A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, URGING THE FLORIDA
LEGISLATURE TO ADOPT SENATE BILL 106, FILED FOR
CONSIDERATION DURING THE 2024 LEGISLATIVE SESSION, WHICH
SEEKS TO REQUIRE CERTAIN BUSINESSES TO ACCEPT CASH AS A
VALID FORM OF PAYMENT IN RECOGNITION THAT NOT EVERYONE
HAS ACCESS TO TRADITIONAL BANKING OR DIGITAL PAYMENT
METHODS; AND FURTHER, DIRECTING THE CITY CLERK TO
TRANSMIT A COPY OF THIS RESOLUTION TO THE SPEAKER OF THE
FLORIDA HOUSE OF REPRESENTATIVES, AND THE PRESIDENT OF
THE FLORIDA SENATE.
WHEREAS, Senate Bill 30 ("SB 106") has been filed for consideration during the
Florida Legislature's 2024 session by Senator Shervin Jones, and aims to address the
challenges faced by individuals who rely on cash transactions by promoting financial
inclusion and access to essential goods and services; and
WHEREAS, if adopted, SB 106 would require businesses to accept cash as a valid
form of payment in recognition that not everyone has access to traditional banking or
digital payment methods; and
WHEREAS, key provisions of SB 106 include guidelines for businesses to comply
with the new requirement, ensuring a smooth transition for both consumers and
establishments; and
WHEREAS, SB 106 will require most businesses to accept cash for in-person
transactions but will provide some exemptions for businesses such as architects,
accountants, attorneys, engineers, financial advisors, insurance agents, as well as an
exemption for parking facilities owned by municipalities; and
WHEREAS, in addition, SB 106 doesn't require businesses to accept bills larger
than a $20, money that the business suspects is counterfeit, or cash for single
transactions over$5,000; and
WHEREAS, SB 106 strikes a balance between technological advancements and
the need for financial inclusivity, acknowledging the importance of accommodating
various consumer preferences; and
WHEREAS, by requiring businesses to accept cash, Senate Bill 106 contributes
to the promotion of financial equity and ensures that all individuals, regardless of their
preferred payment method, can fully participate in economic transactions.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY :
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby urge the Florida Legislature- to adopt Senate Bill 106, filed for
consideration during the 2024 Legislative session, which seeks to require certain
businesses to accept cash as a valid form of payment in recognition that not everyone
has access to traditional banking ordigital payment methods; and further, direct the City
Clerk to transmit a copy of this Resolution to the Speaker of the Florida House of
Representatives, and the President of the.Florida Senate.
