94-21440RESOLIMON NO. 94-21440 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC HEARING FOR JANUARY 18, 1995 FOR THE PURPOSE OF CONSIDERING A RATE ORDER WITH RESPECT TO GOLD COAST CABLEVISION'S FCC 393 SUBMISSION FOR BASIC CABLE TELEVISION RATES AS OF SEPTEMBER 1, 1993. WHEREAS, on September 22, 1993, the City of Miami Beach adopted Ordinance No. 93-2876 adopting cable television rate regulation standards and criteria as promulgated by the Federal Communications Commission ("FCC"); and, WHEREAS, on March 31, 1994 the City of Miami Beach gave Gold Coast notice of its intent to regulate basic cable service and equipment; and, WHEREAS, on April 26, 1994, Gold Coast filed FCC Form 393 with the City; and, WHEREAS, the City Commission retained the law firm of Liebowitz and Associates to review the FCC 393 rate request submission and to make recommendations to the City Commission; and, WHEREAS, Liebowitz and Associates have completed their review and have made findings and recommendations with respect to such rate requests; and, WHEREAS, the findings and recommendations will be presented in the form of a "Rate Order"; and, WHEREAS, FCC rules and regulations require a public hearing on the proposed rate order, which will be issued by the City in response to Gold Coast's rate requests NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing for the purpose of considering a proposed rate order with respect to Gold Coast Cablevision's FCC 393 submission for basic cable television rates in effect in the City of Miami Beach aA995, September 1, 1993 is scheduled for 4:00 pm, January 1in the City Commission Chambers, 1700 Convention Centeive, Miami B ach, Florida. SUBJECT: SETTING A PUBLIC HEARING TO SOLICIT COMMENT AND TO CONSIDER THE ISSUANCE OF A RATE ORDER WITH RESPECT TO GOLD COAST CABLEVISION FCC 393 SUBMISSION FOR BASIC CABLE TELEVISION RATES AS OF SEPTEMBER 1,1993 RECOMMENDATION The City Attorney and the City Manager recommend that the City Commission adopt the attached resolution which sets a public hearing for January 18, 1995 on a proposed "Rate Order" with respect to Gold Coast Cablevision's (Gold Coast) FCC 393 submission for baste —cable television rates in effect -in the City of Miami Beach as of September 1, 1993. BACKGROUND The law firm of Liebowitz and Associates, in conjunction with the accounting firm of Rachlin & Cohen, was retained by the City to evaluate Gold Coast's FCC 393 rate proposal and to report their findings and recommendations to the City Commission. Liebowitz and Associates have completed the review and have submitted their findings and recommendations to the City Attorney and City Manager. The findings and recommendations will be presented in to form of a "Rate Order". FCC rules require that the proposed Rate Order be submitted to the cable television 'operator sufficiently in advance of the scheduled public hearing to allow the operator (Gold Coast) to comment on that order. A report on the findings and recommendations, along with Any comments received from the operator, will be presented to the City Commission prior to opening the public hearing.
