GRANT FUNDED TRAINING PROGRAM CONTRACT
This AGREEMENT ("Agreement") is made this 13,th day ot,\OOr•t..v ,20 between the Anti-
Defamation League(ADL), a not-for-profit corporation having its principal plWce o f business at 605 Third
Avenue, 9i6 Floor, New York, N.Y., 10158 with an office at 5295 Town Center Road, Suite 300,Boca
Raton, Florida; the City of Miami Beach, a Florida municipal corporation with offices located at 1700
Convention Center Drive, Miami Beach, FL 33139 (CMB); North Bay Village, a Florida municipal
corporation with offices located at 1666 Kennedy Causeway, North Bay Village, FL 33141 (NBV); and
The School Board of Miami-Dade County, Florida, with offices located at 1450 NE 2nd Avenue, Miami,
FL 33132 (the District).
WHEREAS,NBV,CMB,and the District desire that ADL shall conduct anti-bullying programs,and ADL
desires to provide the required services to NBV, CMB,and the District;and
WHEREAS,the parties desire to establish the terms and conditions by which ADL will provide said
services.
NOW THEREFORE,in consideration ofthe mutual promises and obligations contained herein,the parties
agree as follows:
(I l ADL agrees to conduct eight(8)anti-bullying workshops on dates and times specified by the City
of Miami Beach as coordinated with each appointed school liaison during the 2023-2024 school
year at each ofthe following schools(See Exhibit A):
• Miami Beach Senior High School
• Miami Beach Nautilus Middle School
• Mimi Beach South Pointe Elementary School
• North Beach Elementary School
• Biscayne Beach Elementary School
• Miami Beach Fienherg Fisher K-8 Center
• Ruth K Broad Bay Harbor K-8 (subject to the provisions in Paragraph 2 of this
Agreement)
• Treasure Island Elementary School(subject to the provisions in Paragraph 4 ofthis
Agreement)
(2) A minimum of 1.5 participants and a maximum of 30 participants are required to attend the
workshop. CMB,NBV,and Ruth K Broad Bay Harbor K-8 Center's principal,respectively,agree
to notify ADL at least thirty(30)business days in advance of the training session if CMB or NBV
expect participation to fall below minimum. In such event, ADL shall have the right to cancel or
postpone the session until another date can be mutually agreed upon. In the event that the District
cancels (without rescheduling) less than thirty days before the date of a scheduled workshop, the
District will be responsible to ADL for 100%ofthe fee that ADL would have paid the facilitators)
• for that particular training date. The total training fee for the program(s) described herein will cost
$10,500.00,of which CMB has agreed to pay$8,250.00,NBV has agreed to pay $750.00, subject
to the provisions in Paragraph 4 of this Agreement, the District's Ruth K Broad Bay Harbor K-8
Center has agreed to pay $1,500 subject to the provisions in Paragraph 4 of this Agreement, and
ADL has agreed to pay $1,500. ADL will provide the supplies, as more particularly described in
Exhibit B.
(3) CMB agrees to fund 100%ofthe total cost lbr live (5) anti-bullying workshops for registered "No

Place For Hate"schools and 50%of the cost for one(1)school.Notwithstanding any other term
• in this Agreement,the total cost to CMB for ADL's services under this Agreement shall not
exceed $8,250.00 ("CMB's Contribution"). CMB's Contribution includes facilitator fees and
travel,as well as all participant.materials.
• (4) Subject to any and all required budgetary appropriations by the NBV Village Commission,NBV
agrees to fund 50%of the total cost for one(1)anti-bullying workshop for a registered"No Place
For Hate"school.The total cost to NBV for the ADL's services under this Agreement is$750.00.
This includes facilitator fees and travel,as well as participant materials
Subject to any and all required budgetary appropriations by the District, the District's Ruth K.
Broad Bay Harbor K-8 Center principal agrees to fund 100%of the cost for one(1)anti-bullying
workshop for a registered"No Place For Hate" school.The total cost to The District's Ruth K.
Broad Bay Harbor K-8 Center principal for the ADL's services under this Agreement is$1,500.00.
This includes facilitator fees and travel,as well as participant materials.
(5) For in-person workshops CMB,NBV,and the District will provide adequate crowd control and
adequate security and obey all fire precautions as required by law or local ordinances.
(6) (a) Either CMB,NBV,the District,or the ADL shall have the right to
terminate this Agreement upon(14)days prior written notice to the other
party. Should either CMB,NBV,or the District erect to terminate pursuant
to this Paragraph 6(a),such termination shall only apply to the terminating
party's obligations under this Agreement.
(b) ADL shall have the right to terminate this Agreement immediately,without notice,
for any of the following reasons:
(i) A breach by CMB,NBV,or the District of any material term or condition
of this Agreement including,but not limited to,the inability of CMB,
NBV,or the District to provide in a timely fashion any of its obligations
outlined in this Agreement;
(ii) CMB or NBV has assigned this Agreement without first receiving ADL's prior written
consent.
(7) ADL hereby agrees to hold harmless,defend and indemnify the District,CMB and NBV and their
affiliates, their directors, officers, employees, agents and representatives from and against all
damages,expenses,cause of action,suits,claims,penalties,judgments and/or liabilities by reason
of any act or commission or omission directly or indirectly attributable to any of ADL's
undertakings and obligations arising under this Agreement.
District, CMB and NBV hereby agree to hold harmless, defend and indemnify ADL and its
affiliates,directors,officers,employees,agents and representatives from and against all damages,
expenses,cause of action,suits,claims,penalties,judgments and/or liabilities by reason of any act
or commission or omission directly or indirectly attributable to any of District, CMB and NBV's
undertakings and obligations arising under this Agreement.
(8) CMB,NBV,and the District agree that all material used in conjunction with the Training program
is proprietary to ADL. As such,these materials may not be reproduced, translated,abbreviated,

abridged, excerpted or in any way altered without written consent of ADL.
(9) Nothing in this Agreement shall be construed to place ADL, CMI3, NBV, and the District in the
relationship ofa partnership or a joint venture,and neither ADL, CMB,NBV,nor the District shall have any
power to obligate or bind the other party in any manner whatsoever.
(10) On termination ofthis Agreement,regardless ofhow termination is effected,or whenever requested
by ADL, CMB, NBV, and/or the District shall immediately return to ADL all copies of ADL's property,
and cease using the ADL name.
(11) Any publicity or promotional materials, including but not limited to press releases and
advertisements,produced by CMB,NBV,or the District for or in conjunction with the t workshop program,
must be reviewed and approved in writing by ADL prior to publication. Any photography or videotaping
takes place independently of this contract with appropriate ADL releases and assignments.
(12) This Agreement contains the entire understanding between the parties and supersedes any prior oral
or written agreement between the parties. No amendment or modification of this Agreement shall be valid,
unless made in writing and signed by both parties.
In the event of any inconsistency between the provisions of this Agreement and the provisions of any
exhibits or other agreements between the parties relating to the services provided for in this Agreement,
the provisions ofthis Agreement shall prevail.
(13) This Agreement shalt be construed in accordance with, be governed by and be subject to the
jurisdiction ofthe laws and courts of the State of Florida,venue being in Miami-Dade County.
(14) Any notice or document required hereunder shall be sent to,the Florida Regional Office Education
Director, Anti-Defamation League. Any notice or document sent to CMB should be sent to Dr.Leslie
Rosenfeld, Chief Education Officer, City of Miami Beach. Any notice or document sent to NBV
should be sent to Frank Rollason, Village Manager. Any notice or document sent to the District should
be sent to Aillette Rodriguez-Diaz, Director, Miami-Dade County Public Schools. Any notice sent by
mail shall be deemed received five (5) business days after mailing. Any notice personally delivered shall
he deemed received when delivered.
(15) All parties understand and agree that they arc subject to all District policies relating to the
confidentiality of student information. Parties acknowledge and agree to comply with the Family
Educational Rights and Privacy Act("FERP A")and all state and federal laws relating to the confidentiality
o f student records.
(16) The parties agree that each ofits employees,or representatives who has direct contact with students,
must comply with the requirements ofJessica Lunsferd Act, 1012.465 F.S.
(17) Parties understand the broad nature of Florida's Access to Record/Public Record Laws, and agree
to comply with Florida's Public Records Laws and laws relating to records retention. The parties shall keep
and maintain public records required to perform the contract. The parties shall keep records to show its
compliance with program requirements. The parties and any subcontractors must make available, upon
request of any other party, a Federal grantor agency, the Comptroller General of the United States, or any
of their duly authorized representatives,any books,doctunents,papers,and records ofthe parties which are
directly pertinent to this specific Contract for the purpose of making audit, examination, excerpts, and

transcriptions. Upon request from the any patty's custodian of public records, provide a copy of the
requested records or allow the records to be inspected or copied within a reasonable time at a cost that does

not exceed the cost provided in chapter 119 or as otherwise provided by law. The parties shall ensure that
public records that are exempt or confidential and exempt from public records disclosure requirements are
not disclosed except as authorized by law for the duration of the contract term and following completion of
the contract if the parties do not transfer the records to the public agencies. The parties shall retain all
records for five(5)years after final payment is made or received and all pending matters are completed
pursuant to Title 34,Sections 80.36(b)(1).Upon completion of the contract,transfer at no cost to the public
agencies all public records in possession of the parties or keep and maintain public records required by the
parties to perform the service. If the parties transfer all public records to the public agencies upon
completion of the contract, the parties shall destroy any duplicate public records that are exempt or
confidential and exempt from public records disclosure requirements. If the parties keep and maintain
public records upon completion of the contract, the parties shall meet all applicable requirements for
retaining public records.All records stored electronically must be provided to the requesting party, in a
format that is compatible with the information technology systems of the School Board.

(18) City of Miami Beach Inspector General Audit Rights:
For the purposes of this Section 18,"City"shall mean the City of Miami Beach and"Grantee"shall mean
the Anti-Defamation League
A. Pursuant to Section 2-256 of the Code of the City of Miami Beach,the City has established the
Office of the Inspector General which may, on a random basis, perform reviews, audits, inspections and
investigations on all City contracts,throughout the duration of said contracts. This random audit is separate
and distinct from any other audit performed by or on behalf of the City.
B. The Office of the Inspector General is authorized to investigate City affairs and empowered to
review past,present and proposed City programs,accounts,records,contracts and transactions.In addition,
the Inspector General has the power to subpoena witnesses, administer oaths,require the production of
witnesses and monitor City projects and programs.Monitoring of an existing City project or program may
include a report concerning whether the project is on time, within budget and in conformance with the
contract documents and applicable law.The Inspector General shall have the power to audit, investigate,
monitor,oversee,inspect and review operations,activities,performance and procurement process including
but not limited to project design,bid specifications,(bid/proposal)submittals,activities of the Grantee,its
officers, agents and employees, lobbyists, City staff and elected officials to ensure compliance with the
contract documents and to detect fraud and corruption. Pursuant to Section 2-378 of the City Code, the
City is allocating a percentage of its overall annual contract expenditures to fund the activities and
operations of the Office of Inspector General.
C. Upon ten(10)days written notice to the Grantee,the Grantee shall make all requested records
and documents available to the Inspector General for inspection and copying.The Inspector General is

empowered to retain the services of independent private sector auditors to audit, investigate, monitor,
oversee, inspect and review operations activities,performance and procurement process including but not
limited to project design,bid specifications,(bid/proposal)submittals,activities of the Grantee,its officers,
agents and employees, lobbyists, City staff and elected officials to ensure compliance with the contract
documents and to detect fraud and corruption.
D. The Inspector General shall have the right to inspect and copy all documents and records in the
Grantee's possession, custody or control which in the Inspector General's sole judgment, pertain to
performance of the contract,including,but not limited to original estimate files,change order estimate files,
worksheets,proposals and agreements from and with successful subcontractors and suppliers,all project-
related correspondence, memoranda, instructions, financial documents, construction documents,
(bid/proposal)and contract documents,back-change documents, all documents and records which involve
cash,trade or volume discounts,insurance proceeds,rebates,or dividends received,payroll and personnel
records and supporting documentation for the aforesaid documents and records.
E. The Grantee shall make available at its office at all reasonable times the records,materials,and
other evidence regarding the acquisition (bid preparation) and performance of this contract, for
examination,audit,or reproduction,until three(3)years after final payment under this contract or for any
longer period required by statute or by other clauses of this contract.In addition:
i. If this contract is completely or partially terminated, the Grantee shall make available
records relating to the work terminated until three (3) years after any resulting final
termination settlement;and
ii, The Grantee shall make available records relating to appeals or to litigation or the
settlement of claims arising under or relating to this contract until such appeals,litigation,
or claims are finally resolved.
F. The provisions in this section shall apply to the Grantee, its officers, agents, employees,
subcontractors and suppliers.The Grantee shall incorporate the provisions in this section in all subcontracts
and all other agreements executed by the Grantee in connection with the performance of this contract.
G. Nothing in this section shall impair any independent right to the City to conduct audits or
investigative activities.The provisions of this section are neither intended nor shall they be construed to
impose any liability on the City by the Grantee or third parties.

ADL Anti-Bullying Workshop
Sample Agenda with Activity Rationales
Workshop Opening(Introduction of Facilitators,of ADL,)provides useful information on the
program, its goals and basic premises,and how program content is linked to organizational goals
and current research. The information provided in this part of the agenda establishes a strong
foundation for the subsequent training components.
2. Workshop Ground Rules are generated by the group;engage participants in the training process
by involving them in establishing guidelines for their interactions with one another.
3. Jniroductoy Ice-Breaker are designed to build trust,cooperation and a sense of comfort in
participants.
4. Examining Bullying activities enable participants to increase their understanding of how bullying
manifests,both historically and within their own daily environments.This awareness is a
necessary precursor to subsequent components that provide opportunities to develop and practice
response strategics to bullying incidents.
5. Challenging Bullying activities provide opportunities to develop a repertoire of responses to
challenge bullying incidents.These activities clarify the different roles people take in bullying
incidents and build skills to be effective allies to others who are targets of bullying.
6. Action Planning Exercise activities enable participants to extend their learning through the
development of specific action plans to accomplish personal and school-wide goals.Because this
process requires time to reflect,brainstorm and plan,this training component is designed to assist
participants in beginning this process by providing tools and suggested methods for follow-up
planning.
7. Closing—Workshop Evaluation activities provide an opportunity to reflect on the days
learning. Because participants require commitment to actively engage in implementing action
1 plans,these activities are designed to inspire,motivate and provide closure to the program.
Evaluation further assists participants in reflecting on the day and provides ADL staff with useful
information on participants'perceptions of the program.
Not every agenda will include all of these workshop components.The specific workshop exercises and
resources selected within each component will vary from agenda to agenda,depending on the client's
workshop goals and identified organizational needs.
The following sample agenda demonstrates the thematic sequence and includes activities that might be
selected in response to a hypothetical needs assessment of a client organization.The notes that follow
each agenda item are for instructional purposes to clarify why specific activities were selected;these
notes would not be included in an actual program agenda.

WHEREAS, at the November 15, 2016 Committee for Quality Education meeting, a
motion was made to encourage the City to implement the Anti-Defamation League's ("ADL") No
Place for Hate program in Miami Beach; and
WHEREAS, the City's Education Compact with Miami-Dade Public Schools ("M-DCPS"),
reflects the community's desires to provide a safe learning environment for all students, support
excellence in the City's public schools, and enhance the health and well-being of our City's
youth; and
WHEREAS, the City's Education Compact with M-DCPS supports the eradication of
bullying and harassment in the public schools and throughout the community by providing
awareness, bullying prevention activities, and education in promoting a school atmosphere in
which bullying, harassment, and intimidation are not tolerated by students, school board
employees, visitors, or volunteers; and
WHEREAS, the City previously partnered with the ADL and M-DCPS to implement the
No Place for Hate program during the 2013-14 school year; and
WHEREAS, during that school year, all public schools in Miami Beach successfully
obtained the No Place for Hate designation and, as a result, the City of Miami Beach earned the
Community of Respect designation; and
WHEREAS, through the generosity of the Harriet and Jack Rosenfeld Foundation, the
ADL has committed to subsidizing the cost of anti-bullying/cyberbullying training activities in the
amount of$600 per program (which is fifty percent of the cost of each program) for the 2017-18
school year and each school year thereafter for Miami Beach Senior High, Nautilus Middle,
South Pointe Elementary, North Beach Elementary, and Biscayne Elementary Schools, as well
as Fienberg-Fisher K-8 Center, for either 30 students or 35 faculty/staff members per program;
and
WHEREAS, the anticipated annual cost to the City to provide the ADL No Place for Hate
program, including the cost of banners, is $3,750; and
WHEREAS, M-DCPS supports and encourages the designation of public schools as "No
Place for Hate" schools; and

WHEREAS, City staff will contact and encourage neighboring municipalities to join the
City in this effort and request that they fund their proportionate share of the implementation of
the No Place for Hate program in schools within their city limits (i.e. Treasure Island Elementary
and Ruth K. Broad Bay Harbor K-8 Center); and
WHEREAS, the City of Miami Beach will earn the ADL's prestigious Community of
Respect designation by implementing one annual community-wide event that raises awareness
and/or addresses bullying prevention, diversity, and respect for all at a City-owned facility (the
"Event"); and
WHEREAS, the ADL will also recognize the City's neighboring municipalities (including
Surfside, Bal Harbour, Bay Harbor Islands, and North Bay Village) if these municipalities elect to
participate in the program; and
WHEREAS, the goal of the Event is to bring together residents of Miami Beach to
support students, teachers, educators, and parents in creating a safe, peaceful, and respectful
community; and
WHEREAS, staff from M-DCPS Division of Student Services will be present at the Event
to provide support and information regarding bullying and violence prevention efforts being
implemented throughout our school district.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission hereby authorize the City Manager to partner with Miami-Dade County Public
Schools and the Anti-Defamation League to implement a Citywide anti-bullying program entitled
"No Place for Hate,"which shall commence at the start of the 2017-18 school year and continue
each year thereafter (subject to future budgetary appropriations by the City Commission), at a
total cost to the City not to exceed $3,750 for the first year, which funds shall be appropriated
from the City's Education Compact fund.

SUBJECT: A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO PARTNER
WITH MIAMI-DADE COUNTY PUBLIC SCHOOLS AND THE ANTI-DEFAMATION
LEAGUE TO IMPLEMENT A CITYWIDE ANTI-BULLYING PROGRAM ENTITLED
"NO PLACE FOR HATE," WHICH SHALL COMMENCE AT THE START OF THE
2017-18 SCHOOL YEAR AND CONTINUE EACH YEAR THEREAFTER(SUBJECT

COST TO THE CITY NOT TO EXCEED $3,750 FOR THE FIRST YEAR, WHICH

RECOMMENDATION
The Administration recommends the approval of this Resolution. This approval will assist the
Department in accomplishing its measurable objectives linked to the City's Key Intended Outcome of
Achieve Educational(K-12) Excellence.
ANALYSIS
•
At the November 15, 2016 Committee for Quality Education meeting, the following motion was
made in support of the implementation of the Anti-Defamation League (ADL)No Place for Hate
program:
•
The Committee for Quality Education requests the Miami Beach Mayor and Commission
fund up to $3,750 annually to implement in its public schools the No Place for Hate
program of the Anti-Defamation League Florida region, beginning in the 2017-18 school
year with the Anti-Defamation League subsidizing 50%of training costs.
The City had partnered with the ADL and Miami-Dade County Public Schools (M-DCPS) to
implement the program during the 2013-14 school year. All schools obtained the No Place for
Hate designation for that school year and the City of Miami Beach earned the Community of
Respect designation. The motion supports the City of Miami Beach Education Compact
outcome to Enhance Learning Opportunities for Youth. The Education Compact, implemented
in January 2008, reflects the desire of the Miami Beach community to support excellence in the
City's public schools and enhance the health and well-being of our City's youth.

The City's Education Compact with M-DCPS supports the eradication of bullying and
harassment in its public schools and community by providing awareness, prevention and
education in promoting a school atmosphere in which bullying, harassment, and intimidation are
not tolerated by students, school board employees, visitors, or volunteers. M-DCPS supports
public schools becoming No Place for Hate®schools.

initiative and encourage community participation.

AMENDMENT NO. 1
TO THE GRANT FUNDED TRAINING PROGRAM CONTRACT
Amendment No. 1 ("Amendment") to the Grant Funded Training Program Contract,
dated December 1, 2017 (the "Agreement") to implement"A World of Difference"Anti-Bias and
Diversity Training Programs, is made and entered into this day of Fix 1-2 , 20

existing under the laws of the State of Florida, having its principal place of business at 1700
Convention Center Drive, Miami Beach, Florida 33139 ("CMB"); the Anti-Defamation League,
a not-for-profit corporation having its principal place of business at 605 Third Avenue 9'" Floor,
New York, New York 10158 with an office at One Park Place, 621 NW 53`d Street, Suite 450,
Boca Raton, Florida ("ADL"); North Bay Village, a Florida municipal corporation with office
located at 1666 Kennedy Causeway, North Bay Village, Florida 33141 ("NBV"); and The
School Board of Miami-Dade County, Florida, with offices located at 1450 NW 2`1 Avenue,

RECITALS
WHEREAS, on February 8, 2017, the Mayor and City Commission adopted Resolution
No. 2017-29731, authorizing the City Manager to partner with Miami-Dade County Public
Schools and the ADL to implement a citywide anti-bullying program, entitled "No Place for
Hate", commencing at the start of the 2017-2018 school year, at the total cost of$3,750 for the
first year, and thereafter, each year subject to budgetary appropriations by the City Commission,
from the City's Education Compact Fund; and
WHEREAS, pursuant to Resolution No. 2017-29731, CMB, ADL, NBV, and the District
executed the Agreement; and
WHEREAS, the parties wish to continue the program for the 2018-2019 school year,
with CMB paying 100% of the training fee, in the amount of$8,250.00 and NBV paying for 50%
of the cost to designate one(1)"No Place for Hate" school, in the amount of$750.00; and
WHEREAS, CMB's contribution was approved via Resolution No. 2018-30512 on
September 26, 2018 at the commission meeting.
NOW, THEREFORE, in consideration of the mutual conditions and promises contained
herein, the Parties agree to amend the Agreement as follows:
1. ABOVE RECITALS.
The above recitals are true and correct and are incorporated as part of this
Amendment.
2. MODIFICATIONS.
The Agreement is hereby amended (deleted items struck--through and inserted items

(a) Paragraph 2 of the Agreement is hereby deleted in its entirety and replaced
with the following:
(2) A minimum of 15 participants and a maximum of 30 participants are required
to attend the training workshop. CMB. NBV. and Ruth K. Broad Bay Harbor
K-8 Center principal Scott Saperstein, respectively, agree to notify ADL at
least thirty (30) business days in advance of the training session if CMB or
NBV expect participation to fall below the minimum. In such event, ADL shall
have the right to cancel or postpone the session until another date can be
mutually agreed upon. In the event that CMB or NBV cancels (without
rescheduling) less than thirty days before the date of a scheduled workshop,
the party that cancelled the workshop will be responsible to ADL for 100%, of
the fee that ADL would have paid the facilitator(s) for that particular training
date. The total training fee for the program(s) described herein will cost
$10,500.00 of which CMB has agreed to pay $8,250.00 and, subject to the
provisions In Paragraph 4 of this Agreement, NBV has agreed to pay
$750.00, and ADL$1,500. ADL will provide the supplies, as more particularly
described in Exhibit B.
(b) Paragraph 3 of the Agreement is hereby deleted in its entirety and replaced
with the following:
(3) CMB agrees to fund 100% of the total cost to designate five (5)"No Place For
Hate" schools and 50% of the cost for one (1) school. Notwithstanding any
other term in this Agreement, the total cost to CMB for ADL's services
under this Agreement shall not exceed $8,250.00 ("CMB's
Contribution"). CMB's Contribution includes facilitator fees and travel,
participant workbooks, workshop DVD, designation banners and other
materials.for each site.
(c) Paragraph 4 of the Agreement is hereby deleted in its entirety and replaced
with the following:
(4) Subject to any and all required budgetary appropriations by the NBV Village
Commission, NBV agrees to fund 50% of the total cost to designate one (1)
"No Place For Hate" school. The total cost to NBV for the ADL's services
under this Agreement is $750.00. This includes facilitator fees and travel,
participant workbooks, workshop DVD, designation banners and other
materials for the site.
(5) Subject to any and all required budgetary appropriations by the District, the
District's Ruth K. Broad Bay Harbor K-8 Center principal Scott Saperstein
agree to fund 100% of the cost to designate one (1) "No Place For Hate"
school. The total cost to The District's Ruth K. Broad Bay Harbor K-8 Center
principal Scott Saperstein for the ADL's services under this Agreement is
$1,500.00. This includes facilitator fees and travel, participant workbooks,
workshop DVD,designation banners and other materials for the site.

2021, by and among the City of Miami Beach, Florida, a municipal corporation organized and
existing under the laws of the State of Florida, having its principal place of business at 1700
Convention Center Drive, Miami Beach, Florida 33139 ("CMB"); the Anti-Defamation League,
a not-for-profit corporation having its principal place of business at 605 Third Avenue 9' Floor,
New York, New York 10158 with an office at One Park Place, 621 NW 53rd Street, Suite 450,
Boca Raton, Florida ("ADL"); North Bay Village, a Florida municipal corporation with its office
located at 1666 Kennedy Causeway, North Bay Village, Florida 33141 ("NBV"); and The School
Board of Miami-Dade County, Florida, with its offices located at 1450 NW 2nd Avenue, Miami,
Florida 33132 (the "District"), each individually referred to herein as a "party" or collectively as
"parties".
RECITALS
WHEREAS, on February 8, 2017, the Mayor and City Commission adopted Resolution
No.2017-29731,authorizing the City Manager to partner with Miami-Dade County Public Schools
and the ADL to implement a citywide anti-bullying program, entitled "No Place for Hate",
commencing at the start of the 2017-2018 school year, at the total cost of$3,750 for the first year,
and thereafter, each year subject to budgetary appropriations by the City Commission, from the
City's Education Compact Fund; and
WHEREAS, pursuant to Resolution No. 2017-29731, CMB, ADL, NBV, and the District
executed the Agreement providing the Program at the CMB public schools, Ruth K. Broad / Bay
Harbor K-8 Center, located in Bay Harbor Islands, and Treasure Island Elementary, located in
North Bay Village; and
WHEREAS, on February 28, 2019, the parties executed Amendment No. 1 to continue
the Training Program for the 2018-2019 school year; and
WHEREAS, on May 28, 2019, the parties executed Amendment No. 2 to continue the
Training Program for the 2019-2020 school year; and
WHEREAS, on October 22, 2020, the parties executed Amendment No. 3 to continue the
Training Program for the 2020-2021 school year; and
WHEREAS, the parties wish to continue the program for the 2021-2022 school year, with
CMB paying 100% of the training fee, in the amount of$8,250, and NBV paying 50% of the cost
to designate one (1)"No Place for Hate" school, in an amount of$750.00.

NOW, THEREFORE, in consideration of the mutual conditions and promises contained
herein, the Parties agree to amend the Agreement as follows:
1. ABOVE RECITALS.
The above recitals are true and correct and are incorporated as part of this
Amendment.
2. MODIFICATIONS.
The term of this Agreement is hereby extended through the 2021-2022 school year.
3. RATIFICATION.
Except as amended herein, all other terms and conditions of the Agreement shall
remain in full force and effect. In the event there is a conflict between the provisions of
this Amendment and the Agreement, the provisions of this Amendment shall govern.

On Feb 8,2017,the City Commission awarded$3,750 to the ADL,on September 26,2018 via Reso 2018-30512 the amount
was increased to$8,250,and on Feb 28,2019,Amend.No 1 added Ruth K Broad funded by the ADL. Yearly,the City
processes an amendment to the ADL agreement to continue the services for the current school year.This Amendment No.6
to the Grant Funded Training Program Contract allows for the Anti-Defamation League(ADL)to continue implementing the
citywide anti-bullying program"No Place for Hate." This partnership began when at the Nov.15,2016 Committee for
Quality Ed.meeting,a motion was made to encourage the City to implement the ADL's No Place for Hate program in Miami
Beach. The City's Education Compact with MDCPS(signed in 2008)reflects the community's desire to provide a safe
learning environment for all students.This is the 7th year of partnership w/ADL under Reso 2017-29731 and 2018-30512,
which authorizes the City Manager to implement a citywide anti-bullying program and allows for partnership each year.
Amend.No.1(attached here)modified the agreement to include Ruth K Broad with the ADL contributing$1,500.Per Reso
2018-30512, CMB will fund the total cost to designate 6"No Place For Hate"schools not to exceed$8,250 (CMB
