A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, APPROVING A JOINT
PROJECT AGREEMENT BETWEEN THE CITY AND THE STATE •
OF FLORIDA DEPARTMENT OF TRANSPORTATION, FOR
PRIMING AND PAINTING CERTAIN TRAFFIC SIGNALS
THROUGHOUT THE CITY; AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE THE AGREEMENT.
WHEREAS, the City, in conjunction with the State of Florida Department of •
Transportation(the Department),is currently in the process of aesthetically upgrading traffic
signals, mast arms, and traffic control assemblies throughout the North Shore Project and
Collins Avenue Project in the Art Deco District; and
WHEREAS, in accordance with the aforementioned process, the City has
requested that the Department prime and paint the mast arm signal pole assemblies on
certain traffic signalization equipment throughout the above areas; and
WHEREAS, the proposed coloring is in accordance with the North Shore
design and the anticipated Collins Avenue design plans; and
WHEREAS, the Administration has negotiated the Joint Project Agreement,
attached hereto as Exhibit "A".
NOW,THEREFORE,BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission herein approve the attached Joint Project Agreement between the City and the
State of Florida Department of Transportation, for priming and painting certain traffic
signals throughout the City, and authorizing the Mayor and City Clerk to execute the
Agreement.

SUBJECT: JOINT PROJECT AGREEMENT BETWEEN THE CITY OF MIAMI
BEACH AND THE STATE OF FLORIDA DEPARTMENT OF -
TRANSPORTATION, TRAFFIC SIGNAL PAINTING
ADMINISTRATION RECOMMENDATION:
It is recommended that the City Commission adopt a resolution authorizing the Mayor and
City Clerk to execute a joint project agreement between the City of Miami Beach and the
State of Florida Department of Transportation to provide for priming and painting to city
specifications certain traffic signals to be installed under state contract in the City of Miami
Beach and to appropriate $76,941.00 to pay for the work with $53,266.84 to be paid from
the North Shore funding and $23,674.15 from gas tax.
BACKGROUND
On November 19, 1992, the City of Miami Beach was notified by the State of Florida
Department of Transportation (FDOT) that due to Hurricane Andrew's destruction of
traffic signals, the Department was able to advance funds for replacement of traffic signals,
mast arms, and traffic control assemblies in ninety (90) intersections in the City of Miami
Beach. The proposed work to be done under three contracts is estimated to cost $7.5
million.
At the request of the City, FDOT has agreed to amend the signalization contracts to
include•aesthetically upgrading all of the signals in the North Shore Project at an additional
estimated cost of $475,000 and to also include at the City's expense the priming and
painting to City specifications, the signals in the North Shore Project as well as the
proposed Collins Avenue Project in the Art Deco District. The proposed coloring is in
accordance with the North Shore design plans and the anticipated Collins Avenue design.
The engineer's estimate for the painting is $105,600.00 in the field, however there is
considerable advantages both in the cost and quality by having the material factory applied.
As indicated in the agreement the cost to the City will be $76,941.00. Of this, $53,266.84
will be part of the North Shore funding,and $23,674.15 from gas tax. FDOT's participation
includes$475,000 for upgrading the North Shore signals,$25,000 for additional engineering
costs, and $7.5 million for the original signal installation project.
ANALYSIS
The advanced funding of the traffic signal upgrades has provided a significant opportunity
to the City to get this work done on a timely basis and in keeping with the design features

of the North Shore Project. It has also provided the opportunity to upgrade the signals in
anticipation of the Collins Avenue Project.
In accordance with the design engineer's recommendation the signals will be painted a flat
black to reduce the visual impact on the streetscape and surrounding areas.
CONCLUSION
It is recommended that the resolution authorizing the Mayor and City Clerk to sign the
joint project agreement be approved.

JOINT PROJECT AGREEMENT
THIS AGREEMENT, entered into this 6th day of October
1993 , between the STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION,
hereinafter referred to as the "DEPARTMENT" and THE CITY OF
MIAMI BEACH, acting by and through its City Commissioners,
hereinafter referred to as "CITY".
WITNESSETH
WHEREAS, the DEPARTMENT has contracted with Mitchell
Construction Company to upgrade the signals in the CITY under the
DEPARTMENT project number 87060-3567,
WHEREAS, the CITY is revitalizing the North Shore area and
Art Deco District within its corporate limits,
WHEREAS, the CITY has requested the DEPARTMENT to prime
and paint the mast arm signal pole assemblies in North Shore area
and the Art Deco District,
WHEREAS, the CITY wishes to pay the DEPARTMENT $76,941.00
(seventy-six thousand nine hundred forty one dollars) the cost of
priming and painting the mast arm signal pole assemblies in the
North Shore area and Art Deco District,
WHEREAS, the DEPARTMENT and the CITY believes that such
improvement to the signal structure is in the best interest of the
citizens of the City of Miami Beach and is a worthwhile public
purpose.
NOW THEREFORE, in consideration of the premises and the
covenants contained herein, the parties agree:
1. The DEPARTMENT agrees to supplement its contract with
Mitchell Construction Company to include the pay items for priming
and painting the mast signal pole assemblies at the intersections
of Collins Avenue and the following streets in the North Shore
area: 63rd Street, 65th Street, 67th Street, 71st Street, 73rd
Street and 75th Street and the midblock pedestrian crossing north of
63rd Street. Additionally, the DEPARTMENT agrees to supplement its
contract to include the pay items for priming and painting the mast
signal poles assemblies at the intersections of Collins Avenue and
the following streets in the Art Deco District: from 5th Street to
and including 23rd Street.
2. The CITY agrees to pay the DEPARTMENT $76,941 (seventy-
six thousand nine hundred forty one dollars) the cost of the

additional pay items referred to in paragraph 1 above within 5
working days from the execution of this Agreement. If said payment
is not received within 5 working days of execution, the Department
shall not authorize the additional pay items in its contract and
this Agreement shall become null and void.
3. Nothing in this Agreement shall be construed to violate the
provisions of Section 339.135(6) (a) , Florida Statutes (1992) which
provides as follows:
The Department, during any fiscal year, shall not
expend money, incur any liability, or enter into any
contract which, by its terms, involves the expenditure
of money in excess of the amounts budgeted as available
for expenditure during such fiscal year. Any contract,
verbal or written, made in violation of this subsection,
is null and void and no money may be paid on such contract.
(The Department shall require a statement from the
Comptroller of the Department that funds are available
prior to entering into any such contract or other binding
commitment of funds. Nothing herein contained shall
prevent the making of contracts for periods exceeding one
year, but any contract so made shall be executory only for
the value of the services to be rendered or agreed to be
paid for in succeeding fiscal years; and this paragraph
shall be incorporated verbatim in all contracts of the
Department which are for amount in excess of $25,000
and which have term for a period of more than one year.
