MIAMI BEACH CITY CODE CHAPTER 15B ENTITLED
"HEALTH ADVISORY BOARD" BY CHANGING ITS NAME
TO "HEALTH ADVISORY COMMITTEE", PROVIDING FOR
COMMITTEE REVIEW OF CITY OF MIAMI BEACH
GOVERNMENT'S EMPLOYEE HEALTH-RELATED ISSUES,
PROVIDING FOR ELEVEN (11) MEMBERS TO SERVE ON
THE COMMITTEE; PROVIDING FOR EX OFFICIO
REPRESENTATION FROM THE STATE OF FLORIDA,
DEPARTMENT OF HEALTH AND REHABILITATIVE
SERVICES AND THE HEALTH COUNCIL OF SOUTH
FLORIDA, (AND DELETING POLICE DEPARTMENT FROM
EX OFFICIO MEMBERSHIP) , PROVIDING FOR
APPOINTMENTS TO BE MADE BY THE CITY
COMMISSION, PROVIDING THAT NO MEMBER MAY SERVE
FOR MORE THAN TWO CONSECUTIVE TERMS, AND
REQUIRING THE HEALTH ADVISORY COMMITTEE TO
SUBMIT AN ANNUAL REPORT TO THE CITY
COMMISSION; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEALER, AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, in order to more effectively utilize the advisory
input from individuals serving the City of Miami Beach on a
voluntary basis and so as to better address the health issues of
Miami Beach, it is necessary to amend City Code Chapter 15B for
purposes of changing the Chapter' s name to the Health Advisory
Committee (in lieu of Board) , expanding and redefining the
Committee' s purpose and redefining its composition.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1.
The Miami Beach City Code Chapter 15B entitled "Health
Advisory Board" is hereby amended to read as follows:
Chapter 15B. "Health Advisory Bid Committee".
Section 15B-1. Purpose. There shall be a Health
Advisory Board Committee that will hold regular meetings
to review and advise the Administration and the
Commission e€ regarding all matters that relate to the
efficient and balanced health,— care welfare, and safety
of for the citizens and visitors of Miami Beach.— as well
as all employee health-related issues of the City of
Miami Beach government.
Section 15B-2 . Composition; Appointments; and Term of
Office. The composition of tThe Board Committee shall
consist of the following eleven (11) members: three (3)
members shall be Aadministrators of from each of the
City' s local hospitals71 an one (1) member shall be an
administrator from an ACLFT1 a one (1) member shall be a
representative from the nursing profession,-1 two (2)
members shall represent citizens who are health benefits
providers,—; two (2) members shall be physicians; and
three (3) two (2) members shall be consumers consisting
of one (1) individual from the corporate level and one
(1) private individual . There shall be one ex officio
representatives from each of the following: Social
Services Department the State of Florida, Department of
Health and Rehabilitative Services, the Health Council of
South Florida, a representative from the Police
Department, and a representative from the Fire Rescue
Department. These Committee appointments shall be made
by the City Commission upon recommendations of the City
Manager; the appointments shall be for a period not to
exceed of two (2) years. No member may serve more than
two consecutive terms. The Committee shall present to
the City Commission an annual report outlining issues
addressed by the Health Advisory Committee and actions
taken.
SECTION 2 . REPEALER
All ordinances or parts of ordinances in conflict herewith be
and the same are hereby repealed.
SECTION 3 . SEVERABILITY
If any section, sentence, clause or phrase of this ordinance
is held to be invalid or unconstitutional by any court of competent

jurisdiction, then said holding shall in no way affect the validity
of the remaining portions of this ordinance.
SECTION 4 . EFFECTIVE DATE
This ordinance shall take effect ten (10) days after its
adoption, on January 29 , 199 4 .

SUBJECT: AN ORDINANCE CLARIFYING THE ROLE AND MEMBERSHIP OF
THE HEALTH ADVISORY COMMITTEE (FORMERLY THE HEALTH
ADVISORY BOARD)
ADMINISTRATION RECOMMENDATION:
To adopt the attached Ordinance, following the Second Reading, which amends Miami
Beach City Code Chapter 15B entitled "Health Advisory Board", in order to allow for the
change of name, to clarify its purpose, modify its composition, requiring an annual report,
and establish terms of office. The First Reading on this Ordinance was held on January 5,
1994.
BACKGROUND:
The Health Advisory Board was established in 1984 to advise the Administration and the
City Commission on matters that relate to the physical and mental health needs of the
citizens of Miami Beach. Due to the current composition of this Board, it is often difficult
to obtain a quorum. Further, the Administration believes that it is important that the
Board's role be re-defined to allow review and advice regarding all matters that related to
the efficient and balanced health care for the citizens and visitors of Miami Beach as well
as all employee health-related issues of the City of Miami Beach Government. Given the
potential for systematic health reforms as well as complex competitive factors currently
underway with Miami Beach health care providers, the need for review and advise is clear.
ANALYSIS:
The proposed Ordinance amends Chapter 15B of the City Code of Ordinances, in order to
change the name to the Health Advisory Committee (in lieu of Board); expand and redefine
the purpose as defined above; modify the composition and terms of office; and require an
annual report to the City Commission detailing issues addressed and actions taken.
On January 5, 1994, this Ordinance was modified to expand the membership to eleven (11)
versus nine (9) members, and changing the appointment process.
CONCLUSION:
The Administration recommends the adoption of the attached Ordinance amending Chapter
15B entitled Health Advisory Board. 6

The following economic analysis of the proposed legislation to
amend Miami Beach City Code Chapter 15B, clarifying the role and
membership of the Health Advisory Committee is being submitted
pursuant to the requirements of Resolution No. 92-20659 approved
November 20, 1992 :
1. The economic impact of the proposed legislation on the City' s
budget.
None.
2 . The economic impact of the proposed legislation on the private
sector.
The proposed clarification of the role and membership of the
Health Advisory Committee will afford greater opportunities
for private sector input and recommendation for the future
development of health care industry in our community.
3 . The effect of the proposed legislation on public or private
employment.
None.
4 . The costs and benefits, both direct and indirect, of
establishing and maintaining the program set forth in the
proposed legislation.
There are no additional costs to be incurred by the City.
The proposed changes will ensure that the City Commission
receive input and recommendation from a balanced committee
representing various groups (providers and users) within the
health care industry.
5. Whether the proposed legislation is necessary to enable the
City to obtain local, state or federal grants or other
financing.
No.
6. Any other concerns the Administration deems necessary to
advise the Commission of, in order to fully appreciate the
economic effects of the proposed legislation.
