Resolution 2024-32974 RESOLUTION NO. 2024-32974 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, PROVIDING THAT AMPLIFICATION OF SOUND BY STREET PERFORMERS BE ALLOWED ONLY PURSUANT TO A SPECIAL EVENT PERMIT IN ALL AREAS OF THE CITY, EXCEPT FOR LINCOLN ROAD, OCEAN DRIVE, AND THE BEACHWALK, WHERE AMPLIFICATION SHALL NOT BE ALLOWED TO THE EXTENT PERMITTED BY APPLICABLE LAW. WHEREAS, Article XV of Chapter 18 of the City Code authorizes street performances that include singing and playing of musical instruments; WHEREAS, the use of amplification by some street performers has become disruptive to the experience of sidewalk cafes and businesses in the surrounding areas; WHEREAS, It is imperative to ensure that amplified sound is controlled and regulated effectively to maintain a peaceful and harmonious environment for all residents, visitors, and businesses; WHEREAS, on March 13, 2024, the Commission discussed and resolved to regulate disruptive amplified sound equipment by street performers within the community by requiring that any amplification of sound by street vendors be allowed only pursuant to a special event permit in all areas of the.City, except for Lincoln Road, Ocean Drive, and the Beachwalk where amplification shall not be allowed to the extent permitted by applicable law. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby establish a rule that any amplification of sound by street vendors be allowed only pursuant to a special event permit in all areas of the City, except for Lincoln Road, Ocean Drive, and the Beachwalk, where amplification shall not be allowed to the extent permitted by applicable law. • Ma PASSED and ADOPTED this 8 day � , 2024. • Steven Meiner, Mayor ATTES . I would like to discuss and provide direction to City staff to update the procedures for artist vendors to reduce or eliminate amplified music in a way to strike a balance between supporting artistic expression and maintaining a vibrant and harmonious urban environment for visitors and businesses.
