission aims to promote transparency, accountability,
and ethical governance in all matters, particularly with respect to matters coming
before the Mayor and City Commission for a vote; and
WHEREAS, the, disclosure of lobbying activities related to agenda items
presented to the Mayor and City Commission contribute to maintaining public trust and
ensuring that as part of the decision -making process, members of the City Commission
and the public have access to all pertinent information relating to the agenda item; and
WHEREAS, any person seeking any official City Commission action is required
to register as a lobbyist with the City Clerk's Office, in accordance with Section 2-482
of the City Code; and
WHEREAS, in many instances, members of the City Commission and the public
lack the opportunity to cross-reference the City Commission agenda, which typically
includes over 100 agenda items on any given agenda, against the City Clerk's lobbyist
records, to ascertain who is lobbying for a particular measure or item; and
WHEREAS, it is essential for the Commission and the public to be informed
about any external influence concerning agenda items sponsored by the Mayor or
members of the City Commission; and
WHEREAS,, in furtherance of the City Commission's objective to promote
transparency and ethical governance, Commissioner Bhatt proposes that, as part of
any Commission -sponsored or Administration item,' that the Commission
memorandum must specify whether the. agenda item was requested by a lobbyist, and
if any lobbying activity has occurred regarding the agenda item, the memorandum shall
explicitly state the name(s) of the lobbyist(s) involve, as well as principals, and
individuals with a direct or indirect ownership interest of 5% or more in the principal,
consistent with the lobbyist registration requirements of Section 2-482 of the City Code.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE, CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby require, with respect to City Commission agenda items
sponsored by the Mayor or Members of the City Commission or Administration, for
the Commission Memoranda accompanying such agenda items to specifically
disclose: (1) whether any lobbyist, 'including the principal for any lobbyist, has
requested for the Administration or the City Commission Sponsor to initiate the
agenda item, and (2) if any lobbying has occurred, to specify the names) of the
following entities associated with the item: lobbyist(s), principals, and individuals
with a direct or indirect ownership interest of 5% or more in the principal, consistent
with the lobbyist registration requirements of Section 2-482 of the City Code.
