The proposed Ordinance will not impact the City of Miami Beach's regulatory costs and

The attached Ordinance was prepared at the request of Vice-Mayor Alex J.Fernandez,
Commissioner David Suarez,Commissioner Tanya K.Bhatt,Commissioner Laura Dominguez,
Commissioner Joseph Magazine,Mayor Steven Meiner,and Commissioner Kristen Rosen
Gonzalez for consideration at the September 25,2024 City Commission meeting.
In 2019,the Mayor and City Commission adopted Ordinance No.2019-4299,providing,among
other things,for an annual adjustment by the City Manager to certain specified fees and charges
in Appendix A to the City Code,entitled "Fee Schedule,"to reflect increases in the Consumer
Price Index ("CPP).The Parking fees were scheduled to adjust every five (5)years consistent
with the CPI,rounded up to the nearest dollar,with the first five 5-year adjustment scheduled to
occur on October 1,2024.
Some of the changes to parking rates resulting from this 5-year adjustment include increasing the
fee for the Resident Parking Discount Program from $1 to $2 per hour and increasing the parking
meter rate for the Entertainment District Parking Zone from $4 to $6 per hour for on-street parking.
In order to mitigate the financial burden of the CPI adjustment on the City's residents,the
workforce,and its visitors,the Mayor and City Commission now wish to repeal the automatic 5-
year CPI adjustment.The Administration has determined that the repeal of the automatic 5-year
CPI adjustment for parking rates will reduce revenues by approximately $4,800,000 in FY 2025-
26 but will not impact City's operational budget or affect the operations of the Parking Department.

SECTION 3.SEVERABILITY.
If any section,subsection,clause or provision of this Ordinance is held invalid,the
remainder shall not be affected by such invalidity.
SECTION 4.CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach,
and it is hereby ordained that the provisions of this Ordinance shall become and be made
a part of the Code of the City of Miami Beach,Florida.The sections of this Ordinance
may be renumbered or re-lettered to accomplish such intention,and the word "ordinance"
may be changed to "section,""article,"or other appropriate word.
SECTION 5.EFFECTIVE DATE.
This Ordinance shall take effect ten days following adoption.
