A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MUM
BEACH, FLORIDA, APPROVING AN
AMENDMENT TO THE PROFESSIONAL
SERVICES AGREEMENT WITH THE FIRM
ROBERT K. SWARTHOUT, INC. TO INCLUDE
EVALUATION OF NEIGHBORHOOD PLANS
FOR COMPLIANCE WITH THE CITY OF
MIAMI BEACH COMPREHENSIVE PLAN.
WHEREAS, the City entered into an agreement with the firm Robert K. Swarthout, Inc. on
July 22, 1992 to evaluate and update the City of Miami Beach Comprehensive Plan in accordance
with Chapter 163, Florida Statutes, a/k/a Florida's Growth Management Act; and
WHEREAS, the agreement with Robert K. Swarthout, Inc. allows the City to authorize
additional work at the rate specified in the agreement; and
WHEREAS, the City has commissioned several experts to prepare neighborhood plans; and
WHEREAS, it is necessary to evaluate these neighborhood plans for compliance with the
City's Comprehensive Plan.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City shall amend the
agreement with the firm, Robert K. Swarthout, Inc. to include evaluation of neighborhood plans for
compliance with the City Comprehensive Plan in an amount not to exceed $5,000.

RECOMMENDATION
The City Manager and City Attorney's Office recommend adoption of the attached resolution.
BACKGROUND AND ANALYSIS
The City has entered into agreements with several experts, including Andres Duany and Elizabeth
Plater-Zyberk, to prepare development plans and design guidelines for various neighborhoods.
These development plans, if adopted, would become a part of the City's zoning ordinance. Section
163, Part II of the Florida Statutes requires that such land development regulations be consistent with
the City's comprehensive plan.
The City is currently under contract with Robert K. Swarthout, Inc: to provide professional planning
services relative to the comprehensive plan amendment adopted on June 2, 1994. Mr. Swarthout is
already familiar with the City's plan and plan amendments. His current contract with City can be

amended to add additional services at the same rate currently being paid, not to exceed $5,000 in
order to review the above plans for consistency with the City's Comprehensive Plan.
CONCLUSION
The City Commission should adopt the attached resolution in order to allow the City to utilize the
professional services of Robert K. Swarthout, Inc. with respect to neighborhood plan's consistency
with the City's Comprehensive Plan.
