A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF MIAMI
BEACH, FLORIDA, DIRECTING THE MIAMI BEACH POLICE
DEPARTMENT TO FORMULATE A. COMPREHENSIVE PLAN TO
IMPLEMENT AND ENFORCE CHAPTER 893 OF THE FLORIDA
STATUTES, PERTAINING TO THE SALE, MANUFACTURE,
DISTRIBUTION OR DELIVERY (OR THE POSSESSION WITH INTENT
TO DO SO) OF ILLEGAL CONTROLLED SUBSTANCES, TO THE
FULLEST EXTENT PERMITTED BY LAW, IN PARTICULAR WITH,
REGARD TO NARCOTICS OFFENSES COMMITTED IN STATUTORILY
PROSCRIBED LOCATIONS FOR WHICH THE LEGISLATURE HAS
ESTABLISHED ENHANCED PENALTIES, SUCH AS INCREASED
OFFENSE LEVEL CLASSIFICATION AND/OR MINIMUM MANDATORY
PERIODS OF INCARCERATION, INCLUDING, BUT NOT LIMITED TO,
THOSE OFFENSES OCCURRING WITHIN 1,000 FEET OF A SCHOOL,
PARK, COMMUNITY CENTER OR PLACE OF WORSHIP.
WHEREAS, the City of Miami Beach is committed to the safety and well-being of its
residents, visitors, and businesses; and
WHEREAS, the illegal sale, manufacture, distribution, or delivery (or possession with
intent to do so) of controlled substances poses a significant threat to the public health, safety,
and welfare; and
WHEREAS, Chapter 893 of the Florida Statutes provides essential guidelines and
regulations for combating the illicit drug trade within the State of Florida; and
WHEREAS, the Legislature has established enhanced penalties (including increased
offense level classification and minimum mandatory periods of incarceration)for drug offenses
committed in 'statutorily proscribed locations, including within 1,000 feet of a school, park,
community center, or place of worship; and
WHEREAS, it is imperative for the City and its Police Department to take proactive
measures to address drug-related crimes and ensure strict enforcement of Chapter 893 of the
Florida Statutes within its jurisdiction; and
WHEREAS, the Police Department shall prioritize efforts to combat the sale,
manufacture, distribution, or delivery (or possession with intent to do so) of illegal controlled
substances within the City; and
WHEREAS, the Police Department shall focus particular attention on offenses
committed in statutorily proscribed locations, as outlined in Chapter 893 of the Florida Statutes,
including, but not limited to, areas within 1,000 feet of a school, park, community center, or
place of worship; and
WHEREAS, the Police Department shall coordinate with relevant law enforcement
agencies and community stakeholders, to include its long-time partnership with the Miami-
Dade State Attorney's Office, in order to enhance strategies for identifying, investigating, and
prosecuting individuals involved in drug-related offenses; and,
WHEREAS, the City Manager and Chief of Police are hereby authorized and directed
to take all necessary actions to effectively implement this Resolution.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and the City
hereby direct the Miami Beach Police Department to formulate a comprehensive plan to
implement and enforce Chapter 893 of the Florida Statutes, pertaining to the sale, manufacture,
distribution or. delivery (or the possession with intent to do so) of illegal controlled substances,
to the fullest extent permitted by law, in particular with regard to narcotics offenses committed
in statutorily proscribed locations for which the Legislature has established enhanced penalties,
such as increased offense level classification and/or minimum mandatory periods of
incarceration, including, but not limited to, those offenses occurring within 1,000 feet of a
school, park, community center or place of worship.
