A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, EXPRESSING THE CITY'S INTENT TO
PROVIDE FOR THE FUTURE USE OF PROPERTIES LOCATED IN THE
ALTOS DEL MAR NO. 1 SUBDIVISION, AS MORE PARTICULARLY
DESCRIBED HEREAFTER, UPON THE ACQUISITION OF SUCH
PROPERTIES FROM THE TRUSTEES OF THE INTERNAL IMPROVEMENT
TRUST FUND OF THE STATE OF FLORIDA.
WHEREAS, the Trustees of the State of Florida Internal
Improvement Trust Fund, under the Save Our Coast Program, purchased
approximately 22 lots which were intended to be incorporated in the
North Shore Open Space Park; and
WHEREAS, the City of Miami Beach adopted the Altos Del Mar
Historic District, in order to assure that future development in
the Altos Del Mar area would be consistent with existing uses; and
WHEREAS, it is the desire of the City of Miami Beach and the
residents of the area to maintain the existing low density zoning
and single family homes, and to encourage the expansion of the
Altos Del Mar Aistoric District and the development of homes in the
manner that has existed on the ocean front in the North end of
Miami Beach for seventy (70) years.
NOW THEREFORE BE IT RESOLVED by the Mayor and City Commission
of the City of Miami Beach, Florida:
1. Upon conveyance of the properties hereafter described
from the State of Florida Trustees of the Internal
Improvement Trust Fund to the City of Miami Beach, the
City of Miami Beach agrees that it will assure that the
properties will be used only for detached single family
dwelling purposes, with appropriate deed restrictions
reflecting this use of any property.
2 . The property which shall be the subject of such
assurances is legally described as:
Block 5, 6, 7, 10, 11 and 12, ALTOS DEL MAR NO. 1
SUBDIVISION, according to the Plat thereof as recorded in
Plat Book 1
1 at page 440, of the Public Records of Dade
County, Florida.

SUBJECT: ADOPTION OF. RESOLUTION DECLARING THE CITY'S INTENT TO -
PROVIDE FOR THE FUTURE USE OF PROPERTY IN THE ALTOS DEL
MAR #1 SUBDIVISION UPON ACQUISITION OF SAME FROM THE
STATE OF FLORIDA, REFERRAL OF NORTH BEACH OPEN SPACE
ACQUISITION TO A JOINT LAND USE AND DEVELOPMENT COMMITTEE
AND CAPITAL IMPROVEMENTS COMMITTEE MEETING AND RESOLUTION
• AUTHORIZING THE ADMINISTRATION TO HIRE UNIVERSITY OF
MIAMI/DUANY PLATER ZYBERK TO PREPARE A MASTER PLAN OF THE
NORTH BEACH AREA.
ADMINISTRATION RECOMMENDATION:
It is recommended that the City Commission approve the attached
Resolution declaring. the- City' s intent to provide ..for. the future
use of the t'v my-two (22) parcels in the Altos del Mai a'uud t;i i'din•
as single family homes; refer the discussion of acquisition steps
and budget to a joint Land Use and Development and Capital
Improvements Committee meeting; and direct the Administration to
retain the University of Miami in conjunction with DPZ to prepare
a master plan for the area.
BACKGROUND:
The Administration and the City Attorney have been working with the
State of Florida over the last several months to have the North
Shore Open Space Park re-conveyed to the City of Miami Beach and to
acquire twenty-two (22) surplus parcels in the Altos del Mar
subdivision. The issue has been noted to the City Commission in
several Letters to Commission and as a recommendation from the Land
Use and Development Committee. . The Commission directed the
Administration and the City Attorney to move forward with this
process at the September 8, 1993, Commission Meeting.
ANALYSIS:
The Administration made a presentation to the Cabinet Aides on
September 22, 1993 . Subsequently, the Cabinet, on September 28,
1993, approved the staff recommendation to authorize the sale of
the 22 lots and to reconvey the remainder of the State Recreation
Area to the City of Miami Beach. There were letters of support for
this action from North Beach Development Corporation, Miami Design
Preservation League and Dade Heritage Trust. Additionally, an oral
presentation was made at the Cabinet Aides' meeting by Mr. Frank •
Wolland, who represents seven of the 13 existing property owners in
Altos del Mar. Mr. Wolland indicated support for the City to• be
able to acquire the property subject to the City agreeing to

restrict the use of the twenty-two (22) Altos del Mar lots to
single family detached residential. A Resolution declaring the
City' s intent is attached and is recommended to be adopted by the
Mayor and City Commission. The adoption of this Resolution will
increase the comfort level of residents in the area who have
expressed great concern regarding the history of the project.
The acquisition process, funding and master planning requires
additional discussion. The Administration recommends that the
North Shore Open Space acquisition issue be referred to a joint
meeting of the Land Use and Development and Capital Improvement
Committees. Closing is anticipated to occur before the end of
1993 .
Because important issues are involved including the preservation of
an historic area and the need for strong design guidelines for this
major new entrance to the City, an innovative master planning
effort is needed. The University of Miami has expressed a strong
interest to be involved in the planning effort along with the firm
of Duany Plater Zyberk (DPZ) . Currently a principal of DPZ,
Elizabeth Plater Zyberk is affiliated with the University program.
Therefore, we believe that engaging this firm, along with the
University, makes this firm uniquely qualified to pursue these
consultant services. It is estimated that the fees for preparing
a master plan will not exceed $50, 000.
