If none of the above exceptions apply, this Business Impact Estim ate is hereby provided
in accordance w ith Section 166.041 ( 4 ), Florida Statutes.
1. A sum m ary of the pro posed Ordinance and its purpose is more fully set forth in the
Com m ission M em orandum accompanying the Ordinance, as w ell as in the recitals to the
Ordinance itself, w hich are attached hereto.
2. The City of M iam i Beach estim ates that the pro posed Ordinance will have no direct
econom ic im pact on private, fo r-pro fit businesses in the City of M iami Beach, that the
pro posed Ordinance w ill have no direct compliance costs that businesses may
reasonably incur; that the pro posed Ordinance w ill not impose any new charge or fee fo r
w hich businesses w ill be financially responsible, and that the pro posed Ordinance will not
im pact the City of M iam i Beach's regulatory costs and w ill not generate any revenue from
new charges or fees.

The attached Ordinance was prepared at the request of Commissioner Alex J. Fernandez for
consideration at the December 13, 2023 City Commission meeting.
The Human Rights Campaign's Municipal Equality Index ("MEI") examines how inclusive
municipal laws, policies, and services are of LGBTQ+ people who live and work tin the
municipality. Cities are rated based on non-discrimination laws, the municipality as an employer,
municipal services, law enforcement and leadership on LGBTQ+ equality. There are currently 506
cities that are automatically rated each year by the HRC.
In past years, the City's LGBTQIA+ Advisory Committee has prepared the relevant documentation
with the assistance of City administration, and submitted it to the MEI Team for scoring. A city
that desires to have its laws and policies assessed according to MEI standards can send an email
to the MEI Team with all of the relevant documentation needed to justify credit for each criterion
The Mayor and City Commission desire to codify the annual preparation and submission of City's
information to the MEI team as part of the LGBTQIA+ Committee's official powers and duties, for
the purpose of scoring the City on its leadership on LGBTQ+ equality.

NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AS FOLLOWS:
SECTION 1. That Section 2-190.145 of Chapter 2 of the City Code is hereby amended
as follows:

Section 2-190.145. Powers and duties.
The committee shall make advisory recommendations to the city commission and
the city manager on initiatives to be implemented and supported by the city regarding a
variety of issues to ensure the well-being and quality of life of the Miami Beach LGBTQIA+
Community. The committee shall annually compile and submit, in a timely manner, with
the assistance of the staff liaison, city data and information to be scored by the human
rights campaign's (HRC") municipal equality index (MEL") on the city's non-
discrimination laws, policies, and services. The committee shall also make
recommendations to the city commission and the city manager regarding any new or
amended laws, ordinances, or policies that may need to be enacted in order to receive
all possible points on the MEI each year.

SECTION 2. REPEALER.
All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. SEVERABILITY.
If any section, subsection, clause or provision of this Ordinance is held invalid, the
remainder shall not be affected by such invalidity.
SECTION 4. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and
it is hereby ordained that the provisions of this Ordinance shall become and be made part
of the Code of the City of Miami Beach, Florida. The sections of this Ordinance may be
renumbered or re-lettered to accomplish such intention, and the word "ordinance" may
be changed to "section," article," or other appropriate word.
