A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, URGING THE FLORIDA LEGISLATURE TO ADOPT
HOUSE JOINT RESOLUTION 167 AND THE RELATED HOUSE BILL 169,
FILED FOR CONSIDERATION DURING THE 2024 LEGISLATIVE SESSION,WHICH SEEK TO REPEAL THE STATE CONSTITUTION'S OUTDATED
DEFINITION OF A LEGAL UNION . OF MARRIAGE AND TO. REMOVE
PROHIBITION. ON RECOGNITION OF SAME-SEX MARRIAGES,
RESPECTIVELY; . AND FURTHER, DIRECTING THE CITY CLERK TO
TRANSMIT A COPY OF.THIS RESOLUTION TO THE SPEAKER OF THE
FLORIDA HOUSE OF REPRESENTATIVES.
WHEREAS, House Joint Resolution 167 ("HJR 167")and House Bill 169 ("HB 169") have
been filed for consideration during the Florida Legislature's 2024 session by House
Representative Fabian Basabe; and aim to repeal the state constitution's outdated definition of a
legal union of marriage and to remove the prohibition on recognition of same-sex marriages; and
WHEREAS; the State Constitution, at Article I Section 27, defines marriage as a legal
union between only one man and only one woman as husband and wife; and
WHEREAS, same-sex marriage was recognized as a constitutionally protected right.in
2015, when the United States Supreme Court, in the landmark Obergefell v. Hodges decision,
granted same-sex couples in all 50 states the fundamental right to marry under the U.S.
Constitution; and
WHEREAS, it is imperative to ensure that the State Constitution aligns with the principles
of equality, nondiscrimination, and inclusivity, reflected by the U.S. Supreme'' Court's legal
recognition of same-sex marriage as protected under the U.S. Constitution; and
WHEREAS, if.adopted, HJR 167 would call for a statewide referendum during the 2024
General Election proposing the removal of language in the Florida Constitution defining marriage
as only being between one man and one woman, and HB 169 would effectuate HJR 167 by
repealing Section 741:212 of the Florida Statutes,which asserts the same definition and:prohibits
same-sex marriage.
NOW,. THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby urge the Florida Legislature to adopt House..Joint Resolution 176 and the
related House Bill 169, filed for consideration during the 2024 Legislative session, which seek to .
repeal the State Constitution's outdated definition of a legal union of marriage and to remove the
prohibition on recognition o same sex marriages, respectively; and further, direct the City Clerk.to
transmit a copy.of:this Resolution to the Speaker of the Florida House of Representatives.
