93-20886 Reso • RESOLUTION NO. 93-20886 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING A PUBLIC HEARING TO CONSIDER ADOPTING AN AMENDMENT TO COMPREHENSIVE ZONING ORDINANCE NO. 89-2665, AMENDING SECTION 7, "PARKING REGULATIONS", AMENDING SUBSECTION 7-1, ENTITLED "PARKING DISTRICTS ESTABLISHED" BY ADDING GENERAL PROVISIONS WHICH ELIMINATE THE REQUIRED PARKING FOR MAIN OR ACCESSORY USES ASSOCIATED WITH EXISTING BUILDINGS LOCATED WITHIN THE MIAMI BEACH ARCHITECTURAL DISTRICT OR A LOCAL HISTORIC DISTRICT; AMENDING SUBSECTION 7-7, ENTITLED "PARKING IMPACT FEE PROGRAM" BY AMENDING THE FEE AND THE PROCESS BY WHICH THE FEE IS ESTABLISHED; CLARIFYING THE PAYMENT FOR THE REMOVAL OF EXISTING PARKING SPACES; AND PROHIBITING THE USE OF THE PARKING IMPACT FEE TO SATISFY MORE THAN 50% OF THE REQUIRED PARKING FOR NEW DEVELOPMENT; PROVIDING FOR INCLUSION IN THE ZONING ORDINANCE; PROVIDING FOR A REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City' s Planning, Design and Historic Preservation Division has recommended amending Comprehensive Zoning Ordinance No. 89-2665, amending Section 7, "Parking Regulations" , amending Subsection 7-1, entitled "Parking Districts Established" by adding general provisions which eliminate the required parking for main or accessory uses associated with existing buildings located within the Miami Beach Architectural District or a local historic district; amending Subsection 7-7, entitled "Parking Impact Fee Program" by amending the fee and the process by which the fee is established, clarifying the payment for the removal of existing parking spaces, •and prohibiting the use of the parking impact fee to satisfy more than 50% of the required parking for new development; and WHEREAS, on August 3 , 1993, the City's Planning Board held a public hearing regarding said amendment, after which the Board voted 4 to 2 in favor of the amendment; and WHEREAS, pursuant to Section 14 of the Zoning Ordinance No. 89-2665, the proposed amendment must now be considered by the City Commission at public hearings. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing to consider an ordinance amending Comprehensive Zoning ordinance No. 89-2665, amending Section 7, "Parking Regulations" , amending Subsection 7-1, entitled "Parking Districts Established" by adding general provisions which eliminate the required parking for main or accessory uses associated with existing buildings located within the Miami Beach Architectural District or a local historic district; amending Subsection 7-7, entitled "Parking Impact Fee Program" by amending the fee and the process by which the fee is established, clarifying the payment for the removal of existing parking spaces, and prohibiting the use of the parking impact fee to satisfy more than 50% of the required parking for new development; providing for inclusion in the Zoning Ordinance; providing for a repealer; providing for severability; and providing for an effective date, is hereby called to be held before the City Commission in its chambers on the Third Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida, on October 6 , 1993 beginning at 5:01 p.m. , and the City Clerk is hereby authorized and directed to publish appropriate Public Notice of the said Public Hearings in a newspaper of general circulation in the City of Miami Beach, at which time and place all interested parties will be heard. Cant" A City Manager if 40 �/�� SUBJECT: AMENDMENT TO ZONING ORDINANCE NO. 89-2665 RELATIVE • TO AMENDING SECTION 7, PARKING REGULATIONS • SETTING OF PUBLIC HEARING ADMINISTRATION RECOMMENDATION The City Administration recommends that the City Commission set a date and time certain for a first reading public hearing on the attached amendments to Zoning Ordinance 89-2665. BACKGROUND . The City Administration is requesting that amendments to the current Zoning Ordinance be_considered, regarding the removal of the parking requirement for existing Buildings within the Architectural District and the Local Historic Districts in order to further encourage historic preservation and . rehabilitation of existing Buildings. An adjustment to the Parking Impact Fee is also being proposed for large projects due to increased construction costs in addition to establishing a revised procedure for adjusting said impact fees. Furthermore, the parking requirement for commercial development outside of the Architectural • or Local Historic Districts is also being amended to clarify the number of required parking spaces that must be physically provided. ANALYSIS As part of an on-going analysis of the City's overall parking situation, the City Administration has identified the_ need to further amend the Parking Regulations Section of the Zoning Ordinance. The proposed Ordinance would eliminate the parking requirement for main or accessory uses associated with existing Buildings within the Miami Beach Architectural District and Local Historic Districts. The amendment would also change the base fee for the Parking Impact Fee Program and the process by which the fee is established. Furthermore, the amendment would also clarify the payment of impact fees for the removal of existing parking spaces and prohibit the use of the Parking Impact Fee to satisfy more than 50% of the required parking for new development other than residential construction, outside 'of the Architectural District,. The underlined portions are those that would be added to the existing Ordinance and the struck-through portions are those that would be deleted. CONCLUSION The Administration concludes that the City Commission should proceed to approve the resolution setting a date and time for the first reading of the attached ordinance.
