A RESOLUTION -OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, WAIVING, BY'5/7T" VOTE, THE REQUIREMENT IN
SECTION 2-14(D)(1)(A) OF THE CITY CODE, TO REFER ANY AGENDA ITEM IN
EXCESS OF $75,000 TO A COMMISSION COMMITTEE FOR A
RECOMMENDATION, AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE
AND EXECUTE A NEW FUNDING AGREEMENT, BETWEEN THE CITY AND
UNIDAD OF MIAMI BEACH, INC., EFFECTIVE MARCH 1, 2025, TO PARTIALLY
FUND THE CURRENT LEVEL OF PARTICIPATION IN THE SENIOR MEALS
PROGRAM (180 PARTICIPANTS) OFFERED AT THE NORTH BEACH SENIOR
CENTER, LOCATED AT 7251 COLLINS AVENUE, IN THE AMOUNT OF $230,000
PER YEAR, ON A RECURRING BASIS, THROUGH FISCAL YEAR 2029-2030,
SUBJECT TO FUNDING APPROPRIATION AND APPROVAL -BY THE CITY
COMMISSION DURING THE BUDGETARY PROCESS FOR EACH FISCAL YEAR,
UNLESS OTHERWISE DIRECTED BY THE CITY COMMISSION, AND PROVIDED
THAT ANY REMAINING UNUSED CITY FUNDS WOULD BE COMMITTED BY THE
CITY FOR ELDER PROGRAMMING AT THE SENIOR CENTER.
WHEREAS, UNIDAD of Miami Beach, Inc. ('UNIDAD") operates the North Beach Senior
Center ("Senior Center"), located at the North Beach Oceanfront Center, 7251 Collins Avenue,
pursuant to a Management Agreement, dated September 30, 2006, as amended by Amendment
No. 1 to the Management Agreement, dated June 20, 2018 (collectively, the "Management
Agreement") to generally provide senior social services, senior training and related elderly services;
and
WHEREAS, the discussion surrounding the need for a congregate meals program serving
the under -served and significant elderly population in North Beach was subsequently discussed at
the December 20, 2017 and January 24, 2018 Neighborhoods Committee; and
WHEREAS, on February 14, 2018, the Mayor and City Commission adopted Resolution No.
2018-30197, accepting the recommendation of the Neighborhoods Committee to provide funding, in
the amount of $230,000.00, to UNIDAD for the creation of a senior meals program, to serve elder
residents at the Senior Center for FY 2017-2018 and FY 2018-2019, subject to funding appropriation
and approval through the City's budgetary process; provided that, in the. event UNIDAD secured
program funding from the Alliance for Aging, any remaining unused City funds would be committed
by the City for elder programming; and further requiring that the Administration provide the City
Commission with an annual report as to the status of the senior meals program; and
WHEREAS, on December 12, 2018, the Mayor and City Commission adopted Resolution
Number 2018-30654, approving funding to UNIDAD for fiscal year 2018-2019, in the amount of
$230,000.00, to support and enhance the senior services being offered at the Senior Center
including, among other things (1) partially funding the current level of participation in the senior meals
program; (2) expanding the meals program by adding 60 participants, for a total of 180 participants;
(3) continuing to support socialization programming and (4) expanding. the programming to include
computer training classes, and approving funding for these services on a recurring basis through FY
2023-2024, subject to funding appropriation and approval by the City Commission during the City's
budgetary process for each subsequent fiscal year, unless otherwise directed by the City
Commission; and
WHEREAS, the funding for the senior meals program and other elder programming have
been funded through a grant agreement, renewable each year once appropriation and funding have
been approved by the City Commission through the budgetary process; and
WHEREAS, due to a delay in the commencement of the services, the term of the annual
grant agreements have commenced on March 1St of each year and expired on the last day of
February of the following year; and
WHEREAS, any unused funds for a particular contract year have been rolled over into the
approved succeeding contract year to be used for elder meals program and elder programming
services; and
WHEREAS, the current grant agreement, approved during the City's budgetary process for
FY 2023-2024, will expire on February 28, 2025 and the continuation of the elder meals program
and other elder programming would require approval by the City Commission; and
WHEREAS, The City currently has the following six congregate meal sites:
0 610 Espanola Way;
• Rebecca Towers (200 Alton Road);
• Council Towers (533 Collins Avenue), currently not operational but is expected to open
again;
• Federation Towers (757 West Avenue); and
• Stella Maris (8638 Harding Avenue) (restricted only to tenants of the Stella Maris housing
facility; and
• the UNIDAD Senior Center (7251 Collins Avenue)(open-to all qualified seniors); and
WHEREAS, all of the meal sites, except -for Stella Maris and the Senior Center, are located
in South Beach and Stella Maris only serves residents of its housing facility, as such, the UNIDAD
Senior Center is the only meal site 1) serving all qualified and registered elders in the North Beach
area, 2) is the only congregate meal site open to the general public north of Dade Boulevard and 3)
is the only full service Senior Center in the entire City; and
WHEREAS, UNIDAD receives funding from the Alliance for Aging from the Older Americans
Act (OAA), Title III program to partially fund its meals program; and
WHEREAS, the OAA program is awarded through a competitive RFP process and requires
that nutrition service providers ensure that meals meet strict food and nutrient requirements, are safe
to serve and are appealing to older adults; and
WHEREAS, although UNIDAD receives funding from OAA, UNIDAD does not charge for the
meals served and does not generate sufficient independent income to fund the entire cost of the
elder meals program; and
WHEREAS, additionally, the' OAA program requires matching funds from a third -party
source, which thus far has been provided by the City; and
WHEREAS, UNIDAD requires funding, in the approximately amount of $230,000.00 per
year, in order to continue to provide meal service for the 180 participants currently capable of being
served at the Senior Center; and

WHEREAS, local governments often help to fund meal services for elders, other at -risk
populations, and food insecure members of a community; and
WHEREAS, this Resolution will help to continue to support and enhance this much needed
senior meal service at North Beach, in the annual amount of $230,000.00, on a recurring basis,
through FY 2029-2030, subject to funding appropriation and approval on an annual basis through
the City's budgetary process, and provided that any remaining unused City funds would be
committed by the City for elder programming at the Senior Center; and
WHEREAS, on June 28, 2023, the Mayor and City Commission adopted Resolution No.
2023-32647 directed the Administration to review and make recommendations to the City
Commission with regard to recurring grants every three (3) years to allow for periodic review and
approval of all Commission -sponsored initiatives or grant programs involving recurring funding; and
WHEREAS, the adoption of this Resolution by the Mayor and City Commission shall be
deemed to satisfy the requirements of Resolution No. 2023-32647 with regard to the recurring
funding for this UNIDAD through FY 2029-2030; and
WHEREAS, pursuant to Section 2-14(d)(1)(a) of the City Code, when a Resolution sponsored
and initiated by a City Commissioner is determined to have a fiscal impact greater than $75,000.00,
the item is required to be referred to a Commission Committee for review and recommendation,
unless the City Commission waives this requirement by a five -sevenths vote; as such, this Resolution
requires a 5/7th vote of the Mayor and City Commission.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission
hereby waive, by 5/7th vote, the requirement in Section 2-14(d)(1)(a) of the City Code, to refer any
agenda item in excess of $75,000 to a commission committee for a recommendation, and authorize
the City Manager to negotiate and execute a new funding agreement, between the City and UNIDAD
of Miami Beach, Inc., effective March 1, 2025, to partially fund the current level of participation in the
senior meals program (180 participants) offered at the North Beach Senior Center, located at 7251
Collins Avenue, in the amount of $230,000 per year, on a recurring basis, through fiscal year 2029-
2030, subject to funding appropriation and approval by the City Commission during the budgetary
process for each fiscal year, unless otherwise directed by the City Commission, and provided that
any remaining unused City funds would be committed by the City for elder programming at the Senior
Center.
