1. A summary of the proposed Ordinance and its purpose is more fully set forth in the

2. The City of Miami Beach estimates that the proposed Ordinance will have no direct
economic impact on private, for-profit businesses in the City of Miami Beach, that the

which businesses will be financially responsible, and that the proposed Ordinance will
impact the City of Miami Beach's regulatory costs in the amount of $269,953.77 and will

At the request of the sponsors, Commissioner Tanya K. Bhatt and Commissioner David
Suarez, this proposed ordinance is presented to the Mayor and City Commission for your
consideration on first reading.
Public piers and other facilities may be maintained by the city for the purpose of loading
and unloading passengers, supplies and boating gear and for similar purposes. It is the
policy of the city to maintain such facilities in a manner that will permit the greatest public
use and avoid continuous occupancy, congestion or blocking of the facility.
City Code Sec. 66-107 ("Maintenance of public piers") currently prohibits docking any
vessel at any public pier or other facility for a period of more than 20 minutes. However,
persons that utilize a dinghy or tender to travel between a vessel temporarily anchored or
otherwise moored in Biscayne Bay and Maurice Gibb Park may need to dock to conduct
activities such as grocery shopping, doctors' visits, and engage in other activities.
The proposed ordinance amends Sec. 66-107, by adding subsection (b), which provides
that the City Administration shall, solely in its proprietary capacity as the operator of the
dock at Maurice Gibb Park, create a Dinghy and Tender Dockage Agreement that will
allow for extended dockage for small dinghies and tenders issued only to those owners

who the City Administration, in its sole discretion, deems qualified, on a form which terms
and conditions shall be approved by the City Commission by resolution prior to
implementation.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. That Section 66.107, of the Code of the City of Miami Beach is/are hereby
amended as follows:

Sec.66-107 - Maintenance of public piers
(a) Public piers and other facilities may be maintained by the city for the purpose of loading
and unloading passengers, supplies and boating gear and for similar purposes. It is the
policy of the city to maintain such facilities in a manner that Will permit the greatest public
use and avoid continuous occupancy, congestion or blocking thereof. Where necessary
to achieve public use and avoid extended occupancy, congestion or blocking thereof, the
city manager is authorized and directed to post signs limiting the time during which a
vessel may be docked or supplies or gear may be placed at or on any such pier or facility
to 20 minutes. A person shall not dock a vessel at any such facility for a period of time
longer than 20 minutes, or permit any public pier or such other supplies or gear to remain
for a period of time longer than 20 minutes.
(b) Notwithstanding the 20 minute time limitation set forth in subsection (a), a person may
dock a dinghy or tender at the city pier at Maurice Gibb Park, which the city owns and
operates solely in its proprietary capacity, for a longer period if the dinghy or tender
operator enters into a valid Dinghy And Tender Dockage Agreement with the city or
registers as a daily user, which terms shall be formulated and drafted by the city manager
with the approval of the city commission by resolution.
SECTION 2. REP EALER.
All ordinances or parts of ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 3. SEVERA BILITY.
If any section, sentence, clause or phrase of this ordinance is held to be invalid or
unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the
validity of the remaining portions of this ordinance.
SECTION 4. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is
hereby ordained that the provisions of this ordinance shall become and be made a part of the
Code of the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or
re-lettered to accomplish such intention, and the word" ordinance" may be changed to" section,"
article," or other appropriate word.

SECTION 5. EFFECTIVE DATE.
This Ordinance shall take effect on the day of , 2024.

Dockmaster or Dockmasters to work at the City pier at Maurice Gibb Park for a daily schedule of
8 AM. to 8 P.M., at a total estimated cost of $269,953.77 for the first year, which shall be expected
to be recouped by the City by dockage and access fees paid by Agreement signatories; and

W H E R E A S , the Mayor and City Commission wish to waive by 517th vote, the requirement
in Section 2-14(d)(1)(a) of the City Code to refer any agenda items In excess of $75,000 to the
Finance and Economic Resfliency Committee.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that:
The Mayor and the City Commission hereby authorize the City Manager to enter into
Dinghy And Tender Dockage Agreements for extended dockage of dinghies and tenders at the
City pier at Maurice Gibb Park as the City Manager may deem appropriate in her sole discretion
with City Commission approval of the final form agreement; providing suggested terms and
conditions to be included in the Dinghy And,Tender Dockage Agreements; providing for approval
of the form agreement by resolution of th~ City Com mission .prior to execution; providing for the
employment of a dockmaster at the City pier at Maurice Gibb Park, at an estimated cost of
$269,953.77 for the first year, to enforce the terr~s of the agreements; and further, waiving, by
5/7th vote, the requirement in section 2-14(d)(1)(a) ~f the City Code to refer any agenda items in

termination of the Dinghy and Tender Dockage Agreem ent and in criminal prosecution.
17. Major repairs and refitting of vessels or associated equipment in Biscayne Bay or any
waterway is prohibited.
18. Charcoal, wood, or open flame burners (cooking stoves to be UL approved) on
dinghy/tender and associated larger vessel are prohibited;
19. Fueling of on dinghy/tender and associated larger vessel in Biscayne Bay or on any
waterway is prohibited. <
20. Disorderly, rowdy, or boisterous conduct and ex~essiv~ noise that disrupts the quiet

break up oil spills is strictly prohibited.
26. Cleaning or washing vessels with detergents containing phosphates, chlorine, or
' < : · petroleum distillates is prohibited.
27. As part of th~ Dinghy,and Tender Dockage Agreement, signatories must grant consent
such that in the event of an emergency, the City has the authority to have necessary
repairs made to the dinghy/tender and associated larger vessel. Em ergencies include, but
are not limited to, tropical storms and hurricanes; breakdown of a bilge, fuel, or sewage
pump or any other leak; chafed or broken lines, or any other emergency that may imperil
the vessel and possibly lead to sinking, damage to other vessels on the water, or damage
to Biscayne Bay. The cost of these repairs, parts, labor or any other appropriate charges,
will be billed to the vessel's owner and must be payable within 24 hours of the owner's
return or as provided by the City.
