A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, APPROVING, IN SUBSTANTIAL FORM, THE
AGREEMENT BETWEEN THE MIAMI-DADE COLLEGE FOUNDATION,
INC. AND THE CITY OF MIAMI BEACH (THE "CITY") TO PROVIDE
FUNDING FOR THE CITY OF MIAMI BEACH SCHOLARSHIP FUND FOR
MIAMI BEACH RESIDENTS, WITH THE AMOUNT OF FUNDING FROM
THE CITY IN THE AMOUNT OF $30,000 FOR THE 2024-2025 SCHOOL
YEAR AND INCLUSION OF ADDITIONAL FUNDS FROM DONATIONS,
AND FURTHER AUTHORIZING THE CITY MANAGER TO FINALIZE AND
EXECUTE ALL RELATED AGREEMENTS AND TO REASSESS THE
SCHOLARSHIP DURING THE FY 2026 BUDGET PROCESS FOR
FUNDING FOR SUBSEQUENT YEARS.
WHEREAS, at the September 11, 2024 City Commission meeting, the Mayor and
Commission adopted Resolution No. 2024-33273, authorizing the negotiation of an agreement
with Miami Dade College Foundation to provide funding for the City of Miami Beach Scholarship
Fund for Miami Beach residents; and
WHEREAS, the City of Miami Beach is committed to supporting educational
opportunities for its residents, particularly those who are the first in their families to pursue a
college education; and
WHEREAS, the Miami Dade College Foundation has a long-standing reputation for
providing scholarships and financial assistance to students who face financial barriers to
accessing higher education; and
WHEREAS, the provision of funding for first-generation college scholarships will help
ensure that Miami Beach residents have the opportunity to achieve their educational goals and
contribute positively to their community; and
WHEREAS, on September 14, 2022, the Mayor and Commission adopted Resolution
No. 2022-32286 authorizing the City to execute agreements with the Miami Beach Police
Athletic League, Inc ("MBPAL") and the Miami Beach Chamber Education Foundation, Inc.
("MBCEF") to provide funding for First Generation College Scholarship for Miami Beach
residents through agreements with Florida International University Foundation, Inc. with a 2:1
matching grant; and,
WHEREAS, during the September 16, 2024 and September 25, 2024 budget meetings,
the Mayor and City Commission approved $30,000 in funding for the 2024-2025 school year to
promote social and economic mobility within the community through the City of Miami Beach
Scholars Fund; and
WHEREAS, the agreement with the Miami Dade College Foundation will provide for a
2:1 match for all dollars allocated or donated to the City of Miami Beach Scholarship Fund for
Miami Beach residents during the term of this Gift Agreement; and
WHEREAS, the City of Miami Beach Scholarship Fund will be provided to eligible Miami
Beach resident college students who meet the following criteria:
(1) Resident of the City of Miami Beach (33139, 33140, 33141-excluding North Bay Village), (2)
Pursuing an Associate Degree, Bachelor Degree or certificate program at Miami Dade College,
(3) Ineligible for Future Ready Miami Dade Scholarship, (4) Pell Grant eligible or eligible for
Miami Dade College equivalent scholarship, (5) Miami Beach Scholarship funds to be applied
as "Last Dollar"; and
WHEREAS, should there be no eligible students, other Miami Beach students will be
eligible, and funding will be awarded based on financial need as indicated by the Free
Application for Federal Student Aid ("FAFSA") "unmet need" of the student; and
WHEREAS, scholarships may be renewable upon meeting certain criteria including
recipients demonstrating financial need by completing the FAFSA and being eligible for a Pell
Grant or equivalent Miami Dade College Scholarship, and recipients must also be enrolled in or
accepted for admission to the Miami Dade College, and be pursuing an Associate Degree,
Bachelor Degree or certificate program at Miami-Dade College, or enrolled for a minimum of six
credit hours per semester; and
WHEREAS, the total contribution for the fiscal year 2025 from the City of Miami Beach is
$30,000, and the Miami Beach Chamber Education Foundation, Inc. will contribute $3,000 and
other possible donations all are to be matched 2:1 by Miami Dade College Foundation.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve, in substantial form, the agreement between the Miami-Dade
College Foundation, Inc. and the City of Miami Beach (the "City") to provide funding for the City
of Miami Beach Scholarship Fund for Miami Beach residents, with the amount of funding from
the City in the amount of $30,000 for the 2024-2025 School Year and inclusion of additional
funds from donations, and further authorize the City Manager to finalize and execute all related
agreements and to reassess the scholarship during the FY 2026 budget process for funding for
subsequent years.

RECOMMENDATION
The Administration recommends the approval of the agreement, in substantial form, with the
Miami Dade College Foundation to provide funding for the City of Miami Beach Scholarship Fund
for Miami Beach residents, and authorize the City Manager to execute all related agreements.
BACKGROUND/HISTORY
At the September 11, 2024 Commission Meeting the Mayor and Commission approved
Resolution 2024-33273 (attachment A), requesting the support of the Mayor and Commission to
negotiate an agreement with Miami Dade College Foundation to provide funding for the City of
Miami Beach Scholarship Fund for Miami Beach residents (attachment B).
The City of Miami Beach is committed to supporting educational opportunities for its residents,
particularly those who are the first in their families to pursue a college education. The Miami Dade
College Foundation has a long-standing reputation for providing scholarships and financial
assistance to students who face financial barriers to accessing higher education. The provision
of funding for first generation college scholarships will help ensure that Miami Beach residents
have the opportunity to achieve their educational goals and contribute positively to their
community.
The City of Miami Beach currently has a separate agreement with the Miami Beach Chamber
Education Foundation, Inc. established as of September 14, 2022 when Resolution No. 2022-
32286 (attachment C)was passed to approve and authorize the City to execute agreements with
the Miami Beach Police Athletic League, Inc (MBPAL) and the Miami Beach Chamber Education
Foundation, Inc. (MBCEF) to provide funding for the First Generation College Scholarship for
Miami Beach residents through agreements with Florida International University Foundation, Inc.
providing a 2:1 matching grant.
ANALYSIS
Investing in the education of Miami Beach residents is a vital step in promoting social and
economic mobility within the community.Approved funding in the amount of$30,000 for the 2024-

2025 school year and the acceptance of donations will providing additional support to eligible
Miami Beach residents.
The Foundation will provide a 2:1 match for all gifts received during the term of this Gift Agreement
and thereafter (attachment D).

WHEREAS, in January 2008, the City of Miami Beach, Florida ("City") entered into an
Education Compact with Miami-Dade County Public Schools (M-DCPS) to enhance learning
opportunities for youth; and
WHEREAS, the Education Compact reflects the desire of the Miami Beach community
to support excellence in the City's public schools; and
WHEREAS, the Florida International University (FIU) First Generation Scholarship
Program is supported by an innovative matching grant program established in 2006 by the
Florida Legislature; and
WHEREAS, the program provides financial support to qualified undergraduate FIU
students who are the first generation in their families to attain a college degree; and
WHEREAS, this program is the only one of its kind in the state .of Florida to match
private donations for first generation scholarships, providing financial assistance for students to
attend a state university or state college; and
WHEREAS, to date, FIU has awarded over 15,300 scholarships for critical financial
support for FIU students; and
WHEREAS, the need, however, is far greater than the available resources — currently,
less than one in seven eligible students receives a First Generation Scholarship; and
WHEREAS, as a result, many talented and highly motivated students with limited
resources are forced to attend only part-time or postpone their education altogether; and
WHEREAS, the First Generation Scholarship Program is, therefore, a vital source of
financial support for many of FIU's underserved, low-income students that bridges the gap
between their financial aid funding and their unmet need to fund their cost of attendance at FIU;
and

WHEREAS, increased scholarship and program financial aid are critical to ensure that
all deserving students receive the assistance needed to enroll, succeed, and graduate.; and
WHEREAS, FIU serves more than 58,000 students, 70% of whom are undergraduates,
approximately 90% of FIU undergraduate students are minorities, and nearly 25% self-identify
as first generation college students; and
WHEREAS, first generation students are more likely than their peers to come from
lower-earning households, and yet, despite the significant need, a high percentage of FIU
students receive only partial financial aid, and many students eligible for First Generation
Scholarships remain unfunded; and
WHEREAS, in 2020-21, donor investment and state-matched funds supported 889
students, while 6,555 (88.1%)students did not receive funding; and
WHEREAS, investing in FIU's First Generation Scholarship Program will benefit not only
the students, but the greater Miami Beach community; and
WHEREAS, the City of Miami Beach will contribute $28,000 for First Generation
Scholarships and partner with the Miami Beach Police Athletic League, Inc. ("MBPAL") which
will contribute $3,500, and the Miami Beach Chamber Education Foundation, Inc. ("MBCEF")
which will also contribute $3,500, for total investment in the FIU First Generation Scholarship in
the amount of$35,000; and
WHEREAS, the Florida state matching funds will provide an additional $70,000 which is
a 2:1 match yielding a total amount of$105,000 for FIU first-generation scholarships; and
WHEREAS, approximately 30 students who are residents of the City would receive a
$3,500 scholarship in the 2022-23 school year; and
WHEREAS, funding will be prioritized to meet the needs of students who are degree-
seeking undergrad students with a permanent address in the City and with zip codes of 33139,
33140, and 33141 (only residents in the City) with a preference for First Time in College (FTIC)
students; and
WHEREAS, should there be no eligible FTIC students, other Miami Beach students will
be eligible, and funding will be awarded based on financial need as indicated by the FAFSA
"unmet need" of the student; and ,
WHEREAS, in an event where there will not be enough students eligible to award the
funds that meet these criteria, funds will be rolled over to the following year or scholarship
• amounts per student can be increased; and
WHEREAS, scholarships may be renewable upon meeting certain criteria including
recipients demonstrating financial need by completing the national Free Application for Federal
Student Aid (FAFSA) and being eligible for a Pell Grant, recipients must also be the first
generation in their family to attain a college bachelor's degree (students whose siblings have
attained or are pursuing a degree are also eligible, recipients must be residents of the State of
Florida, be enrolled in or accepted for admission to the FIU, and be a degree-seeking
undergraduate student enrolled for a minimum of six credit hours per semester.

COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve and authorize the City Manager and City Clerk to execute

RECOMMENDATION
Approve the resolution and partnerships to provide First Generation Scholarships to eligible
Miami Beach residents.
BACKGROUND/HISTORY
In January 2008, the City of Miami Beach, Florida ("City") entered into an Education Compact
with Miami-Dade County Public Schools (M-DCPS) to enhance learning opportunities for
youth. The Education Corrpact reflects the desire of the Miami Beach community to support
excellence in the City's public schools.
The Florida International University(FI U)First Generation Scholarship Program is supported by
an innovative matching grant program established in 2006 by the Florida Legislature. The
program provides financial support to qualified undergraduate FIU students who are the first
generation in their families to attain a college degree. This program is the only one of its kind in the
state of Florida to match private donations for first generation scholarships, providing financial
assistance for students to attend a state university or Florida college.

To date, FIU has awarded over 15,300 scholarships for critical financial support for FI U
students. The need, however, is far greater than the available resources—currently, less than one in
seven eligible students receives a First Generation Scholarship. As a result, many talented and
highly motivated students with limited resources are forced to attend only part-time or postpone their
education altogether. The First Generation Scholarship Program is, therefore, a vital source of
financial support for many of FIU's underserved, low-income students that bridges the gap between
their financial aid funding and their unmet need to fund their cost of attendance to FIU.
ANALYSIS
Increased scholarship and program financial aid are critical to ensure that all deserving students
receive the assistance needed to enroll, succeed, and graduate. Investing in F I U's First
Generation Scholarship Program benefits not simply the students, but the greater Miami Beach
community. FIU serves more than 58,000 students, 70% of whom are undergraduates.
Approximately 90%of FIU undergraduate students are minorities,and nearly 25%self-identify as first
generation college students.
First generation students are more likely than their peers to come from lower-earning
households. Despite the significant need,a high percentage of FIU students receive only partial
financial aid, and many students eligible for First Generation Scholarships remain unfunded. In
2020-21, donor investment and state-matched funds supported 889 students, while 6,555 (88.1%)
students did not receive funding. Receiving an award is elusive for many FIU students, as the
demand for funds exceeds FIU's aid,budget.
The City of Miami Beach will partner with the Miami Beach Police Athletic League, Inc.
("MBPAL")and the Miami Beach Chamber Education Foundation, Inc.("MBCEF"). The City of
Miami Beach will contribute $28,000 for First Generation Scholarships and partner with the Miami
Beach Police Athletic League, Inc. ("MBPAL") which will contribute $3,500 and the Miami Beach
Chamber Education Foundation, Inc. ("MBCEF")which will contribute$3,500 for total investment in
the FIU First Generation Scholarship of$35,000 and the Florida state matching funds will provide an
additional $70,000 which is a 2:1 match yielding a total amount of$105,000 for FIU first-generation
scholarships.
Approximately 30 students who are residents of the City of Miami Beach would receive a
$3,500 scholarship in the 2022-23 school year. Funding will be prioritized to meet the needs of
students who are degree-seeking undergrad students with a permanent address in the city of Miarri
Beach and with zip codes of 33139, 33140, and 33141 (only residents in the city of Miami Beach)
with a preference for First Time in College (FT IC) students. Should there be no eligible FTIC
students, other students will be eligible. Funding will be awarded based on financial need as
indicated by the FAFSA"unmet need" of the student. If there are not enough students eligible to
award the funds that meet this criteria, funds will be rolled over to the following year or scholarship
per students can be increased;and
Scholarships may be renewable upon meeting criteria including recipients demonstrate financial
need by completing the national Free Application for Federal Student Aid (FAFSA) and be
eligible for a Pell Grant, recipients must be the first generation in their family to attain a college
bachelor's degree (students whose siblings have attained or are pursuing a degree are also
eligible, recipients must be residents of the State of Florida, be enrolled in or accepted for
admission to the University, and be a degree- seeking undergraduate students enrolled for a
minimum of six credit hours per semester.

THE CITY OF MIAMI BEACH SCHOLARSHIP FUNDs
The following sets forth the agreement between the City of Miami Beach (the "Donor") and Miami
Dade College Foundation, Inc. (the "Foundation"), for the benefit of Miami Dade College (the
"College"). This Gift Agreement concerns the purpose, conditions, recognition, and administration of
the Donor's gift to the Foundation.
1. Amount of the Gift
The Donor wishes to further the educational purposes of the College by making a gift in the
amount of$30,000 to the Foundation to establish a non-endowed scholarship fund (the "Gift").
The Foundation shall provide a 2:1 match for all gifts received during the term of this Gift
Agreement and thereafter.
2. Purpose of the Gift
The purpose of the Gift is to provide scholarships to students who are residents of the City of
Miami Beach. A non-endowed scholarship fund will be established with the Gift and the
Foundation will name the scholarship fund, The City of Miami Beach Scholarship Fund (the
"Fund").
3. Payments
a. The Donor irrevocably promises to give or cause to be given to the Foundation the Gift,
in cash or check, and agrees that the Gift is due and payable no later than December 31,
2024.
b. The Donor reserves the right to make additional gifts to the Fund and shall permit others
to contribute thereto, but all such gifts shall be subject to the terms and conditions of this
Gift Agreement.
c. The Donor may have the option to make payment(s) via mdcfoundation.com/give or by
mail with check(s)payable to Miami Dade College Foundation, Inc. 300 NE 2nd Avenue,
Room 1423-1, Miami Florida 33132, by any other reasonable commercial means used to
transfer funds or securities by calling 305-237-3945.
4. Scholarship Selection Procedures and Eligibility
a. Selection Procedure: The selection of recipients will be made in accordance with the
College's standard scholarship selection procedures. Students will be selected under the
Non-Endowed Scholarship Gift Agreement: The City of Miami Beach Scholarship Fund

direction of the College's Director of Scholarships. If different criteria are not specified
below, scholarship recipients will be chosen principally on the basis of academic
performance or potential and the extent of unmet financial need.
b. Eligibility: The City of Miami Beach Scholarship Fund will be provided to eligible
College students who meet the following criteria:
1. Resident of the City of Miami Beach(33139, 33140, 33141(excluding North Bay
Village))
2. Pursuing Associate Degree, Bachelor Degree or certificate at Miami Dade
College
3. Ineligible for Future Ready Miami Dade Scholarship
4. Pell Grant eligible or eligible for equivalent Miami Dade College scholarship
5. Miami Beach Scholarship funds to be applied as "Last Dollar"
5. Recognition
a. Recipients of The City of Miami Beach Scholarship Fund will be known as The City of
Miami Beach Scholarship Fund recipients.
b. The Donor agrees to allow the Foundation and the College to publish the Donor's name
and information about the Gift in various publications and press releases. For recognition
purposes, the Donor wishes to be recognized as follows: the City of Miami Beach

6. Administration
a. The Foundation will manage the Fund in accordance with the applicable management
policies of the Foundation, as updated from time to time, and this Gift Agreement.
b. The Office of Financial Aid will administer the scholarships in accordance with the
provisions of this Gift Agreement and in conformity with all applicable laws and College
policies and regulations, as may be amended from time to time.
c. This Gift Agreement will be part of the Foundation's records and is intended as a guide to
those who will administer the Fund in the future.
d. In the event of any legal impropriety on the part of the Donor, the Foundation and
College will have the right to reconsider any naming recognition given to the Donor in
consideration of this Gift.
7. Miami Dade College Foundation,Inc. Qualifications

The Internal Revenue Service has declared the Foundation to be a duly qualified charitable
organization under section 501(c)(3) of the Internal Revenue Code. Furthermore, the
Foundation has been certified by the College as a direct support organization of the College in
accordance with Florida Statute Section 1004.70. Donations to the Foundation are tax
deductible as permitted under Internal Revenue Code sections 170, 2055, 2106 and 2522.
8. Disposition of Funds Under Extraordinary Circumstances
It is the intent of the parties to this Gift Agreement that this Fund will continue to be utilized
under the terms and conditions specified herein. The parties recognize that the College's
academic structure and its needs evolve over time. If such evolution leads this Fund to be
administered by a new or different academic unit or in the event that the Fund cannot be used
for the purpose intended because the purpose is no longer appropriate, necessary, practical, or
possible, or if for other substantial and lawful reasons the purpose cannot be accomplished,
including, but not limited to changes in College practices, policies or organizational structure,
the Foundation must return unused funds to the City of Miami Beach on an annual basis.
9. Miscellaneous
a. This Gift Agreement will be construed in accordance with, and the administration of the
assets held in the Fund will be determined by, the laws of the State of Florida. In the event
of any action arising under this Gift Agreement, the venue of such action shall lie
exclusively within the state courts of Florida located in Miami-Dade County, Florida, or
the United States District Court for the Southern District of Florida, and the parties hereto
specifically waive any other jurisdiction and venue.
b. A one-time 2.5% origination fee will be assessed on all contributions received by the
Foundation for reasonable and proper compensation as per Foundation Policy. Donor will
receive credit for the full amount of the Gift.
c. The Donor and Foundation may jointly amend the Gift Agreement whenever necessary or
advisable for the more convenient or efficient administration of the Fund or to enable the
Foundation to carry out the purposes of the Gift more effectively. Amendments to this Gift
Agreement shall be made in writing and signed by the parties. No such amendment shall
alter the intention of the Donor that the Gift be used exclusively for charitable, scientific,
literary or educational purposes and in a manner which will make donations tax deductible
to the extent allowed by law.
d. College is a third-party beneficiary under this Gift Agreement.
e. The effective date of this Gift Agreement shall be the date on which it is fully executed as
reflected by the last date of signature below by Donor and Foundation.
