OF SUCCESSFUL NEGOTIATIONS BY THE ADMINISTRATION.

WHEREAS, at the May 15, 2024 Commission meeting, Commissioner Kristen
Rosen Gonzalez referred to the Finance and Economic Resiliency Committee item C4Y
to discuss strategies in bridging Miami Beach Fienberg Fisher K-8 funding gap in light of
their Title I funding loss for the 2024-25 school year; and
WHEREAS, in 2016, the City of Miami Beach passed Resolution No. 2016-
29284 allowing the City to partner with Miami-Dade County Public Schools (M-DCPS) to
utilize the parking lot at Miami Beach Senior High School for additional parking for
events taking place at the Miami Beach Convention Center; and
WHEREAS, M-DCPS approved the City's application for temporary use of school
building facilities with the City's Parking Department administering the City's use of the
Miami Beach Senior High parking lot by charging the general public the same municipal
parking special event rates approved at that time; and
WHEREAS, proceeds generated by the City's use of the school parking lot, net
of'all the City's costs and user fees payable to M-DCPS, were to be applied to support
Education Compact related programs at public schools located within the City of Miami
Beach, with any such proceeds to be allocated proportionately to each public school
based on each school's full-time equivalent student attendance, and used for the benefit
of Education Compact programs within the City; and
WHEREAS, Miami Beach Fienberg Fisher K-8 received Title I funds during the
2023-24 school year and funded paraprofessionals, a prekindergarten class, tutoring
(before and after school), and a community involvement specialist at a cost of
approximately $171,000; and
WHEREAS, for the 2024-25 school year, Miami Beach Fienberg Fisher K-8 is no
longer eligible to receive Title I funds; and
WHEREAS, per the district, Miami Beach Fienberg Fisher K-8 was notified of
their Title I ineligibility status determination for the 2024-25 school year; and
WHEREAS, the established economic poverty threshold for Title I funding is
75%, as per federal ESSA Section1113 (A)(i) and as depicted in the Florida Statute,
Section 1011.69 of the Equity in School-Level Funding Act; and
WHEREAS, based on the FDOE Title I Public School Eligibility Survey Data -
Survey 3 Report, the % of students deemed eligible for FY 2024-2025 for Miami Beach
Fienberg Fisher K-8 Location 0761 was 73.72%; and
WHEREAS, at the July 26, 2024, Finance and Economic Resiliency Committee
meeting, members unanimously supported the recommendation to negotiate an
agreement with the School Board of Miami-Dade County for the use of the parking lots
at Miami Beach Fienberg Fisher K-8 with any profit after City costs are covered shared
between the School Board of Miami-Dade County and the City of Miami Beach with the
City's portion being directed to Miami Beach public schools and the School Board's
utilization of their portion at their discretion across the Miami-Dade County Public
School District; and
WHEREAS, Chief Education Officer Dr. Leslie Rosenfeld has met with members
of the School Board. of Miami-Dade County to review opportunities for partnership to
support Miami Beach Fienberg Fisher K-8 funding loss; and
WHEREAS, the Administration will reach out to M-DCPS to understand the
district's plan to address potential Title I funding loss to Miami Beach Fienberg Fisher K-
8 in the 2025-26 school year and explore partnership opportunities to supplement
educational programming for students at Miami Beach Fienberg Fisher K-8 as a result
of potential funding loss; and
WHEREAS, Title I eligibility is determined on an annual basis based on Title I
eligibility criteria. Miami Beach Fienberg Fisher K-8 will be reconsidered during the
2024-25 school year for 2025-26 Title I eligibility based on Florida Department of
Education Public School Eligibility Survey 3 Report.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby direct the Administration to negotiate an agreement with the School
Board of Miami-Dade County for the use of the parking lots at Miami Beach Fienberg
Fisher K-8, with any profits from the use of the lot allocated as follows (1) fund all City of
Miami Beach upfront costs related to parking lot utilization including but not limited to
installation of parking meters, trash cans, and parking staff monitoring (2) fund all City
related costs during public utilization and (3) any profits beyond City costs to be shared
with the School Board of Miami-Dade County with a percent allocated to public schools
located in the City of Miami Beach and a percent to be utilized by the School Board of
Miami-Dade County at their discretion across all Miami-Dade County Public School; and
further authorize the City Manager or his/her designee to execute all agreements or
documents upon conclusion of successful negotiations by the administration.

RECOMMENDATION
Accept the recommendation of the Finance and Economic Resiliency Committee, made at the
July 26, 2024 meeting to negotiate an agreement with the School Board of Miami-Dade County
for the use of the parking lots at Miami Beach Fienberg Fisher K-8 with any profit after City costs
are covered shared between the School Board of Miami-Dade County and the City of Miami
Beach with the City's portion being directed to Miami Beach public schools and the School Board's
utilization of their portion at their discretion across the Miami-Dade County Public School District.
BACKGROUND/HISTORY
At the May 15, 2024 Commission meeting, item C4Y was referred by Commissioner Rosen
Gonzalez to the Finance and Economic Resiliency Committee to discuss strategies in bridging
Miami Beach Fienberg Fisher K-8 funding gap in light of their Title I funding loss for the 2024-25
school year (attachment A). Title I is the major component of the Elementary and Secondary
Education Act(ESEA), passed in 1965 as part of President Lyndon B. Johnson's War on Poverty.
Congress has reauthorized the Act numerous times since its enactment, making changes in focus
each time. The current reauthorization of ESEA is the Every Student Succeeds Act (ESSA),
signed into law by President Barack Obama on December 10, 2015.
Title I funding flows from the U.S. Department of Education (as appropriated by Congress)to the
Florida Department of Education (FDOE), which then allocates funds to Miami-Dade County
Public Schools (M-DCPS). The District adheres to Federal ESSA law mandates to ensure that

Title I School-wide Program funding is provided directly to eligible schools above the 75 percent
poverty threshold. Eligible schools spend the funds allocated based on formalized School
Improvement Processes approved by M-DCPS and FDOE.
Title I is part of ESSA that supports programs in schools and school districts to improve the
learning of children from low-income families. Title I is the largest federally funded education
program designed to provide students with additional help in Reading, Language Arts,
Mathematics, Science, and Social Studies.
The Title I Program is committed to helping schools close the achievement gap between
disadvantaged and minority students and their peers. ESEA ensures that federal funds provide
the additional educational resources that students and teachers in high-poverty schools need to
succeed and that supplement vs supplanting provisions are always observed.
In 2016, the City of Miami Beach passed Resolution No. 2016-29284 (attachment B)allowing the
City to partner with M-DCPS to utilize the parking lot at Miami Beach Senior High School for
additional parking for events taking place at the Miami Beach Convention Center. M-DCPS
approved the City's application for temporary use of school building facilities (attachment C)with
the City's Parking Department administering the City's use of the Miami Beach Senior High
parking lot by charging the general public the same municipal parking special event rates
approved at that time. Proceeds generated by the City's use of the school parking lot, net of all
the City's costs and user fees payable to M-DCPS, were to be applied to support Education
Compact related programs at public schools located within the City of Miami Beach,with any such
proceeds to be allocated proportionately to each public school based on each school's full-time
equivalent student attendance, and used for the benefit of Education Compact programs within
the City.
ANALYSIS
Each year, M-DCPS ensures that eligible schools receive Title I funding. Eligible schools spend
the Title I School-wide Program funds allocated, based on the School Improvement Process (Title
I Plan) as follows:
• Additional teachers and support staff
• Instructional coaches and academic tutoring
• Computers and educational software
• Supplemental instructional materials
• Early childhood services (i.e. full-day pre-kindergarten)
• Parent and family engagement activities and support.
Per Dr. Gilberto Bonce, North Region Director, Miami Beach Fienberg Fisher K-8 received Title I
funds during the 2023-24 school year (attachment D) and funded paraprofessionals, a
prekindergarten class, tutoring (before and after school), and a community involvement specialist
at a cost of approximately $171,000 (attachment E). For the 2024-25 school year, Miami Beach
Fienberg Fisher K-8 is no longer eligible to receive Title I funds. ESEA requires M-DCPS to
determine the eligibility of a school to receive Title I funds by annually ranking eligible schools in
which the concentration of children from low-income families exceeds 75 percent from highest to
lowest. M-DCPS is required to use the Direct Certified (DC) or Free or Reduced Price Lunch
(FRPL)data, based on the lunch program type selected for the school with the Florida Department
of Agriculture, from the Florida Department of Education (FDOE) Public School Eligibility Survey
3 Report of the current year in order to determine the Title I eligibility of a school for the following
year. If a school that is currently implementing the Title I School-wide Program does not meet the
Title I eligibility threshold, it will not be designated as a Title I school for the subsequent school
year.

Per the district, Miami Beach Fienberg Fisher K-8 has been notified of their Title I ineligibility

completing the FY 2024-2025 Federal Programs Consolidated Grant Applications.
Per email received on August 12, 2024 from Region Administrative Director Gilberto Bonce
(attachment G), Miami Beach Fienberg Fisher K-8 will be held harmless for their Title I funding
loss in the 2024-25 school year. The school will have a reading coach, a community involvement
specialist,a paraprofessional,and will also receive a new VPK allocation. Additionally,the school
will be provided with funds to cover the cost of tutorial services for the students at the school.

Miami Beach Fienberg-Fisher K-8 (MBFFK-8) Center, an International Baccalaureate school in South Beach, FL. With students
from nearly 100 countries, Fineberg-Fisher prioritizes holistic education, offering robust music, fine arts, and physical education
programs. In May, MDCPS leadership met with MBFFK-8 leadership, for the Budget conference for the upcoming school year, to
determine if the school qualifies for Title I status and funds based on the number of Full-Time Equivalent (FTE) certified students.
During the May budget Conference, it was determined that MBFFK-8 would lose its Title 1 funding. Without Title I funding, MBFFK-
8 faces a funding gap of about 250,000. With the lost funding, the student population at MBFFK-8 faces an educational risk with
the belief that the learning impact/loss will spill over to Miami Beach Senior High as the children move.

FLORIDA, APPROVING AND AUTHORIZING THE CITY
MANAGER AND CITY CLERK TO EXECUTE AN
AGREEMENT WITH THE SCHOOL BOARD OF MIAMI-

nevertheless continue to host events throughout the 2016, 2017, and 2018 calendar years, and
such events require public parking access; and
WHEREAS, access to the parking lot at Miami Beach Senior High School after-school •
hours and weekends will increase public parking in the vicinity of the Convention Center by
approximately 300 spaces, and thereby reduce the temporary parking impacts associated with
the Project; and
WHEREAS, the City has submitted an Application for Temporary Use of School Building
Facilities of the Miami Dade County Public Schools — Temporary Use Agreement FM-0117 for
one (1) year; and

WHEREAS, the M-DCPS will allow for access to the Miami Beach Senior High School
parking lot on requested dates, for an hourly fee-between $100 and $150 per hour, depending
on the dates requested; and
WHEREAS, the-City's Parking Department will administer the City's use of the Miami
Beach Senior High School parking lot, and will charge the general public the same municipal
parking special event rates that previously applied at the P-lot; and
WHEREAS, the City will request permission from M-DCPS to connect the bus loop to
the parking lot area in order to reduce the impact of traffic on Prairie Avenue, for a cost not-to-

Miami Beach Convention Center, for an initial term of one (1) year, with two (2) one-year
renewal options, at the mutual discretion of the City Manager and M-DCPS

BACKGROUND
Since the Education Compact implementation on January 16, 2008, the City of Miami
Beach has collaborated with Miami-Dade County Public School (M-DCPS) to improve
educational opportunities for youth. The Miami Beach Convention Center Renovation
and Expansion Project ("Project") has commenced, resulting in a temporary decrease in
the 800+ public parking spaces at the "P-lot" due to construction staging requirements.
The Miami Beach Convention Center will nevertheless continue to host events
throughout the 2016, 2017, and 2018 calendar years, and such events require public
parking access. Access to the parking lot at Miami Beach Senior High School after-
school hours and weekends will increase public parking in the vicinity of the Convention
Center by approximately 300 spaces, and thereby reduce the temporary parking impacts
associated with the Project.
The City has submitted an Application for Temporary Use of School Building Facilities of
the Miami Dade County Public Schools — Temporary Use Agreement FM-0117 for one
(1) year. M-DCPS will allow for access to the Miami Beach Senior High School parking
lot on requested dates, for an hourly fee between $100 and $150 per hour, depending
on the dates requested. The City's.Parking Department will administer the City's use of
the Miami Beach Senior High School parking lot, and will charge the general public the
same municipal parking special event rates that previously applied at the P-lot. The City

will request permission from M-DCPS to connect the bus loop to the parking lot area in
order to reduce the impact of traffic on Prairie Avenue at a cost not to exceed $25,000.
The proceeds generated by the City's use of the parking lot, net of all of the City's
parking costs and user fees payable to the M-DCPS, will be applied to support
Education Compact-related programs at public schools located within the City of Miami
Beach, with any such proceeds to be allocated proportionately to each public school
based on each school's full-time equivalent student attendance, and used for the benefit
of Education Compact programs within the City.
CONCLUSION
The Administration recommends the approval of this Resolution. This approval will assist
the City Manager's Office and Office of Organization Development Performance
Initiatives in accomplishing its measurable objectives linked to the City's Key Intended
Outcome to Improve Alliance with Key Business Sectors, Namely Hospitality, Arts, &
International Business with a Focus on Enhanced Culture, Entertainment, & Tourism and
Achieve Ed cational (K-12) Excellence.

The North Region Office has received confirmation,that Miami Beach Fienberg Fisher K8 will be
held harmless for their Title I funding loss this school year. The school has a reading coach, a
community involvement specialist,a paraprofessional, and will also receive a new VPK
allocation. Additionally,the school will be provided with funds to cover the cost of tutorial
services for the students at the school.

fully funded ($171,000) in school year 2024-25 by MDCPS and that no support from the City of Miami
Beach is needed to fill the gap caused by the loss of Title Ito MB Fienberg Fisher K-8.
