97-22491 RESO RESOLUTION NO. 97-22491 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, PURSUANT TO MIAMI BEACH CITY CODE CHAPTER 8, SECTION 8-3, SUBSECTION (L) ENTITLED "SCHEDULE OF PERMIT FEES", GENERAL INFORMATION, AUTHORIZING THE ADMINISTRATION TO RAISE THE SANITATION IMPACT FEE CHARGED ON VARIOUS TYPES OF CONSTRUCTION ACTIVITIES FROM THE CURRENT RATE OF .15% TO .20% AND RAISE THE MINIMUM FEE FROM $15.00 TO $20.00. WHEREAS, the City Commission of the City of Miami Beach, Florida finds it in the pllbhc interest to ensure that all areas within the City limits are adequately provided with high-qu ali:y waste collection and disposal service; and WHEREAS, the City Commission finds it in the public interest to retain regulatory authori:y lS permitted by law over waste collection and disposal because of the overriding public healt 1, safety, welfare and ecological considerations associated with the provision of this service; 1m i WHEREAS, the City Commission finds it in the public interest to retain control over the u;e )f public rights of way to ensure against interference with the public convenience, to promcte aesthetic considerations, and to protect the public investment in right of way property; and WHEREAS, the City Commission finds that the current rate of the "Sanitation Impact Fe,:" charged on various construction activities is an inadequate amount to offset the enormous em ts related to the collection and disposal of illegally dumped construction related debris; and WHEREAS, the City Commission finds that the raising of the "Sanitation Impact Pee" from tle current rate of .15 % to .20 % and the raising of the minimum fee from $15.00 to $20.00 is t Ie best means of assuring that the above interests of the City are served. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and Cil y Commission hereby authorize the Administration to raise the "Sanitation Impact Fee" from tl e current rate of .15 % to .20 % and raise the minimum fee from $15.00 to $20.00. BACKGROUND: The City of Miami Beach Sanitation Department removes an enormous amount of debris illegal y dumped in back alleys, private properties and City rights of ways. This debris is generated :.TO n various types of construction activities such as building demolition and electrical, plumhin~, mechanical, remodeling of existing properties. The City's cost to collect, clean, transport at d dispose of this debris is estimated at more than $225,000 annually. The addition ofa "Sanitation Impact Fee" to help offset the enormous cmts related to the collection and disposal of illegally dumped construction related debris within the Ci:y is the best means of assuring that the above described interest of the City are protected. "D,. 1.,- AGENDA ITEM ~b'll-.L.--- DATE-=t:l~'TI__ Commission Memorandum Page 2 July 16, 1997 The above mentioned City Ordinance passed on second reading January 8, 1997, and took effect tm (10) days after its adoption on the 18th day of January, 1997. The Sanitation Impact Fee is charged on all building, electrical, plumbing, mechanical ard demolition permits. The fee is based upon a 0.15% projected cost ofthe project for which the pem:l it is being applied, with a minimum fee of$15.00 and a maximum fee of$1,500.00. The curren It fte rate of .15% is estimated to generate approximately $200,000 annually. Since the adoption of City Ordinance No. 97-3068, the costs for collection and disposal of illegal y dumped debris has increased considerably. To date there has been no increase in the Sanit,tic n Impact Fee schedule. ANALYSIS: The proposal recommends an increase ofthe current fee of 0.15% of the projected cost of the proje:t for which the permit is being applied to 0.20%. It also increases the minimum charge from $15,( 0 to $20.00. The new rate for the Sanitation Impact Fee would generate approximately $75 ,OC 0 annually which helps offset the estimated costs presently borne by the City. CONCLUSION The proposed increase in the Sanitation Impact Fee would help offset the enormous costs relatf:d' 0 the collection and disposal of construction related debris illegally dumped in the City of Mlani Beach and is therefore in the best interests of the City. lRT"g
