A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPOINTING RICARDO J. DOPICO
AS THE CITY ATTORNEY FOR THE CITY OF, MIAMI BEACH, AND
AUTHORIZING THE CHAIR OF THE FINANCE AND ECONOMIC
RESILIENCY COMMITTEE TO NEGOTIATE THE TERMS OF AN
EMPLOYMENT AGREEMENT WITH MR. DOPICO, WHICH
AGREEMENT WILL BE SUBJECT TO FINAL APPROVAL BY THE
MAYOR AND CITY COMMISSION.
WHEREAS, on February 26, 2024, City Attorney Rafael A. Paz submitted a
letter to the Mayor and City Commission advising the Commission of his decision to
step down as City Attorney; and
- WHEREAS, on March 13, 2024, following Mr. Paz's resignation notice, the
City Commission initiated an internal selection process for a permanent City
Attorney; and
WHEREAS, on April 3, 2024, the City Commission unanimously appointed Deputy
City Attorney Ricardo J. Dopico as Acting City Attorney until the expiration of Mr. Paz's
employment agreement on May 3, 2024, following which Mr. Dopico will serve as City
Attorney; and
WHEREAS, the City Commission desires to provide certain benefits and to
establish certain conditions of employment for Ricardo J. Dopico in his capacity as City
Attorney(including the period of time when Mr. Dopico shall serve as Acting City Attorney,
prior to the expiration of Mr. Paz's employment agreement); and
WHEREAS, Mr. Dopico desires to accept the position of City Attorney for the term
of the Employment Agreement.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby appoint Ricardo J. Dopico as the City Attorney for the City of Miami
Beach, and authorize the Chair of the Finance and Economic Resiliency Committee to
negotiate the terms of an Employment Agreement with Mr. Dopico, which Agreement will
be subject to final approval by the Mayor and City Commission.

SUBJECT: DISCUSSION AND TAKE ACTION REGARDING THE SELECTION
PROCESS FOR THE APPOINTMENT OF THE CITYATTORNEY.
RECOMMENDATION
Pursuant to Commission direction, recruitment was completed and is submitted for Commission
consideration.
BACKGROUND/HISTORY
As directed at the March 13, 2024 Commission meeting, the Human Resources department
proceeded with the internal recruitment for the City Attorney position.
The posting for the position was advertised on the City's website on March 14, 2024. The
advertisement closed on March 22, 2024. We received two applications for the position. These
two applicants are Ricardo Dopico, Deputy City Attorney, and Robert Rosenwald, Chief Deputy
City Attorney. The applications and resumes were emailed to the Mayor and City
Commissioners on March 22, 2024, and are attached for your reference.
If a candidate is appointed at the April 3, 2024 City Commission meeting, the appointee would
serve as Acting City Attorney effective immediately, until City Attorney Paz's departure date.
With respect to the proposed employment agreement for the new City Attorney, historically, the
City Commission has delegated to the Chair of the Finance and Economic Resiliency
Committee ("FERC")the task of reviewing each new Charter Officer's proposed compensation
and terms, subject to final approval by the Mayor and City Commission. If the City Commission
desires for Commissioner Magazine, the current FERC Chairperson, to review and negotiate
the proposed employment agreement terms with the new City Attorney, the proposed
agreement would be drafted following such discussions with FERC Chairperson Magazine and
placed on the May 15, 2024 City Commission agenda for final review and approval.
