94-21433 ResoRESOLUTION NO. 94-21433 A RESOLUTION OF THE MAYOR AND CITY COMMISSION . OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AN AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH THE FIRM ROBERT K. SWARTHOUT, INC. TO INCLUDE THE PREPARATION OF AN EVALUATION AND APPRAISAL REPORT FOR AN AMOUNT NOT TO EXCEED A $20,224 GRANT FROM THE DEPARTMENT OF COMMUNITY AFFAIRS. WHEREAS, the City entered into an agreement with the firm Robert K. Swarthout, Inc., on July 22, 1992 to evaluate and update the City of Miami Beach Comprehensive Plan in accordance with Chapter 163, Florida Statutes, a/k/a Florida's Growth Management Act; and WHEREAS, the City must periodically prepare an Evaluation and Appraisal Report (E.A.R.) on its comprehensive plan pursuant to the requirements of Section 163.3191, Florida Statutes; and WHEREAS, the Department of Community Affairs (DCA) requires that the City complete certain technical requirements prior to August 15, 1995; and WHEREAS, the City's receiving a grant from DCA to finance the preparation of this portion of the E.A.R. is subject to DCA's approval of a contract with the City; and WHEREAS, the firm Robert K. Swarthout, Inc. agrees to prepare this portion of the E.A.R. for an amount not to exceed the DCA Grant of $20,224; and WHEREAS, the firm Robert K. Swarthout, Inc. is uniquely qualified to perform this task due to the,firm's past and current experience with the City of Miami Beach Comprehensive Plan. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City shall amend the agreement with the firm, Robert K. Swarthout, Inc. to include the preparation of those portions of the evaluation and appraisal report currently requested by the DCA for an amount not to exceed the $20,224 grant the City may receive from the Department of Community Affairs. Carlton City Manager SUBJECT: A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AN AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH THE FIRM ROBERT K. SWARTHOUT, INC. TO INCLUDE THE PREPARATION OF AN EVALUATION AND APPRAISAL REPORT FOR AN AMOUNT NOT TO EXCEED A GRANT FROM THE DEPARTMENT OF COMMUNITY AFFAIRS. RECOMMENDATION The.Administration recommends adoption of the attached Resolution authorizing an amendment to the Professional SerVlbes Agreement with the firm of Robert K. Swarthout, Inc. to prepare an Evaluation and Appraisal Report (EAR) of the City's Comprehensive Plan. This company is uniquely qualified to undertake this project as it is completely familiar with the City's Comprehensive Plan. BACKGROUND The 1994 State Legislature appropriated $1.8 million for the Department of Community Affairs (DCA) to assist eighty nine local government with the preparation of their required Evaluation and Appraisal Reports. The amount of funds available to the City of Miami Beach is $20,224, equal to each other government receiving funds. On July 27, 1994, the City Commission authorized the Mayor and City Clerk to enter into an agreement with the State of Florida. That agreement was executed and sent to the State by the required deadline of August 15, 1994. ANALYSIS The City of Miami Beach, in accordance with'Chapter 163, Part II, F.S., and Chapter 9-J5, Florida Administrative Code, is required to prepare and submit an Evaluation and Appraisal Report. The purpose of this report is to assess and evaluate the success or need for revisions of the City's Comprehensive Plan. The grant funds may be utilized for either salaries and expenses of City staff or payment to a consultant involved in the preparation of the Evaluation and Appraisal Report. The City is currently required to complete the scope of technical requirements outliend in the E.A.R. Contract submitted to DCA. AGENDA ITEM - ' - A DATE 1 2' 2 The Administration and Planning staff have concluded that the City's Comprehensive Plan consultant, Robert K. Swarthout, Inc. is best suited to prepare this document. This company has agreed in principle, as per the attached letter from same dated July 19, 1994, to perform all necessary work to complete the EAR in a manner that will be acceptable to the State DCA.
