RESOLUTION NO j 2024-33019 A RESOLUTION OF THE MAYOR AND CITY COMMISSION.OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING, IN SUBSTANTIAL FORM, AMENDMENT NO. 1 TO'THE INTERLOCAL AGREEMENT FOR VOLUNTARY PRE -KINDERGARTEN (VPK) CLASSES DATED AUGUST 18, 2023, BETWEEN THE CITY AND THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA; SAID AMENDMENT: (1) MOVING THE VPK CLASSROOM AT BISCAYNE BEACH ELEMENTARY SCHOOL TO MIAMI BEACH FIENBERG FISHER K-8 FOR THE 2024-2025 SCHOOL YEAR IN ORDER TO MEET THE NEEDS OF THE COMMUNITY; AND (2) SETTING AN EXPIRATION DATE FOR THE INTERLOCAL AGREEMENT AS OF THE LAST DAY OF THE 2024-2025 SCHOOL YEAR; AND APPROVING THE REALLOCATION OF THE CITY CONTRIBUTION UNDER THE INTERLOCAL AGREEMENT, IN THE AMOUNT OF $45,945.00 PER YEAR, BEGINNING IN THE 2025-2026 SCHOOL YEAR, TO SUPPORT THE CITY'S PREKINDERGARTEN -SCHOLARSHIP PROGRAM, THEREBY INCREASING THE TOTAL NUMBER OF SCHOLARSHIPS FOR THE PROGRAM BY FIFTEEN (15) COMMENCING IN THE 2025-2026 SCHOOL YEAR AND EACH'YEAR THEREAFTER; AND FURTHER AUTHORIZING THE INTERIM CITY MANAGER TO NEGOTIATE AND EXECUTE THE AMENDMENT. WHEREAS, on December 9, 2015, the Mayor and City Commission adopted Resolution No. 2015-29222, authorizing the City Manager to negotiate an agreement with The School Board of Miami -Dade County, Florida (M-DCPS) for the City to provide funding to M-DCPS for one prekindergarten classroom ("VPK") at each of the following. schools: Biscayne Elementary School and Fienberg Fisher K-8 Center (the "CMB VPK classrooms"); and WHEREAS, on February 10, 2016, the City and M-DCPS executed an Interlocal Agreement ("Agreement"); and WHEREAS, the VPK services offered at Biscayne Elementary School and Fienberg Fisher K-8 Center, under the terms, of the Agreement, served the City of Miami Beach resident children from the following four targeted schools: Biscayne Elementary. School, Fienberg Fisher K-8 Center, North Beach Elementary School and South Pointe Elementary School, following the Registration. and Lottery Procedures for school years 2016/17, 2017/18, and 2018/19; and WHEREAS, On April 11, 2018, the Mayor and City Commission adopted Resolution No. 2018-30259, approving the reduction in funding for the CMB VPK classrooms during the 2018- 2019 school year, by approving the removal the CMB VPK class at Fienberg Fisher K-8 Center and providing funding for fifty percent (50%) of personnel costs for the CMB VPK class at Biscayne Elementary School, serving up to 20 City resident children from the four targeted Miami Beach schools, based upon a lottery system, in an amount not to exceed $35,000.00, with M- DCPS funding the remaining costs; and WHEREAS, on June 26, 2018, the parties executed Amendment No. 1 to the Agreement, memorializing that the CMB VPK class at Biscayne Elementary School would be providing the VPK program for the four targeted Miami Beach schools during the 2018-2019 school year; and WHEREAS, on June 5, 2019, the Miami -Dade County Public School Board adopted a Resolution relating to Item D-67, renaming the Miami Beach public schools, and Biscayne Elementary School was renamed Biscayne Beach Elementary School and Fienberg Fisher K-8 Center was renamed Miami Beach Fienberg Fisher K-8; and WHEREAS, on June 5, 2019, the Mayor and City Commission adopted Resolution No. 2019-30840, approving Amendment. No 2 to the Agreement for the continuation of the CMB VPK classroom at Biscayne Beach Elementary School for. the 2019-2020 school year; subject to two (2) additional one-year extensions by mutual agreement of the parties, based upon the same financial terms, which included an annual City contribution in the amount not to exceed $35,000.00; and WHEREAS., instead of executing Amendment No. 2, the City and M-DCPS executed a new Interlocal Agreement dated January 3, 2020 for the 201'9-2020 school year; and WHEREAS, the following two-year extensions of the CMB VPK program at Biscayne Beach Elementary School were memorialized pursuant to the following two new Interlocal Agreements: an Interlocal Agreement, dated August 2, 2021, covering the period. from July 1, 2021 through June 30, 2022; and an Interlocal Agreement, dated August 30, 2022, covering the period from July 1, 2022 through June 30, 2023; and WHEREAS, on April 28, 2023, the Mayor and City Commission adopted Resolution No. 2023-32571, extending the Agreement to continue the CMB VPK program at Biscayne Beach Elementary School for the 2023-2024 school year, with two (2) additional one-year extensions, and with the City contributing an amount not to exceed $45,945.00 per school year; and WHEREAS, on August 18, 2023, the City and MDCPS executed an Interlocal Agreement, continuing the CMB VPK program, as authorized pursuant to Resolution No. 2023-32571 (the "2023 Agreement'); and WHEREAS, in March 2024, the Title I classification for Miami Beach Fienberg Fisher K-8 was not renewed for the 2024-25 school year, resulting in a loss of federal funding for its VPK program; and WHEREAS, thirty-seven (37) students have applied to attend the VPK classes at Miami Beach Fienberg Fisher K-8 for the 2024-2025 school year; however, only a few students have applied to attend the VPK class at Biscayne Beach Elementary School; and WHEREAS, MDCPS has requested that the existing Interlocal Agreement be amended to move the VPK classroom at Biscayne Beach Elementary School to Miami Beach Fienberg Fisher K-8 for the 2024-2025 school year, in order to meet the needs of the community; and . WHEREAS, the Administration recommends that the amendment also provide an expiration date for the current Interlocal Agreement as of the last day of the 2024-25 school year; and WHEREAS, the Interim City Manager recommends that the Mayor and City Commission approve, in substantial form, Amendment No. 1 to the 2023 Agreement, a copy of which is attached to the City Commission Memorandum accompanying this Resolution; and further authorize the Interim City Manager to negotiate and execute the Amendment; and WHEREAS, the Interim City Manager further recommends approving the reallocation of the City contribution under the Interlocal Agreement, in the amount of $45,945.00 per year, to support the City's Prekindergarten Scholarship Program ("Scholarship Program"), beginning in the 2025-26 school year, thereby increasing the total number of scholarships for the Scholarship Program by fifteen (15) each year thereafter. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve, in substantial form, Amendment No. 1 to the Interlocal Agreement for Voluntary Pre -kindergarten (VPK) Classes dated August 18, 2023, between the City and The School Board of Miami -Dade County, Florida; said Amendment: (1) moving the VPK classroom at Biscayne Beach Elementary School to Miami Beach Fienberg Fisher K-8 for the 2024-2025 school year in order to meet the needs of the community; and (2) setting an expiration date for the Interlocal Agreement as of the last day of 2025-2026 school year; and approve the reallocation of the City contribution under the Interlocal Agreement, in the amount of $45,945.00 per year, to support the City's Prekindergarten Scholarship Program, beginning in the 2025-26 school year, thereby increasing the total number of scholarships forthe Program by fifteen (15) commencing in the 2025-26 school year and each. year thereafter; and further authorize the Interim City Manager to negotiate and execute the Amendment. M- DCPS agreed to'fund the portion of the costs to operate the CMB VPK classroom which would not be funded by CMB for the 2019-2020 school year. On June 5, 2019, the Mayor and City Commission adopted Resolution No. 2019-30840, approving, in substantial form, the Amendment. Miami Beach Fienberg Fisher K-8 Center lost its Title I classification for the 2024-25 school year resulting in a loss of funding for VPK programming. An amendment to the existing Interlocal Agreement, dated August 18, 2023, would allow MDCPS to move the one (1) Prekindergarten classroom (VPK) at Biscayne Beach Elementary to Miami Beach Fienberg Fisher K-8 to meet the needs of the community. ANALYSIS The current City of Miami Beach funded VPK class is located at Biscayne Beach Elementary School. As of today, there is one (1) registered student for the 2024-2025 school year. The VPK program at Miami Beach Fienberg Fisher K-8 has thirty-seven (37) families on the wait list for the 2024-2025 school year. To accommodate up to 20 of the families at Miami Beach Fienberg Fisher K-8, which shows the highest demand for VPK seats, this amendment to the existing interlocal agreement will move the city funded VPK class from Biscayne Beach Elementary to Miami Beach Fienberg Fisher K-8 for the 2024-2025 school year. The full-day VPK program at Miami Beach Fienberg Fisher K-8, which has traditionally been funded through Title 1, provided a free full day of VPK; however, the loss of Title I funds converts the VPK classes to parental/guardian fee based for extended school hours beyond those funded by the State. The full-day VPK program will require a fee of approximately $15 per day for students who desire to remain at school from 11:20 a.m. to 1:50 p.m. for a full day. The City of Miami Beach funded VPK class will provide a free altemative for twenty (20) of the Miami Beach resident families who may not be able to pay the cost of the full-day program. All 37 families currently registered for the VPK program at Miami Beach Fienberg Fisher K-8 are Miami Beach residents. Beginning in the 2025-26 school year, these funds will be allocated to the City's PreK scholarship program to increase the number of scholarships by approximately fifteen allowing families to select their child's prekindergarten provider from a variety of provider partners.
