RELATIVE TO THE ETHICS ORDINANCE
Attached herewith, please find a Resolution adopted by the Historic Preservation
Board, at its July 14, 1998, meeting, urging the City Commission to amend the City's
ethics ordinance.

RESOLUTION
At the July 14, 1998, meeting, the Historic Preservation Board of the City of Miami Beach discussed
Ordinance No. 97-3105, adopted on December 17, 1997, amending Miami Beach City Code Chapter
2 entitled "Administration", Article III thereof entitled "Standards of Conduct for City Officers and
Employees", by creating Section 2-47.4 entitled "Supplemental Abstention and Disclosure
Requirements", and 2-47.5 entitled "Certain Appearances Prohibited" relative to City of Miami
Beach Board and Committee members and unanimously resolved (7-0-2 [2 vacant appointments])
as follows:
1. The Historic Preservation Board unanimously urges the City Commission to strengthen the
City's ethics standards by adopting an amendment to the aforementioned Ordinance No. 97-
3105, which will uniformly limit the permissible conflicts-of-interest for members on all fu.w:
City land use boards, including the Historic Preservation Board, Design Review Board,
Planning Board, and Zoning Board of Adjustment, to three (3) per year, and will exempt the
land use boards from those provisions of the ethics ordinance which now prohibit a person
who presents to the board from serving on a City board or committee, due to a conflict-of-
interest, by allowing a maximum of three (3) abstentions for voting on a matter before the
respective board, due to a conflict-of-interest, on three (3) different applications within a
period of one (1) year.
2. The Historic Preservation Board unanimously urges the City Commission to consider an
amendment to the Code of the City of Miami Beach, Chapter 118 (Historic Preservation
Board ), Section 118-105 (Removal) to include the language as follows, "For the purposes
of this section, an absence from a board meeting shall be defined as missing more than thirty
percent (30%) of the scheduled matters on that meeting's agenda."

I am pleased to hear that the Blue Ribbon Committee appointed by the City Manager has met and
determined that, in fact, Brown and Brown's report was predominantly accurate and that the best
course of action is for replacement of the roofs at the Center and Theater. We look forward to
completion of the tests on the West Wrap and C-7 roof to finalize the course of action on these areas.
Throughout the process, questions have been raised regarding the "maintenance" of the roof I have
attached a synopsis, previously submitted to the City, again reiterating the extent and longevity of the
roof leakage problems. These problems date back to prior to final completion of the expansion
project in 1991. In fact, our files show notification to the City by SMG ofleakage problems by me
personally in my capacity as Director of Operations during my initial tenure here in 1991.
Throughout the years, our maintenance staff has created temporary solutions, from patching to
hanging "diapers" to catch and divert water down makeshift garden hose drains in order to minimize
inconvenience to our exhibitors.
In spite of these efforts, we have still suffered embarassment by virtue of these leaks. We have
reached an agreement with a dissatisfied exhibitor during the Graphics ofthe Americas show just this
year; during the Glenn Miller Orchestra concert, the conductor's podium had to be moved because
of a leak directly overhead; and, Lou Baron has consistently encountered problems with his Antique
Show exhibitors. The Miami City Ballet would also serve as an anecdotal resource concerning these
problems. These are but a few of our clients who have encountered inconveniences over the years.
We look forward to the opportunity to assist the City in moving forward and finally correct these
problems.

May 4, 1993 TCCEA Minutes - Reported that West Wrap roof replacement will
start in June.
August 2, 1993 Memo from Purchasing to Eddie Cox - Reporting Advanced Roofmg is
now required by code to perform a Moisture Survey and Wind Up-Lift test
prior to performing any work on the West Wrap.
September 13, 1993 Memo from Chuck Nedrow (MBCC) to Thom Connors - Reporting leaks
At the Jackie Gleason Theater. Additional attachments: Advanced
Roofmg bid for emergency repair, a memo from Thom Connors to Mayra
Diaz Buttacavoli informing her that previous roof damage at the Gleason
has not been repaired, and a letter from Owens-Coming recommending
the City of Miami Beach contract a consultant and moisture detection
service to evaluate the theater roof s current condition.
June, 1994 Updated Capital Plan presented by SMG - Stating the replacement of
Gleason parapet moldings was awarded to Frank Moran Company. The
plan further requests roof moisture testing to determine whether repairs or
replacement is necessary.
