Resolution 2020-31487RESOLUTION NO.. 2020-31487 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE ART IN PUBLIC PLACES COMMITTEE AND APPROVING THE 500 ALTON ROAD PUBLIC ART COMMISSION BY MIAMI BASED ARTIST MARK HANDFORTH; TO BE FUNDED THROUGH THE ESCROW AGREEMENT BETWEEN TCH 500 ALTON, LLC AND THE CITY OF MIAMI BEACH IN THE AMOUNT OF $95,812.00, THUS SATISFYING THE REQUIREMENTS OF THE ART IN PUBLIC PLACES ORDINANCE. WHEREAS, in 1995, the Mayor and City Commission adopted Ordinance No. 95-2985, also known as the Art in Public Places ("AiPP") Ordinance, to "enhance the aesthetic environment of the City of Miami Beach by including works of art on public property within the City and in City construction projects"; and WHEREAS, the goals of the AiPP program are: overseeing the City's public art collection; enhancing the physical environment of Miami Beach with artworks of the highest level of quality and suitability for the site; serving as the coordinating body for all public art projects on City property; building partnerships with the private sector, non- profit and community groups that connect the AiPP projects to the life of the City; encouraging participation by artists based locally, nationally and internationally; and serving as a source of information about public art; and WHEREAS, on September 11, 2019, the Mayor and City Commission adopted Ordinance No. 2019-4296, amending the Art in Public Places Ordinance to increase the amount to be appropriated to the Art in Public Places fund from not less than 1.5%, to not less than 2% of the construction cost of city construction projects and joint public /private developments; to decrease the dollar threshold of city construction projects from $500,000 to $250,000 for projects subject to the provisions of Art in Public Places; amend the definition of City construction projects; amend applicable projects to include management agreements for a City -owned buildings or facilities having a term of ten (10) years or more; and amend consideration of a waiver of the required AiPP appropriation to require a resolution approved by 5/7t" vote of the City Commission; and WHEREAS, currently, the AiPP program is funded by 2% of all "hard costs" of City capital construction projects, including new construction, additions, and costs for construction of joint private/public projects; and WHEREAS, pursuant to Section 82-562 of the AiPP ordinance, entitled "Powers and Duties" of the Art in Public Places Committee, the AiPP Committee shall recommend to the City Commission whether a particular proposed city construction project is an appropriate site for works of art and whether all or a part of the appropriation required by Section 82-587 should be utilized at the site or, reduced or waived in its entirety or, placed, whether in its entirety or a portion thereof, in the art in public places fund for other acceptable uses; and WHEREAS, the AiPP Committee shall also recommend to the City Commission the selection of existing work of art or determine whether to recommend the selection of new works of art, and screen submissions therefore; and WHEREAS, on December 12, 2018, the City of Miami Beach entered into an agreement with South Beach Heights I, LLC, 500 Alton Road Ventures, LLC, 1220 Sixth, LLC, and KGM Equities, LLC (collectively the "Developer") via Resolution No. 2018-30647 for the development of properties located at 500 Alton Road, 630 Alton Road, 650 Alton Road, 1220 6th Street, 659 West Avenue, 701 West Avenue, 703 West Avenue, 711 West Avenue, 721 West Avenue, 723 West Avenue, 727 West Avenue, and 737 West Avenue ( collectively, the " Development Sites"); and WHEREAS, as part of the Agreement, the Developer is required to comply with the City's Art in Public Places Ordinance, defined in Section 16 of the Development Agreement as follows: The Developer shall comply with the City's Art In Public Places (the "A/PP') program requirements under Section 82-536 through 82-612 of the City Code (as applicable) and shall contribute to the City' s Art in Public Places fund the total of 1.5% of the " construction cost" as such term is defined in Section 82- 537 of the City Code) of the Park Project (the "Public Art Funds') no later than the date of execution of a construction contract for or that includes the construction of the Park Project, as required by the City Code. The full amount of the Public Art Funds shall be dedicated to Developer's use for public art within the Park Site. In view of the Developer's overall design responsibility for the Park Project, the Developer shall either.- (a) submit the proposed artworks to be funded with the Public Art Funds to the City' s Art In Public Places Committee for its review, recommendation and approval, or (b) seek the City Commission's approval of the proposed artworks and waiver of any applicable AIPP program requirements, which approval by the City Commission shall not to be unreasonably withheld, conditioned or delayed. WHEREAS, on October 20, 2020, the Developer presented to the City's AiPP Committee a proposed artwork, Mark Handforth's Snow White, 2016, to be funded with the Public Art Funds; and WHEREAS, following a presentation of the proposed work by artist Mark Handforth and upon reviewing the required submission materials, the AiPP Committee made a unanimous motion to accept the work as part of the City of Miami Beach Art in Public Places Collection, and further recognized that the Developer has fulfilled its public art contribution, as required by the Art in Public Places Ordinance. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the Art in Public Places Committee, and approve the 500 Alton Road Public Art Commission by Miami based artist Mark Handforth; to be funded through the escrow agreement between TCH 500 Alton, LLC and the City of Miami Beach in the amount of $95,812.00, thus satisfying the requirements of the Art in Public Places Ordinance. On October 20, 2020, the Developer presented to the City's Art in Public Places Committee a proposed artwork, Mark Handforth's Snow White, 2016, to be funded with the Public Art Funds. In considering the work, the Art in Public Places Committee reviewed the following criteria, as fully presented in Exhibit A and. B : 1. Pho ogmphs ofof proposed work Mark Handforth's Snow White (2016) is composed of painted aluminum and is 112 x 120 x 50 inches. 2. Artist Resume Mark Handforth (b. 1969, Hong Kong) was raised in London and has been based in Miami since 1992. His work has appeared in exhibitions worldwide, including solo presentations and outdoor public sculptures at the Museo d'Arte Contemporanea, Villa Croce, Genova, Italy (2016); Museum of Contemporary Art Chicago (2011); Dallas Museum of Art (2007); Kunsthaus Zu-rich (2005); and the Hammer Museum, Los Angeles (2002). Page 247 of 1430 Handforth's work is held in the collections of the Whitney Museum of American Art, Museum of Contemporary Art Los Angeles, Dallas Museum of Art, Pinault Collection, The Bass Museum of Art, Camegie Museum, Rubell Family Collection and Jumex Foundation, among others. 3. Project Description The all white star titled Snow White is part of a series of seven sculptural stars by Miami artist Mario Handforth. A red star, Texas Tom, is on exhibit at the Rachofsky House, a private home and contemporary art collection in Dallas; a deep violet star graces the rustic grounds .of the Domaine du Muy sculpture park in southeastern France; a saffron star adds a brilliant splash of color to the Governors Island park in New York Harbor. Handforth is debating whether to complete his star series by creating an eighth and final star in silver. According to Handforth, it was a challenge to convert the abstract rays of light that make up stars into a concrete sculptural form that also conveys movement. He succeeded by twisting the point of at least one of the five prongs, conveying the sense of a star streaking through the sky. 4. Proposed Location Within the Development Site public park, as further referenced in Exhibit B. 5. Project Budg_et/. Compliance with Art in Public Places Contribution The City held in escrow $95,812.00, which was the required contribution of the Developer to the Art in Public Places Program. As provided by the Developer, the actual cost of acquiring and installing the work is $177,250.00. The additional_ cost of $81,438.00 is being contributed by the Developer. 6. Engineering Requirements Renderings were provided as part of the submission package, Exhibit A, page 13. 7. Maintenance Plan As provided by the artist, the work will require periodic waxing to protect the paint and a periodic wash of clean water to remove construction dust and ocean salt. 8. Appraisal Re oo The Developer provided an. appraisal report by Morrissey Fine Art for the retail replacement value of Mark Handforth's Snow White (2016). This appraisal report is used for insurance inventory purposes. The market for works by the artist remains successful both on the auction and retail levels. The replacement value of the work is $281,500.00 9. Condition Report The work is in pristine condition and, is Zahnradstrasse21, CH-8005, Zurich. currently stored at Galerie Eva Presenhuber, Following a presentation of the proposed work by artist Mark Handforth and upon reviewing the required submission materials, the Art in Public Places Committee made a unanimous motion to accept the work as part of the City of Miami Beach Art in Public Places `Collection and further recognizes that the Developer has fulfilled its public art contribution, as required by the Art in Public Places Ordinance. In his sculptural installations, Handforth often transplants familiar objects found in civic infrastructure —such as municipal signs, motor scooters, hydrants, street lamps, wheels, and traffic cones —into unfamiliar surroundings and transforms them, by reworking or deforming their structures and configurations, in order to reveal something new about the ways in which these objects function in our everyday lives. He revels in the skewed, perspectives and unintended consequences that result from cultural exchange and displacement. Known for his humorous sculptural appropriations of public objects, Mark Handforth has used a breadth of subjects, including fire hydrants, stop signs, and even celestial forms such as stars. His highly popular neon installation at PAMM, Western Sun, is part of a group of works consisting of fluorescent light fixtures installed directly into the gallery wall in pictorial arrangements-- in this case, a partially setting sun disappearing into the floor. The work immerses everything around it, including the viewers body, in a dramatic, red -orange glow. Evoking the notion of human -made sunlight, it relates to visions of a world in which all things natural have been replaced by manufactured products. It is among the most Instagrammed works in the PAMM collection. Locally, he has also shown at MOCA in North Miami under the direction of Bonnie Clearwater. Handforth's dynamic and playful works extend ideas that have been at play in the artist's work for several years. He typically utilizes materials drawn from everyday civic infrastructure, such as streetlamps, road signs, fluorescent lights, and the like, but radically reworks and deforms them into new and exciting configurations. Let's start with how you came to this idea of 'Twisted L ampost Star' The lampost is a recurring motif in your work (for instance there is another Lamppost in Central Park, New York), and so is the star Stilt, this sculpture is a speafic response to the site and contest. You've had the opportunly to spend some time in Pw4 observe the site, and aiaw msprra- tion from it.. But aid the precise site appeal to you as such first-hand?And could you describe this observation/ working process, and how you came to elaborate this prcyect? Wei, rt's kind of a crazy site, a restless site... all action all the time, everyone passing through, a place on the way to everywhere else; and with the tramline running, now even more so. Then there's the Penferique just beyond, never stopping, always humming - not so much seen but very present somehow. At the same time there are these strangely peaceful moments here, under the great trees of the Park Sevenne, in the streets of bu- colic little houses, in the market stalls and the cafes that wrap the square. There's a kind of tension, but also a kind of poetry in the interaction of these opposites that I like very much. It took a little while to figure rt out. At first the square seems to be halfway up a hill, kind of lost in the middle, neither the bottom or the top - but in terms of an artwork this tums out to be an opportunity to play with vantage points, with views from above and below Similarly the streets that feed into the square would seem to block the work, yet instead form sight lines down canyons of buildings that frame certain perspectives and that in turn informs the work, gives each defined view, each approach a different set of meanings. of title alongside my original. Handforth is known for his adaptations of industrially manufactured signposts and urban *furnishings' such as street lamps, tires, motorcy6es, parking meters, public telephones, or hydrants. He uses these objects, altering them and sometimes reproducing them partially, thus often keeping the viewer in the dark about whether they are ready-mades or not He recognises things existing in the world and takes them as a basis for his work, subjecting them to a shift in time. By transforming the objects, the artist lets them gain a new sense of poetry that carries the idea of vanity. With his sculptures, Handforth creates a feel of urbanity. Mark is debating whether to complete his star series by creating an eighth and final star in silver. According to Mark, it was a challenge to convert the abstract rays of light that make up stars into a concrete sculptural form that also conveys movement.
