impact on private, for-profit businesses in the City of Miami Beach, that the proposed Ordinance

O n Se pte m b er 25, 2017 , the M ayor and C ity C om m ission adopted Resolution N o. 2017-
30 0 2 3 , w h ich au th o rize d the C ity A ttorn e y's O ff ice to com m ence the in-house pro secution, by and
th ro u g h a C ity m un icip a l pro se cution tea m , of those individuals exclusively charged w ith violating
th e C ity's crim in al ord in a n ce s. H ow ever, the M ia m i-D ade State A ttorn ey's Off ice (the "M iam i-
D a d e S A O") rem aine d the pro se cutoria l entity respo nsible fo r the prosecution of persons arrested
fo r th e co m m ission of all felo ny, m isdem e anor, and/or C ounty ordinance violations com m itted in
M ia m i-D a d e C o u n ty.
N o dou b t d u e in pa rt to its reputatio n as an intern ationally renow ned tourist destination
a n d the co nsta n t he a vy influx of to urists and othe r visitors, the C ity continues to contend w ith
m a n y crim in a l, qu a lity of life off ense s be ing com m itted w ithin its jurisdictional bounds. The
co m m is sion of m isd e m e a n o r and m unicipa l ordinance offenses in the City adversely im pact
re sid ents' qu a lity of life and tourists' vacatio n expe rie nce, and continue to generate an inordinate
nu m b e r of issues an d co m p la ints fr om the C ity's residents, visitors, and business establishm ents.

ac q u ire grea te r co ntro l an d discretion rega rding the prosecution of such offenses occurring w ithin
th e C ity , an d to re lie ve the M iam i-D a de S A O of so m e of its pro secutorial burden, the C ity desired
to be c o m e the prim a ry en tity responsib le fo r the prosecution of those specified State law
m isd em e anor off ense s (e xcluding dom e stic battery cases). A ccordingly, on M arch 9, 2022, the
M a y o r an d C ity C o m m issio n adopted O rdina nce N o. 2022-4477, w hich created specific offenses
ag a in st m u n icip a l la w fo r the sa m e acts that constitute the State law m isdem eanor offenses of
ba tt e ry (n on-d om estic), crim ina l m ischie f and exposure of sexual organs (indecent exposure).
M ost re ce ntly, on O cto be r 26, 20 22, the M a yor and C ity C om m ission adopted O rdinance
N o . 2 0 2 2 -4 5 2 0 , w h ich crea ted a spe cific off ense ag ainst m unicipal law for the sam e act(s) that
co n stitute the S tate law m isd em ea nor off ense of brea ch of the peace I disorderly conduct.
T he pro p o se d O rd in ance w ou ld create, through specific reference, offenses against
m u n icip a l la w fo r the sa m e acts tha t constitute the State law m isdem eanor offenses of assault,
lo ite rin g or pro w ling , an d disorderly cond uct on the prem ises of an establishm ent, as such
off e n s e s are se t fo rt h in F la. S tat. 784.011, Fla. Stat. 856.021, and Fla. Stat. 509.143, respectively.

U n d er F lorid a law , a m u n icipality m a y, by ordina nce, adopt State m isdem eanor statutes by
sp e c ifi c re fere n ce or by gen e ra l refere nce, such as that contained in an ordinance m aking it
un la wf ul to co m m it, w ithin C ity lim its, any act w hich is ( or shall be) recognized by the law s of the
S ta te as a m isdem e a n o r.
T h e F lorid a Sup re m e C ourt ha s determ ined that Florida's loitering or prow ling statute, as
se t fo rt h in F la. S tat. 85 6.021, is co nstitutio na l. See State v. Ecker, 311 So. 2d 10 4 (Fla. 1975).
T o m itig a te va g uene ss co n ce rn s, the crim ina l offense of loitering requires that a person be in a
pla ce at a tim e or m a n n e r tha t is un usual fo r a law -a b iding citizen, and furt her, that circum stances
ex ist w hich w a rra nt a justifia b le an d rea so na b le ala rm or im m ediate concern fo r the safety of
pe rsons or pro pe rt y in the vicin ity. T he refo re, prio r to effectuating any arrest fo r loitering, a police
off ic e r m us t be able to po in t to spe ci fic and art icula b le facts w hich, taken together w ith rational
in fe re n c e s therefr o m , rea so nab ly w arrant a find ing that a breach of the peace is im m inent or
pu b lic sa fety is thre ate n e d .
F la . S tat. 856 .0 21 also pro vide s that unless flight by the person or other circum stance
m a k e s it im p ra ctica b le, a la w enfo rcem ent officer m ust, prior to effectuating any arrest fo r the
off e n se of loite ring, aff ord the person an opport unity to dispel any alarm or im m ediate concern
w h ic h w o u ld otherw ise be w arra nted by req uesting the person to identify him self or herself and
ex p la in his or he r prese n ce and co nd uct. M oreover, the loitering statute specifically states that
no pe rso n sh all be co nvicted of an off ense under the statute if the law enfo rcem ent offi cer did not
co m p ly w ith this pro ce d u re o r if it appea rs at trial that the explanation given by the person is true
an d , if belie ve d by the off ice r at the tim e , w ou ld have dispelled the alarm or im m ediate concern .

MIAMI BEACH, FLORIDA, AMENDING CHAPTER 70 OF THE CODE OF THE
CITY OF MIAMI BEACH, FLORIDA, ENTITLED "MISCELLANEOUS

WHEREAS, on September 25, 2017, the Mayor and City Commission adopted Resolution
No. 2017-30023, which authorized the City Attorney's Office to commence the in-house
prosecution, by and through a City municipal prosecution team, of those individuals exclusively
charged with violating the City's criminal ordinances; and
WHEREAS, the Miami-Dade State Attorney's Office (the "Miami-Dade SAO") continues
to be the prosecutorial entity responsible for the prosecution of those offenders arrested for the
commission of all felony, misdemeanor, and/or County ordinance violations committed in Miami-
Dade County; and
WHEREAS, due in part to its reputation as an internationally renowned tourist destination
and the constant heavy influx of tourists and other visitors, the City continues to contend with
many criminal, quality of life offenses being committed within its jurisdictional bounds; and
WHEREAS, the commission of misdemeanor and municipal ordinance offenses adversely
impact residents' quality of life and tourists' vacation experience, and continue to generate an
inordinate number of issues and complaints from the City's residents, visitors, and business
establishments; and
WHEREAS, some of those misdemeanor offenses which most adversely affect the City's
residents, visitors, and businesses include battery, indecent exposure, criminal mischief, and
breach of the peace I disorderly conduct; and
WHEREAS, in order to acquire greater control and discretion regarding the prosecution
of those identified misdemeanor offenses occurring in the City, and to relieve the Miami-Dade
SAO of some of its prosecutorial burden, the City desires to become the entity responsible for the
prosecution of those specified State law misdemeanor offenses (excluding domestic battery
cases); and
WHEREAS, Florida caselaw has established that a municipality may enact an ordinance
which creates an offense against municipal law for the same act that constitutes an offense
against State law (see Jaramillo v. City of Homestead, 322 So.2d 496 (Fla. 1975)); and
W H E R E A S , Florida law has further established that a municipality, by ordinance, may
adopt State misdemeanor statutes by specific reference or by general reference, such as that
contained in an ordinance making it unlawful to commit, within City limits, any act which is (or
shall be) recognized by the laws of the State as a misdemeanor (Id. at 498); and
WHEREAS, the City previously established, pursuant to Section 70-1 of the City Code,
that it is unlawful for any person to commit within the City any act that is (or shall be) recognized
by the laws of the State as a misdemeanor and that the commission of such acts is forbidden;
and
WHEREAS, on January 20, 2022, the Mayor and City Commission adopted Resolution
No. 2022-32020, which expanded the City's municipal prosecution program by directing that the
City shall become the primary entity responsible for the prosecution of the State law misdemeanor
offenses of battery ( except domestic battery), criminal mischief, and indecent exposure; and
WHEREAS, on March 9, 2022, pursuant to Resolution No. 2022-32020, the Mayor and
City Commission adopted Ordinance No. 2022-4477, which created specific offenses against
municipal law for the same acts that constitute the State law misdemeanor offenses of battery
(non-domestic), criminal mischief and exposure of sexual organs (indecent exposure); and
WHEREAS, on October 26, 2022 the Mayor and City Commission adopted Ordinance No.
2022-4520 which created a specific offense against municipal law for the same acts that
constitutes the State law misdemeanor offense of breach of the peace I disorderly conduct; and
WHEREAS, the Mayor and City Commission hereby desire to adopt the following
amendments in order to further expand the City's municipal prosecution program by creating,
through specific reference, offenses against municipal law for the same acts that constitute the
State law misdemeanor offenses of assault, loitering or prowling, and disorderly conduct on the
premises of an establishment.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AS FOLLOWS:
SECTION 1. That the section of the City Code creating offenses against municipal law for
the same acts that constitute misdemeanor offenses against State law, as such Ordinance
is codified in section 70-1 of the City Code, be amended as follows and as hereinafter set
forth below:

h) It shall be unlawful for any person to commit, within the city, any act that is or shall be
recognized as a misdemeanor loitering or prowling, as such offense is set forth in F.S. §
856.021.
ill It shall be unlawful for any person to commit, within the city, any act that is or shall be
recognized as a misdemeanor disorderly conduct on the premises of an establishment, as
such offense is set forth in F.S. § 509.143.
SECTION 2. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and the same are hereby
repealed.

SECTION 3. SEVERABILITY.
If any section, subsection, clause or provision of this Ordinance is held invalid, the
remaindershall not be affected by such invalidity.
SECTION 4. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is
hereby ordained that the provisions of this ordinance shall become and be made part of the Miami
Beach City Code. The sections of this ordinance may be renumbered or relettered to
accomplish such intention, and the word "ordinance" may be changed to "section," "article," or
other appropriate word.
SECTION 5. EFFECTIVE DATE.
This Ordinance shall take effect on the day of2023.
