SUBJECT: FOLLOW UP ON ISSUES FROM THE SEPTEMBER 2, 1998 SUTNICK
HOUR
This Letter to the Commission is regarding three issues that were raised during the September 2,
1998 Sutnick Hour.
The first issue is relevant to traffic violations (speeding) in the area of 59th to 63rd Streets on Collins
Avenue. The Police Department STEP unit conducted four separate details at the location, between
September 15th - 25th, 1998 and issued only six citations. Officers who worked the detail reported
vehicles are averaging 35-40 m.p.h in a 35 m.p.h. zone.
The second issue is that of stores or shops that sell drug paraphernalia, commonly known as "Head
Shops." This was referred to the Police Departments Legal Advisor. The applicable law is found in
Chapter 893, sections 145, 146, and 147, Florida Statues. The statute states that unless there is proof
of narcotics, or advertisement for the specific use of illegal narcotics, the mere displaying of items
that may be associated with narcotics use is not illegal.
The last issue is that of the new City Ordinance that prohibits package sales of alcoholic beverages
after 10:00 P.M.. This issue will require more study. The Police Department is conducting the study
and the results will be furnished in mid-November.
