A RESOLUTION OF THE MAYOR AND CITY COMMISSION OFJTHE CITY OF
MIAMI BEACH, FLORIDA, DIRECTING THE ADMINISTRATION TO INSTALL A
RAILING ALONG THE WEST END OF LINCOLN ROAD AND STREET ENDS
AT 10TH AND 14TH STREETS TO PREVENT UNAUTHORIZED DOCKING
ACCESS FROM THE PUBLIC SEAWALL.
WHEREAS, public piers and other facilities may be maintained by the City of Miami Beach
(the "City") for the purpose of loading and unloading passengers, supplies and boating gear and
for similar purposes; and
WHEREAS, it is the policy of the City to maintain such facilities in a manner that will permit
the greatest public use and avoid continuous occupancy, congestion or blocking thereof; and
WHEREAS,.Section 66-107 of the City Code currently prohibits docking any vessel at any
public pier or other facility for a period of more than 20 minutes unless a dinghy/tender operator
enters into an agreement with the City to allow an extended period; and
WHEREAS, the City continuously contends with illegal conduct, noise, litter, derelict
vessels (or vessels in danger of becoming derelict) and a myriad of resident complaints relating
to watercraft; and
WHEREAS, many of these issues relate to the illegal docking of vessels which negatively
impact the City's safety, sanitation, image, and aesthetics, in addition to adversely affecting
neighboring residents' quality of life; and
WHEREAS, enforcement measures such as increased surveillance through the
installation of additional cameras and additional police personnel are too financially burdensome;
and
WHEREAS, installing a physical barrier in the form of a railing along the specified areas
would be a more cost-effective solution to deter illegal docking; and
WHEREAS, the Mayor and City Commission hereby direct the Administration to install a
railing along the west end of Lincoln Road and all street ends at 10th and 14th Streets to prevent
unauthorized docking access from the public seawall.
'NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby direct the Administration to install a railing along the west end of Lincoln Road ,
and street ends at 10th and 14th Streets to prevent unauthorized docking access from the public
seawall.
