A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE SECOND
BUDGET AMENDMENT TO.THE POLICE CONFISCATION BUDGET AND
APPROPRIATING FUNDS FOR THE POLICE CONFISCATION TRUST
ACCOUNT FOR FISCAL YEAR 1994/95 IN THE AMOUNT OF
$20,000 THE BUDGET TO BE FUNDED FROM THE PROCEEDS OF
FEDERAL CONFISCATED FUNDS.
WHEREAS, the Chief of Police of the City of Miami Beach has
determined that the need for expenditures and appropriation, as
provided for and outlined in the budget attached as Exhibit "A",
exists; and
WHEREAS, funds for the budget are available from the Police
Confiscation Fund.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and
City Commission hereby adopt the Second Amendment to the Confiscation
Fund Budget for the City of Miami Beach, in the amount of $20,000 as
reflected in Exhibit "A".

$15,000 ADDITIONAL CONSTRUCTION WORK TO FINISH THE NEW NORTH BEACH
SUB -STATION. THIS INCLUDES: painting the exterior of the
building, installing flooring and repair of the rest rooms,
fencing, and a flag pole.
$ 2,500 VARIOUS CRIME PREVENTION MATERIALS FOR THE NEW NORTH BEACH
SUB -STATION, TO INCLUDE: handouts, signs, pamphlets and
other related items
$ 2,500 TO PURCHASE SECURITY EQUIPMENT FOR THE NEW NORTH BEACH SUB-
STATION TO INCLUDE: a closed circuit television monitoring
system and safety glass.

hereby certify that the aforementioned proposed request for
expenditures from the City of Miami Beach Confiscations Trust Fund,

services as detailed in Exhibit "A", complies with the guidelines of
use of federally confiscated funds, and Section 932.705, Florida
Statutes, for the use of forfeited funds.

SUBJECT: SECOND AMENDMENT TO THE POLICE CONFISCATION TRUST ACCOUNT
FOR FISCAL YEAR 1994/95
The Administration recommends authorization to adopt the Second
Amendment to the operating budget for the Police Confiscation Trust
Account for fiscal year 1994/95 in the amount of $20,000 from federal
confiscated funds, to be used to provide funds for the law
enforcement expenditures listed in Exhibit "A".
ADMINISTRATION RECOMMENDATION
The Administration recommends that the Mayor and City Commission
adopt the Second Amendment to the operating budget for the Police
Confiscation Trust Account and appropriate funding.
BACKGROUND
Expenditure for forfeiture funds for law enforcement purposes under
the federal guidelines is a proper expenditure.
The Chief of Police of the City of Miami Beach has determined that
the need for the expenditures and appropriations exist.

ANALYSIS
Federal forfeiture funds have been collected pursuant to Asset
Sharing Agreements with various federal agencies pursuant to 18 USCA
981 (e)2; 21,USCA 881 (e)(1)(A) and (e)(3); and/or.19 USCA 161a and
have been deposited in the Police Confiscation Trust Account.
