A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING A PUBLIC HEARING TO CONSIDER ADOPTING AN ORDINANCE AMENDING COMPREHENSIVE ZONING ORDINANCE NO. 89-2665, AMENDING SECTION 7, "PARKING REGULATIONS", AMENDING SUBSECTION 7-1, ENTITLED "PARKING DISTRICTS ESTABLISHED", AMENDING THE BOUNDARY OF PARKING DISTRICT NO. 2 BY INCLUDING THOSE PROPERTIES SOUTH OF 17TH STREET; AMENDING SUBSECTION 7-2, ENTITLED "OFF-STREET PARKING REQUIRED" BY MODIFYING THE PARKING REQUIREMENTS FOR THEATERS LOCATED IN PARKING DISTRICT NO. 2; PROVIDING FOR INCLUSION IN THE ZONING ORDINANCE; PROVIDING FOR A REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City's Planning, Design and Historic Preservation Division has recommended that Section 7, entitled "Parking Regulations" of Comprehensive Zoning Ordinance No. 89-2665 be amended by amending Subsection 7-1, entitled "Parking Districts Established", amending the boundary of Parking District No. 2 by including those properties south of 17th Street and amending Subsection 7-2, entitled "Off-Street Parking Required" by modifying the parking requirements for theaters located in Parking District No. 2; and WHEREAS, on October 26, 1993 the City's Planning Board held a public hearing regarding the proposed amendment, after which the Board voted 4 to 3 in favor of the amendment; and WHEREAS, pursuant to Section 14 of the Zoning Ordinance No. 89-2665, the proposed amendment must now be considered by the City Commission at public hearings. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing to consider an ordinance amending Comprehensive Zoning Ordinance No. 89-2665, amending Section 7, entitled "Parking n Regulations", amending Subsection 7-1, entitled "Parking Districts Established", amending the boundary of Parking District No. 2 by including those properties south of 17th Street; amending Subsection 7-2, entitled "Off-Street Parking Required" by modifying the parking requirements for theaters located in Parking District No. 2 ; providing for inclusion in the Zoning Ordinance; providing for a repealer; providing for severability; and providing for an effective date, is hereby called to be held before the City Commission in its Chambers on the Third Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida, on January -5 1993 beginning at 4:45 p .m. , and the City Clerk is hereby,, authorized and directed to publish appropriate Public Notice of the said Public Hearings in a newspaper of general circulation in the City of Miami Beach, at which time and place all interested parties will be heard. Carit• 1 City Manager SUBJECT: AMENDMENTS TO ZONING ORDINANCE NO. 89-2665 AMENDING SECTION 7, "PARKING REGULATIONS", PERTAINING TO AMENDING THE BOUNDARY OF PARKING DISTRICT NO. 2 AND MODIFYING THE PARKING REQUIREMENT FOR THEATERS LOCATED WITHIN PARKING DISTRICT NO. 2 - SETTING OF PUBLIC HEARING RECOMMENDATION The Administration recommends that the City Commission set a public hearing for January 5, 1994 for first reading of the attached Ordinance amending Zoning Ordinance 89-2665. BACKGROUND The City Administration is requesting the City Commission to consider an amendment to the current Zoning Ordinance regarding the parking regulations for theaters located within Parking District No. 2. A second amendment proposes the expansion of the boundaries of Parking District No. 2 to include those properties north of Lincoln Road and south of Seventeenth Street from the west side of Washington Avenue to the east side of Lenox Court. The Planning Board, at its meeting of October 26, 1993, voted 4-3 to recommend in favor of the proposed amendment. ANALYSIS The proposed amendments are designed to encourage the development of motion picture theaters within the Lincoln Road Mall area by modifying the parking requirement for theaters to no parking requirement for the first 600 seats and one (1) parking space for every additional eight (8) seats over the 600 seat threshold. The concept is that patrons would park in existing lots or garages and walk to Lincoln Road •to attend the theaters. The parking requirement for theaters may not be satisfied through participation in the Parking Impact Fee Program. Since recent parking studies prepared by the City's consultant for Lincoln Road have confirmed that there is generally a surplus of available public parking spaces in Parking District No. 2, the proposed amendments constitute an efficient mechanism to attract not only new theater development, but • also help foster supplementary economic growth to the surrounding Lincoln Road Mall area. 99 AGENDA I ITEM I L_ DATE / I 3 By expanding Parking District No. 2 north to Seventeenth Street, those at-grade municipal parking facilities immediately to the north of Lincoln Road become potential prime sites for new theater development. As such, the City Commission will, at, the December 1, 1993 meeting, be reviewing a Request For Proposals (RFP) to develop two of these sites as a multiple-screen cinemas. It is expected that the revised parking requirement will establish a substantial inducement to entice this sought after development for the west end of Lincoln Road. CONCLUSION Based on the foregoing, the Administration has concluded that the proposed amendments are necessary in order to encourage the development of theaters in the Lincoln Road Mall area.
